Mayor Pro Tem Fry called the meeting to order°
MINUTES: Minutes of the City Council meeting of February 13, 1962~ were approved
on motion by Councilman Coons~ seconded by Councilman Chandler° MOTION
CARRIED.
TRASH CONTAINER PROGRAM: Mr° Thornton Piersall~ Director of Public Works, repor-
ted on studies and investigation reiative to 'the trash program~ particularly
as it pertains to the fifty gallon drums~ and the apartment house storage
bins9 and submitted to each Councilman a copy of their proposed trash
container program dated February~ 19629 setting forth in detail their recom-
mendations as to type of container~ cost and disposition thereof; that
basically this proposal would provide the property owner with a minimum of
two plastic containers with altached lid9 which would be purchased by the
City at an approximate cost of $6o75 each~ and recovery of cost thereof
would be by adding a minimum rental fee of fifty cents per month to the
present trash and sanitation charges; that at the option of the apartment
house owners9 buik Oins furnished by the 'trash contractor could be used for
a rental fee of $5°00 per mon%bo Furiher~ that he would also recommend a
a twenTy-four month period for property owners who presently have 9cod
lightweight containers to replace-them with the plastic container°
Mro Piersall reported tha± during the past six weeks containers
of 'this type have been used in ceriain areas on an experimental basis, and
presented a short film show~hg the present 'trash collection procedure, and
comparing the present sJiua~ion wflh the recommended change°
At the conclusion of the film~ Mayor Pro Tem Fry' thanked Mr°
Piersall for his complete report~ and stated that the Council would take

CENTRAL LIBRARY- FINAL PLANS: Mro Joe Jozdan9 Architect9 submitted an artist~s
rendering and final plans of the Central Library for Council approval9 and
advised that he has received approval of said plans from the Library Board°
He stated 'the plans are now in plan checK~ and %ha% minor changes as sug-
gested by the Cit? departments would be made prior to final printing of the
plan$~ that they have completed their detail wor~ and ~o~id go to bid on

The Mayor declared Resolution No. 62R-155 duly passed and adopted.
RECLASSIFICATION NO. 60=61-94: Request of Mr. Frank Riggi for waiver of wall
requirement on the easterly line of 1200 Katella Avenue, front to rear, and
allowing said wall to stop at the garage line, was submitted at the meeting
of February 139 1962~ and continued to this date to allow for further
investigation and for contact with Mr. Vaughan~ the owner of the adjacent
C-1 property°
Plans from file No. 60-61-94 were reviewed by the Council and it
was noted that a condition of the rezoning was development in accordance
with plans presented, and that the plans indicate the construction of a
wall to the sidewalk.
Mr. Vaughan, owner of the C-1 property, was of the opinion that
the wall was to cease a% the front of the garage, and came forward to the
Council Table 'to review the plans~ and discussion was held.
At the conclusion of the discussion, C~uncilman Coons moved that
the request of Mr. Riggi for waiver of a portion of the wall requirements
be denied° Councilman Chandler seconded the motion. Councilmen Fry and
Schut%e voted "No". MOTION CARRIED.
SIDEWALK WAIVER - FAHRION PLACE AT BROADWAY: Request of Emery P. Collins,
Pastor, First Sou!hem Baptist Church, 1275 East Broadway, for amendment to
their original request of June 6, 1960, to allow waiver of sidewalk require-
ments on the "las't 165 feet" instead of "last 100 feet"~ was submitted.
Councilman Fry moved that temporary waiver of sidewalk require-
ments be granted for the total of 165 feet, as requested. Councilman
Coons seconded the motion° MOTION CARRIED.
REQUEST - FIREWORKS PERMIT: Request of Atlas Fireworks Company for permit to
display fireworks at Disneyland during 'the summer season, from May 1 to
October 1~ 1962~ was submitted.
Communication dated February 15, 1962, from Mr~ E. D. Ettinger~
Director, Public Relations Division, Disneyland, Inc~, presenting detailed
facts and information pertaining to the fireworks displays including the
dates and types of the proposed displays, was submitted (copies furnished
each Councilman)~
In accordance wrth previous Council action on September 5,
1961, Councilman Coons moved that subject request for fireworks displays
be scheduled for hearing at the next Council meeting, February 27~ 1962~
at 3:00 P.M~, and that the press be requested to fully publicize the
scheduled public hearing° Councilman Chandler seconded the motion, and
requested that a report be obtained from the City Fire Department pertain-
ing to this issue~ MO/ION CARRIED.
APPLICATION - TRANSFER OF TAXICAB PERMITS: Request of Mr. E. A. Slagle,
President, Yellow Cab Company of Northern Orange County, Inco, for permission
to transfer taxicab permits from six old units to six new units, together
with a list of the serial numbers and license numbers of said units, was
submitted°

