Councilman Coons suggested we acknowledge 'receipt of the letter from the Orange County Property Owners Association and'thank them for their interest, advising them that it is our feeling %ha% the issue involved in their recommendation goes beyond %he point of just an election of a Mayor by popular vote, such as area representation, district representation, the possibility of more than a five man Council, the formation of the Charter for the City, and other items of a similar nature; %hat all these things should be studied in considering a Charter form of Government. CONDITIONAL USE PERMIT NO. 140 - CONDITIONAL USE PERMIT NO. 186: Mr. James Maddox, City Engineer, reported on a meeting with Mr. Freedman and Mr. Stout of McDaniel Engineering, regarding waiver of sidewalks and permitting the construction of industrial type curb in lieu of standard type curb. He advised that Mr. Freedman remained at the meetinq only a short times however, Mr. Stout and Mr. Freedman agreed on a solution. He explained %he terms of their agreement as outlined in his let%er to Mr. Freedman da%ed February 5, 1962. It was moved by Councilman Thompson, seconded by Councilman Fry, thai the conditions as required by %he City Engineer pertaining to these developments be approved. MOTION CARRIED. PUBLIC HEARING - HOUSE MOVING PERMIT: Submitted by Union Development Company, requesting permission to move a dwelling from 11110 Garetal, Santa Fe Springs, California to 3340 West Thornton Avenue, Anaheim, California. The Mayor asked if anyone wished to address the Council, there being no response, declared the hearing closed. Mr. Murdoch reported that if said permit is granted, the City Engineer recommends that a sidewalk waiver be granted with the provision that no trees or other permanent planting be permitted in the area assigned for sidewalks, as Thornton Avenue has curb, gutter and paving, and no additional right-of-way is required. RESOLUTION NO. 62R-107: Councilman Thompson offered Resolution No. 62R-107 for passage and adoption, granting House Moving Permit as requested, and further granting temporary waiver of sidewalk, with provision that no tree or other permanent plan%lng be permitted in %he area assigned for said sidewalk. SIGN APPLICATION - SIGNAL OIL COMPANY: Application for permission to erect two non-conforming signs ~versize with five foot projection) at llO1 North Euclid Avenue, together with plans, was submitted and reviewed by the City Council. Councilman Coons moved that the request for the 7 foot by 25 foot sign on Euclid Avenue be granted, providing the projection of the sign over the property right-of-way shall not exceed four fee%; and %hat the request for the relocation of %he circle sign on the La Palma Avenue frontage also be approved. Councilman Thompson seconded the motion. MOTION CARRIED. SIGN APPLICATION - SEASIDE OIL COMPANY: Application for permission to erect non-conformin9 sign at 1733 South Brookhurst Avenue~ together with plans~ was submitted and reviewed by the City Council. Councilman Thompson moved said sign application be granted in accordance with the plan submitted (four foot projectlonl. RECLASSIFICATION NOo 60-61-94: Request of Mr~ Frank Riggi for waiver of require- ment for construction of a wall on the easterly line of 1200 Katella Avenue, front to rear9 and allowing said wall to stop at the garage line, was sub- mitted (copies furnished each Councilman)° It was noted that subject property at 1200 Katella Avenue is zoned R-I~ and that the adjacent pzoperty to the East is zoned C-i9 pursuant to Reclassification Nco 60-61-94o Mro Frank Riggi~ owner of the property at 1200 Katella Avenue, addressed the Council noting the location of the property~ and advised that ?:e ~as spoken with Mro Vaughan~ owner of the C-1 property to the East, and he also desired to have the wall. requirement dele%ed from this portion of the property° Mr° Riggi further advised that it is his intent to file an application for C-] zoning on his property within the next sixty days° Plans from file No° 60-61-94 were reviewed by the City Council and discussion was heldo Councilman Coons moved that a six months temporary waiver of the wall requirement be granted~ subject to the posting of a bond in sufficient amount satisfactory 'to the City Attorney~ guaranteein9 the construction of said improvement° Councilman Fry seconded the motion° Further discussion was held by the City Council regarding the responsibility of Mro Vaughan9 owner of the adjacent C-1 property9 and at the conclusion 'bhereof~ Councilman Coons, and Councilman Fry withdrew the previous motion° Councilman Coons moved that action on said request be continued for one week~ February 20~ !962~ at 3:00 PoM,9 to allow f~r further study and investigation~ and that both Mro Riggi and Mro Vaughan be requested to attend said meeting° Councilman Thompson seconded the motion° MOTION CARRIED, RECLASSIFICATION NOo 61-62=,23: Request of Mro Joseph Mo Girard, Girard and Pastel~ Atto~neys~ on behalf of the owners of property included in Reclassi- fication Nco 61,~,62-23 for 120 day extension of time for compliance with conditions as set forth in Resolution No° 73059 was submitted° On motion by Councilman Thompson, seconded by Councilman Fry~ said extension of t~me was granted as requested° MOTION CARRIED° CONDITIONAL USE PERMIT NO~ 134: Request of Mr° John Krajacic for a 180 day extension of time for compliance with conditions set forth in Resolution Nco 71289 was submit%ed and granted on motion by Councilman Fry, seconded by Councilman Thompson° MOTION CARRIED° INTERPRETATION - SECTION 18o32o050: Mr° Harry Knisely requested interpretation of Section 18o32o050 of the Anaheim Municipal Code to determine whether or not a lot of record zoned R,~3 would be required to comply with the new R-3 Regu.[ations concerning setbacks and ici area°. Mr° Joseph Gets.let9 Assistant City Attorney, read the section of the Cede referred to, and recommended any deviation from the R=3 require- ments be by Variance procedure or by determination of the City Council based on factual circumstances° It was reported Variance Application No° 1445 pertainin9 to certain deviations will be before the City Planning Commission on February 19, 1962o ~470 City Hall9 Anaheim~ California - COUNCIL MINUTES - February 139 19629 3:00 P.M. Mro Knisely advised that these plans are the same as were previously allowed to be constructed under similar conditions at 211 and 215 South Rose Street without any complications; however, upon applying for a building permit for subject development, plan check revealed that under the new R-3 regulations, it would be practically impossible to comply because of the lot size° That in an effort to solve this problem, a variance was applied for; however~ a financial situation now makes it necessary to request the Council to make a determination and interpretation relative to this section of the Code to avoid any further delay° Discussion was held by the City Council and plans for development were reviewed° At the conclusion of the discussion, it was moved by Councilman Chandler~ seconded by Councilman Thompso6 that the plan submitted this date, dated and signed by Councilman Coons, conform as nearly as possible to the R-3 requirements 'that could be applied to a fifty foot loto MOTION CARRIED. POLICY': Councilman Coons moved that all future developments on substandard R-3 lots of record as of September 15~ 1959, be referred to the City Attorney and Architectural Control Board~ and that %hey be empowered %o determine if plans submit%ed conform as nearly as possible to the R-3 requirements that %he size of the lot makes i% possible to comply with (Sec%ion 18o32o050)o Councilman Thompson seconded %he motion° MOTION CARRIED.
