1962/05/01~694 City Hall, Anaheim~ California - COUNCIL MINUTES - April 24~ 1962, 3:00 P.M, Because of the present work and time spent by the various departments in gettin9 a balanced budget to the City Council by 'the first of June, Mayor Coons felt the departments involved should be requested to fit this program into 'their schedule as soon as possible. Councilman Dutton concurred with Mayor Coons'suggestion, and stated the urgent need for such a study makes it necessary to commence the program as soon as possible. At the conclusion of %he discussion, Councilman Chandle{ moved that the various departments be instructed to confer with %he Urban Renewal Committee for instituting required studies; that the first interim report shall be in ninety days, and progress reports every thirty days thereafter. YOUTH IN GOVERNMENT DAY: Mayor Coons announced that forty-six students from the Anaheim High School District have been with the City officials.and departments during this day pamticipating in City activities for the pur- pose of learning more about municipal government. He commended the studenls for their interest and stated that in his opinion, the progressive future of the City of Anaheim, with young people of this caliber, is assured. Mr. Marvin Harper reported that the sign would be a directional sign for the Custom Homes tract. On motion by Councilman Schutte, seconded by Councilman Krein, said permit was granted for a temporary sign (six months) in accordance with the nine conditions established by Council policy. MOTION CARRIED. REQUEST - JO ANN BURDICK: Request for Council support of Buccaneer Youth Group attending Seattle World's Fair was deferred to the meetin9 of May 8, 1962, for further investigation. CIVILIAN DEFENSE TRAINING PROGRAM: Dr. Cecil Coggins, Chief of the Medical and Health Division of %he State Disaster Office from Sacramento, addressed the Council extendin9 an invitation to the City of Anaheim to take part in a pilot study project which is being conducted all over the United States by · the United States Public Health Service, the American Medical Association, the National Red Cross, and the Department of Public Health, Education and Welfare9 combined. He explained the program which objective is to teach one person in every American family something about the skills by which they will be able to take care of medical and first aid emergencies in the home or aid in the case of a disaster. Dr. Coggins reported that this problem was recognized approximately two a~td one-half ?ears ago, and plans for the traininq course were commenced at' ~ - .n~. Lime,, He explained the reasons that %he City of Anaheim was selected as one of the pilo-~ sLud'y areas, and ~hat there would only be two cities and 'two coJn'~es selected in the Sgate of Californza, as this program can only be extended at this 'time to one pe~-cent of the population of the state. Mr. Fox9 Assistant Civii Defense Director of Orange County, addressed the Co:~n~]. and read a copy of the letter received by Charles E. He stated that they were all in fauor ct the program and would render every assistance possible should the invitation be a~cep[ed by Anaheim~ In answer to a question by Councilman Krein, Dr. Coggins reported [hal the program was One Hundred per-cent federally financed, and further reported that the program has been slatted in Madera County and Manhattan Beach. He stated %hat they have provided administrative procedures, list of organizations~ local steer:nB committee, and step by step, the ways to carry out the program, Mayor Coons thanked Dr. Coggins for extending the invitation and stated that the Council is interested but would like an opportunity to read the outline just presented in order to know its complete ~nvolvement. PUBLIC DANCE PERMIT: Application of St. Justin Martyr Church for Public Dance Permit, May 5, 1962, Carpenter's Hall, 608 West Vermont Street, was submitted and granted in accordance with recommendations of the Chief of Police, on motion by Councilman Dutton, seconded by Councilman Schutte. MOTION CARRIED. DINNER DANCING PLACE PERMIT: Application of Richard P. Alexander for Dinner- Dancing Place Permit, Branding Iron Steak House, 2141 South Harbor Boulevard, was submitted and granted in accordance with recommendations of the Chief of Police, on motion by Councilman Dutton, seconded by Councilman Chandler. MOTION CARRIED. MacTAViSH DANCE STUDiO~ DANCE PERMIT: Mr. Darry1Deayn addressed the Council regarding Teen Dances at the MacTavish Dance Studio, 135½ West Lincoln Avenue. He related the provisions under which the permit was granted by the City Council, and reported that these conditions had not been complied with, and recommended the permit be revoked. Mr. Robert Phillips, Fire Marshall, reported that subject permits had never obtained clearance of the Fire Department, and the premises have not been cleared for a public dance. He further reported that the require- ments still necessary as of their last inspection were the panic hardware on the rear door and exit lights. However, they had been advised that these