Mayor Schutte called the meeting to order.
MINUTES: Council approval of the City Council minutes of the meeting held
March 27, 1962~ was deferred to April 10, 1962.
PUBLIC HEARING - HOUSE MOVING PERMIT: Request of Harvey Servance for permis-
sion %o move a dwelling from 3630 Westminster Boulevard, Santa Aha,
California, to 3435 Brady Avenue, Anaheim, California, was submitted.
File containing application, picture of dwelling to be moved,
and plot plan, was reviewed by the City Council.
The Mayor asked if anyone wished to address the Council.
Mr. S. A. Shearer, 2043 Minerva, representing the applicant,
addressed the Council advising that the house to be moved was a nice house
and will be increased in size to meet Code requirements.
The Mayor asked if anyone else wished to address the Council,
there being no response, declared the hearing closed.
RESOLUTION NO. 62R-319: Councilman Coons offered Resolution No. 62R-319
for passage and adoption, granting said House Moving Permit.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING A HOUSE
MOVING PERMIT TO HARVEY SERVANCE TO MOVE A DWELLING FROM 3630 WESTMINSTER

The Mayor declared Resolution No. 62R-319 duly passed and adopted.
SIDEWALK WAIVER~ 3435 BRADY.. AVENUE: On the recommendations of the City Engineer,
and on motion by Councilman Coons seconded by Councilman Chandler, temporary
waiver of sidewalk requirements at 3435 Brady Avenue was granted, subject to
the provision that no permanent plantings (trees) be permitted in the area
reserved for future sidewalk. MOTION CARRIED.
SIGN APPLICATION: Application submitted by Dace Construction Corporation for
permission to erect a roof sign at 1600 West Broadway, advertisin9 "Sherwood
Riviera Garden Apartments" was submitted at the meeting o£ March 27, 1962,
and deferred to this date pending further investigation.
Communication dated March 28, 1962, from George D. Buccola,
President of Dace Construction Corporation was submitted advising that the
proposed sign would be the only illuminated sign at the apartment develop-
ment other than a one foot by three foot office sign. (Copies furnished
each Councilman)

that sign permit be 9ranted as requested, subject to the conditions contained

SIGN APPLICATION: SuOmitted by Union Oil Company for permission to erect two
signs at 446 West Lincoln Avenue.
Discussion was held, and Councilman Coons was of the opinion that
these signs probably would be a thin type sign that are placed on the
canopies~ and thereupon moved that said permit be granted with the provision
that the signs not exceed a four-foot overhang of the right-of-way. Council-
man Chandler seconded 'the motion. MOTION CARRIED°
PROPOSED POLICY OF THE COUNCIl.: Opinion of' Assistant City Attorney, John Dawson,
pertaining to the 'use of City equipment to grade private property for
ultimate use of private recreation was submitted and read by Mr. Murdoch.
Said opinion stated that the City may not use or loan or other-
wise commit City equipment to perform services on private property, as
such activit7 would be sontrary to the ~'gift' limitations of the constitu-

EAST ANAHEIM BABE RUTH LEAGUE: Request for assistance in the construction of
a baseball field on privately owned property was deferred from the meeting
of March 27~ 1962~ pending report from the City Manager,
in 'view of the opinion of 'the Assistant City Attorney previously
read~ it was moved by Councilman Coons, seconded bF- Councilman Chandler,
that said reqdest be denied~ and that a copy of '[he Assistant City Attorney's

FULLERTON EASTSIDE CLUB - REQUEST: Request from the Fuilerton Eastside Club
for permission to operate Jamaicas at Cypress and Orangethorpe Avenues

Mr. Ac R. McDaniel, Engineer, addressed the Council regarding
the unloadin9 of school busses on what would be a minor residential
street, and asked if it was possible to request that no future bus
loading be at this location.
Mr. Murdoch suggested that the request be made to the School
District, and asked Mr. Kreidt to draft a letter outlining the fact that
the provision for a pedestrian walk-way is being required of the developers
of Tract No. 4612, and that they specifically request that this interior
street not be used for bus loading, that the bus loading take place in front
of the building.
CONDITIONAL USE PERMIT NO. 219: Submitted by Ardmore Development Company
requesting permission to construct a planned unit development on property
located briefly 100 feet south of Catalpa Avenue bounded on the East by
Chippewa Street, the South by the Orange County Flood Control Channel, and
the Southwest by the Santa Aha Freeway. (Filed in conjunction with Tenta-
tive Maps of Tracts Nos. 4107, 4617, 4618, 4619, 4620 and 4621.)
The City Planning Commission pursuant to Resolution No. 271,
Series 1961-62, granted said Conditional Use Permit subject to conditions.
Mayor Schutte requested that review of action taken by the City
Planning Commission be held by the City Council on said Conditional Use
Permit No. 219.

PUBLIC HEARING~ CONDITIONAL USE PERMIT NO. 193: Submitted by Silas W. Lehmer,
Owner, Rothman-Steen and Associates, Agents, requesting permission to
construct one-family planned residential development on property located
on the north side of Katella Avenue between Dallas Drive and Nutwood
Street, its southwest corner being approximately 186 feet east of the
northeast corner of Dallas Drive and Katella Avenue.
The City Planning Commission pursuant to 'their Resolution No.
234~ Series 1961-62, granted said Conditional Use Permit, subject to the
following conditions:
1. Development substantially in accordance with Exhibit No. 1, provided
that the carport structures shall be enclosed on the rear and sides.
2. Provision of a six (6) foot masonry wall alon9 the west, north, and
east boundaries prior to Final Building Inspection.
3. Installation of a six (6) foot wide landscapin9 strip abutting and
parallel 'to the southerly property line of subject property along
Katella Avenue with 'the provision of a six (6) foot masonry wall
abutting said landscapin9 strip, except for that area reserved for