On motion by Councilman Pry~ seconded by Councilman Thompson, said
transfer of taxicab permits was granted as requested° MOTION CARRIED.
TRACT NO. 3446 - ADJUSTMENT~ WATER LINE CHARGES: Mro Murdoch reported regardin9
the adjustment in the water line charges in the vicinity of Cris Street and
Mell's Lane~ requested by Mr. John Do Griffith, developer of Tract No. 3446;
that installation of the water lines were made in accordance with City
specifications, however the area in question is served by Dyke Water Company
in accordance with an agreement between the City and Dyke Water Company.
He further reported on the opinion received from the Assistant City Attorney
relative to the legality of the reimbursement, and recommended a specific
authorization of reimbursement to Home Land Company (Griffith Brothers) in
the amount of $29669°30°
On the recommendation of the City Manager, Councilman Thompson
moved that reimbursement in the amount of $2,669.30 be authorized and the
adjustment be consumatedo Councilman Fry seconded %he motion° MOTION
CARRIED.
VARIANCE NO. 1406 - RECLASSIFICATION NO. 61-62-26: Communication dated February
16, 1962, from Mr° John Fo Rothman, Rothman-S%een & Associates, setting
forth additional evidence relative to his request for permission to proceed
with the R-1 development~ pursuant to Variance Nco 1406, was submitted°
Mr. Rothman addressed the Council advising that in accordance
with conditions of Resolution of Intention No~ 7308, in Reclassification
Proceedings Nco 61-62-26~ Mr~ Pettengill, the applicant, has recorded Deed
Restriction%has submitted to the City Right-of-Way Department the Deed of
Dedication, and has paid the required street lightin9 charges; however,
has encountered delay in obtainin9 an improvement bond in the amount
required by the Engineering Depar%mento Mro Rothman was of the opinion
that if the six foot masonry wall (Condition Nco 2, Resolution No° 7308)
could be excluded from the street improvement bond (Condition Nco 5b,
Resolution No° 7308), that the applicant would have no further difficulty
in obtainin9 the necessary bond°
Discussion was held by the City Council and the files in question
reviewed°
POLICY OF THE COUNCIl.: Councilman Chandler moved %hat bonds for Engineer-
ing requirements be for street improvements only; that the construction of
walls be made prior to Final Building Inspection, oz' at the option of the
petitioner, and subject to the approval of the City Council, be included in

Mro Dave Delano, 529 - 23rd Street, Manhattan Beach, referred to
the statement submitted to the City Planning Commission of eight existing

this type of ope:ration~ the Code provisions were unrealistic.
Mr~ Kreidt reported that the City Planning Commission:s basic
concern was the matter of compatibility of land use°

No. 1439 was submitted and reado
The Mayor asked if anyone wished to address the Council.
Mr. Kreidt noted the location of the subject property and sum-
marized the evidence presented 'to the City Planning Commission, their
findings and actions on both Reclassification Noo 61-62-70 and Variance
No. 1439.
Mro Harry Knisely, Attorney representing the applicant, requested
relief from the wall requirement on the south side of the property where
subject property abuts property owned by the Orange County Agricultural
Department° In his opinion, if this property to the South is developed at
some future date, it would probably be an R-3 or commercial use. He
called attention to'an architectural error on the plans, and advised that
the size of the one-bedroom units and garages would be increased to Code
requirements. He further advised that they were in agreement with the
requirements as outlined by the City Planning Commission with the exception
of the single story height limitation and wall requirement on the south
side' of subject property.
Mr. Knisely referred to the petition in the file endorsing the
development, and stated that the neighbors to the 5asr and West, Miss
Clemmer, 314 West Vermont Avenue, and Miss Stull, 308 W. Vermont Avenue,
favor the two-story construction° He further advised that because of the
location, the entire area lends itself to high density use.
Petition dated December 129 1961, approving the development was
compared to the petition dated February 14 and 15, 1962, protesting Variance
No. 1439, and it was noted that some of the names appeared on both
petitions.
Mrs. Lucile Perryman, 210 West Vermont Avenue, addressed the
Council and explained that when the first petition was circulated it was
not known that the plans were for two-story construction, and further
stated that they were not opposed to the rezoning, but were opposed to the
variance°
Mro Martinez~ 217 West Vermont Avenue, addressed the Council in
opposition to the two-story construction°
Mro Knisely reported that Mr. Martinez did not reside within the
150 foot single-height limitation area of the property, that all within the
150 foot radius had approved this development, with the exception of Mrs.
Perryman.
Mtso Jean Beals, 225 West Vermont Avenue (circulator of the
second petition), advised that their only objection was to the waiver of
the height limitation.