requirements have now been complied with, and have an appointment for an additional inspection tomorrow. Mr. Joseph Geisler, Assistant City Attorneys reported on routine investigation made by the Police Department April 18, 1962, and that there were no unfavorable reports to this date from the Police Department. It was determined by the City Council that the responsibility was that of Lhe Police Department, Fire Department and City Attorney's Office 'to see that the conditions of the permit were fulfilled, and if the conditions were not fulfilled, the license should be voided; that any evidence pertaining to this permit should be reported to those departments responsible for enforcement, and upon their investigation, the termination made if there is a violation of the permit. FINAL MAP, TRACT NO. 4533: Subdivider, Marlborough Homes, Inc. (A. R. McDaniel, Engineer), tract located on the north side of Wagner Street, west of Sunkist Street, and contains twenty-one R-1 lots. Mr. James Maddox, City Engineer, reported that bonds have been posted and necessary fees paid, and that said map conforms substantially with tentative map previously approved, and recommended the approval of said Final Map. On the recommendations of-the City Engineer, Final Map of Tract NO. 4533 was approved on mo'%ion by Councilman gchu~e, seconded by Council- man Dut~on. MOTION CARRIED. RESOLUTION NO. 62R-398: Councilman Chandler offered Resolution No. 62R-398 authorizing the purchase and acceptin9 deeds of Lots A and B, Tract No. 4533. A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUISITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL PURPOSES AND ACCEPTING A GRANT DEED CONVEYING SAID PROPERTY TO THE CITY OF ANAHEIM. The Mayor declared Resolution No. 62R-398 duly passed and adopted, TRASH COLLECTION: Discdssion was held regarding the modification of trash collection services~ and the furnishing to residents by the City of Anaheim of uniform light-weight trash containers; the financin9 and cost to the residents; the responsibility for the containers, etc. At the conclusion of 'the discussion, Councilman Dutton moved that this matter be deferred to the next meeting (May 8, 1962) for further study of the revised trash container program. Councilman Schutte seconded the motion. MOTION CARRIED. TENTATIVE MAP~ TRACT NO. 4643, AND COUNTY TENTATIVE MAP, TRACT NO. 4644: Developers~ Stanley H. Ritter, Inc.; Tract No. 4643 located on the north side of 'the Santa Aha Canyon Road, south of the Santa Aha River, and con- tains seven%y-four proposed R-1 lots. County Tentative Map, Tract No. 4644, located on the east side of Jefferson Street, approximately 3.67 acres north of the Santa Aha Canyon Road, and contains thirty-three proposed R-1 lots. City Planning Commission recommended approval of Tentative Map, Tract No. 4643, subject to the following conditions: 1. Requirement that should this subdivision be developed as more than one subdivision~ each subdivision thereof shall be submitted in tentative form for approval. 2. Subject to 'the approval of plot and building plans by the Planning and Buiidin9 Departments. 3. That there be provisions of an adequate drainage plan, by filling the northerly end of the tract to discharge into the river at its present flowline, pumping to the river's present flowline, dischargin9 into the City of Orange or any other method which is to the satisfaction of the City Engineer. 4. Mr. Martin Kreidt reported that later in the City Planning Commis- sion meelin9 of April 25, 1962, it was reported that information had just been received from 'the County Planning Commission that the proposed width of Jefferson Street south of the Santa Aha River had been altered, As official recommendation had already been taken by the City Planning Commis- sion it was ordered that this information be forwarded %o the City Council. Mr. Kreidt reported that the new Jefferson Street width as projected by the County Planning Commission was 100 feet. He further reported that the developer had revised the tract from 100 feet 'to a ninety-foot secondary road on the recommendation of 'the City's Interdepartmental Committee, and noted if Jefferson Street is to be a major highway, the City's requirement would be t. 06 feet. Mr. James Maddox, City Engineer, reported that the lO0-foot right-of-way for both tracts would be ample for the purpose. Mr. Kreidt further reported that the property owner retaining the 76 foot by 300 foot parcel from Tract No. 4644 and marked "Not A Part" has applied for a variance to the one acre lot size requirement, and reclassi- fication from R-A to R-1. Discussion was held; at ~he conclusion thereof, Councilman Dotton moved that Tentative Map of Tract No. 4643 and County Tentative Map of Tract No. a64a be approved, subject to the recommendations of the City Planning Commission, amending said conditions to require a fifty-foot, half width street for Jefferson Street, as projected by the County Planning Commission. Mr~ Robert MacMahon, Attorney representing the applicant, and the proposed lessee of subject property, addressed the