Mr. Martin Kreidt indicated the location of subject property and
the exlsting land uses in the area, and briefly summarized the evidence
presented to the City Plannin9 Commission at their hearing and based upon
the low density, the internal arrangement, and on other evidence received
by the City Planning Commission, they recommended approval subject to
conditions. He specifically called attention to the followin9 findings of
the City Planning Commission contained in their Resolution No. 234;
That the installation of carports as proposed for the subject property
may be developed in accordance with the requirements of %he R-A,
lesideniial Agricultural, Zone.
That the specific waiver of the side and rear yard requirements for the
subject property is hereby deemed necessary, in order to develop the
subject property in accordance with the plans presented, said waiver
permitted under the authority 9overned by Section t8.6~.070 of the
Anaheim gunicipal Code.

Mr. Kreidt further reported that the density has been reduced
by the applicant and therefore, reclassification from the present R-A
Zone is not necessary; that the total acreage is 13.5, and 100 dwelling
units could be permitted on the property and still maintain the density
requirements of the R-A Zone, which is one dwelling unit for 6,000 square
feet of lot area; that the applicants wish to enclose this development
with a block wall and have no dedicated streets, therefore there is more
land area to incorporate in calculating the density requirements.
Plans and the file were reviewed by the City Council, and the
Mayor asked if the applicant wlshed to address the Council.
Mr. John Rothman, Ro/hman-Steen and Associates, representing
Mr. Lehmer, addressed 'the Council and submitted and explained in detail
a large scale model of their proposed development, bein9 a planned group
of single family homes with a common wall placed around a park area. He
stated that if the Council desired, they would revise the model to one
dwelling dnit per :7200 square feet to conform with the R-1 Zone density
requirement by removing the eight homes abuttin9 the walls on the West
and East property lines, reducing 'the total number of homes to eighty-
four. Mr. Rothman advised that a meeting was scheduled with the residents
in %he area, at which time their proposed plans were fully explained and
he felt %hat a majority of 'the residents objections were satisfied~ that
due to 'the fact that subject property is a life estate, and the unusual
ownership problems involved, they have presented this new concept of
single family planned residential development in an effort to develop
subject property at this time; that the homes would be leased and ultimately
sold upon Mr. Lehmer~s death, or by order of the trustees.
The Mayor asked if anyone else wished 'to address the Council.
Mr. Frank Woodman, 1735 South Ivanhoe, addressed the Council in
opposition advising that they were not interested in this experimental
concept, even if it was reduced to eighty-four houses; that they do not
feel the surrounding properties should be subjected to this experimental
concept and called attention 'to the over-crowded schools in the area,
the heavily travelled Katella Avenue, and the poor drainage in the area;
that %hey would be in favor of an R-1 subdivision with approximately
fifty four homes for subject property.
Mrs. Betty J. Marquardt, 1665 South Nutwood, addressed the Council
and requested that in making their decision regardin9 %his proposed
development, the Council consider the entire area of West Anaheim and
placed a map on the wall showin9 other existin9 oran9e groves in this area
that could also request a high density use, and by placin9 overlays on the
map, graphically explained how their area would appear if said remaininq
groves were developed alon9 'the lines presented 'tonight. (Map retained ~y

Mr. Rothman read from 'the Na'tional Housin9 Act of 1961 and
advised tha't the federal housing indicates that they are interested in
financing and encouragin9 this kind of development adjacent to existin9
R-i, and he did not feel 'that they would consider said financing if this
concept had no merit and tended to reduce adjacent property values. "~
The Mayor asked if anyone else wished to address the Council,
there being no response, declared %he hearing closed.
Discussion was held by 'the City Council regardin9 the terms and
conditions of 'the life estate on subject property, the density requirements
of the R-A and R-1 Zones and 'the method used in calzuia%ing the density,
and possible revisions to 'the planned development reducin9 the number of
dwelling units.
Mr. Rothman requested that Council action be deferred for one
week and that he be allowed to submit a revised plan reducing the number of
homes to exactly fifty-four, or whatever number the Council suggested; the
concept of the development to remain the same.

RECLASSIFICATION NO. 61-62-78: Submitted by Alex L. Fishman and Jerry Marks
requesting change of zone from R-A to C-2 and P-l; property briefly des-
cribed as located on the west side of Empire Street between Lincoln Avenue
and Hiawatha Avenue, approximately 250 feet south of Lincoln Avenue.
Public hearing was held March 13, 1962, at which time said
hearing was closed and action deferred to this date to allow the City
Attorney's Office time to prepare a complete report concerning the present
status of Parcels 1~ 2 and 3, as indicated in Reclassification Proceedings
No. 58-59-4'7.
Mr. Joseph Geisler, Assis'tant City Attorney, briefed the City
Attorney's memorandum, dated April 2, 1962, pertainin9 to the history and
status of zoning applications of property involved (copy of memorandum
given to representative of Lincoln Park Civic Association and Mr. Fishman).
Mr. Martin Kreidt summarized the evidence and action taken by
the City Council at 'their last meeting.
Discussion was held by the City Council regarding 'the dedication
of access rights to Empire Street, the filing of deed restrictions limiting
use of property to C-1 only, the requirement of a six foot masonry wall
along Lhe entire southerly boundary of the property presently occupied by
Lin-Brook Hardware.
Councilman Schutte was of the opinion that action should be further
continued to allow Councilman Chandler an opportunity to review the report
of the City Attorney inasmuch as the report was prepared at his request.
RECESS: Councilman Fry moved for a five minute recess. Councilman Coons seconded