APPLICATION - PUBLIC DANCE PERMIT: Mro Murdoch and Assistant City Attorney Joe
Geisler reported on investigations made by the Building and Fire Departi
ments of the premises at 135½ West Center Street, and their recommendations
as to conditions that should be corrected prior to issuance of a Public
Dance Permit.
Councilman Fry moved that the application of Sandy MacTavish
Dance Studio for a Public Dance Permit at 135~ West Center Street be
granted, subject to compliance with the requirements of the City Manager's
Office, the Police Department and the Fire Department. Councilman Thompson
seconded the motion. MOTION CARRIED.
REPORT - FIRE STATION SITES AND EQUIPMENT: Fire Chief Edo Stringer reported on
present coverage by the existing Fire Stations and equipment and the coverage
recommended by the National Board ~ Fire Underwriter$~ and presented chart and
maps indicaling by comparison, the recommended increase in fire station
sites and the additional personnel and equipment required°
Chief Stringer recommended that land be acquired as soon as
possible for the additional fire station sites %o be located in the south-
east industrial area, the Broadway Shopping Center area, and the north
central industrial area°

At the conclusion of the report and on the recommendations of
the City Manager, Councilman Coons moved that the City Manager and the City
Right-of-Way Agent be authorized to proceed in the acquisition of addi-
tional land for fire station sites as outlined by Chief Stringer.
Councilman Thompson seconded the motion° MOTION CARRIED.
REPORT - PARK DEVELOPMENT, MEL GAUER SCHOOL: Mr. Murdoch reported that funds
could be made available durin9 %his fiscal year for the development of
the park site near Mel Gauer School (eight acres) and the Park and Recrea-
tion Department is trying %o re-schedule their work to include development
of this park; that perhaps if they receive support and help in the line of
fine grading, sprinklers, etCo, they could move ahead with immediate
development~
REPORT - NO PARKING ON EAST STREET, LINCOLN TO VERMONT: Mr. Murdoch read in
full the report dated January 19, 1962, regarding the establishment of
"No Parking" on East Street from Lincoln to Vermont Avenue, prepared by
the Traffic Engineer, indicating the present traffic volumes on East
Street, and recommending that a parking restriction not be required until
the traffic volumes increase or the parkin9 becomes a problem.
RESOLUTION NO. 62R-177: On report by the City Manager, Councilman Thompson
offered Resolution Noo 62R-177 for passage and adoption.

LIMITED PARKING - DOWNTOWN AREA: Mr. Murdoch read the letter received from the
Downtown Merchants' Association requesting limited parking in the Down%own
area of two hour parking on West Lincoln between Los Angeles Street and
Harbor Boulevard, and one hour parking in all other areas which were pre-
viously metered.
Discussion was held by the City Council, and at the conclusion
thereof, Councilman Coons moved that action on said request be deferred for
one week, February 27, 1962, 3~00 P.M., to give the Council an opportunity
to review the reports received from the Traffic Engineer and the Police
Department. Councilman Chandler seconded the motion. MOTION CARRIED.
PROXY - ANAHEIM UNION WATER COMPANYI On motion by Councilman Fry, seconded by
Councilman Coons, Mro George Fo Oelkers, Director of Public Utilities, was
appointed to represent the City of Anaheim at the Annual Meeting of the
Shareholders of Anaheim Union Water Company to be held on the 24th day of
February, 1962~ or at an adjourned meeting thereof. MOTION CARRIED.
CONDITIONAL USE PERMIT NO. 169 - ALGOHOLIC BEVERAGE APPLICATION: Mr. Krogman,
owner of the property~ and Mrs. Rosema, lessee, addressed the Council
requesting clarification regarding conditions of Conditional Use Permit
No. 169, which granted permission to establish a Cocktail Lounge in con-
junction with a restaurant at 1027 North Magnolia Avenue. Mr. Krogman
advised that the restaurant adjacent to the proposed Cocktail Lounge has
now changed hands and questioned the requirement of a door being cut
through to the restaurant making the service of food available to the
Cocktail Bar area.
Minutes of the Council meeting held November 28, 1961, pertain-
ing to Conditional Use Permit Noo 169 were read, and it was determined
that food must be made available, as Resolution No. 132, Series 1961-62~
of the City Planning Commission granted permission %o establish a Cocktail
Lounge in conjunction with a restaurant.