Council explaining in de;ali the proposed cons%rdction and operation of the mobile home park on the twenty-acre parcel; that it is their intent to initially provide for approximately 130 spaces~ and later expand, if the property permits, to approximately 190 trailer spaces° Thai they believe this project to be feasible from an economic slandpoint, as there is a need for a certain amount of housing in this specific area, and the mobile homes concept is the most desirable. Mr, MacMahon called attention to the existing C-1 zoning immediately to the West, and advised that subject property is bounded on three sides by major thoroughfares and development at this time would result :in dedication and improvement of said streets; further, that the railroad tracks Lo 'the North are much higher than the present level of Placentia-¥orba Road, and in his opinion this considerable embankment provides a natural boundary between subject property and the industrial zoning in the City of Placentia, and particularly the Kraemer-Backs property; that Orangethorpe Avenue on the south boundary also provides a natural dividing line for industry in the City of Anaheim, as there is very little ].and north of Orangethorpe in the Anaheim city limits; therefore 'they do not feel they are creating a buffer zone nor breaking the industrial zoning integrity, but that they' are adhering to the natural development of the area; that the planning study conducted by the City Planning Commission and the reclassification by the Council, in his opinion~ was based on ihe fact that the property to the North is going to remain zoned for industry; however he did not believe anyone had assurance of zoning actions in the City of Piacentia, or when the property would be developed., Mr. MacMahon was of the opinion that industrial development of the northeasi area of Anaheim is far in the future, as two years have already elapsed since Autonetlcs located and no other major industrial concern has established in this area, and if development does commence, he believed it would be in the Autonetics area and not as far north as subjecl property. He advised that prior to the preparation of plans and negotia'tion, the~ zeceived an informal opinion from the City that the industrial development would be south of Orangethorpe~ and on that basis they pzoceeded, noi realizing they' were going against an established Council poiicyo He spoke of the planning concepts for this area, being of the opinion ~hat pri~a%e industry~s own capital and risk makes progress towards development of an area, and questioned how far do you go in allowing planning on a large scale before entering the area of actual governmental plannin9 of the economy° 'fne Mafor asked if anyone else wished to address the Council. Mr. Jack Hamilton, 6651 Richfield Road, Anaheim, Real Estate Broker representing Mr. Dowling, advised that this property has been for sale for one and one-.half years, and prior to the proposal for a trailer park, he had tried very conscientiously to develop this property for industrial purposes, as well as other property in this neighborhood which he has not been able to dispose of, as there appears to be no interest towards inddstriai development; further, that he has checked with the City of Placentia, and they have granted a variance for a trailer court on a twenty acre parcel to the West of the existin9 C-1 property. Mr. Dowiin9, applicant, addressed the Council advising that his father and mother purchased this property in 1909, and the sixty-two year old citrus grove is no longer productive; that they now have an opportunity to lease this property for its highest and best use, providing a return to them, which would equal the sale of the property at $30,OOO. per acre. In his opinion, this pzoperty was separate from the rest of the area to the point of being an island, and is bounded on the South by the Crill basin, Anderson basin, and the flood control channel. He further reported that th~ mobile homes would be a £1rst-.class establishment, having a density of 'twenty~-.four people per acre, and would require very little police, fire and trash service from the City, resulting in a financial return to both the City and his family. Discussion was held by the City Council, and Councilman Dutton slated in view of the recent M-1 Zoning action taken by the City Council and the density proposed for this development, he felt the granting of this permit would establish a precedent and start encroachment in the area designated for industrial purposes. Councilman Chandler concurred with the statements of Councilman Dutton, because of the Council's recent action reclassifying the northeast area to M-l, and the definite statement at 'that time that any encroachment into the area would be objectionable, and the Council's request to the City of Piacentia and the County of Orange to take a similar stand. In his opinion, notice has been given to the general public that this area will be reserved for M-1 and compatible uses, with an attempt to combat the encroach- ment of residential type units in the area.
