Mr~ Horny, Applicant, indicated he wcutd be out of town on said
date due to previously scheduled appointments, and noted the many contin-

Councilman Clark withdrew his previeus motion, and moved that
Public Hearing on Conditional Use Permit Nc 1050~ be continued to the
meeting of January 28, 1969, at 1 30 P~M~ Mayor Pebley asked if those in
opposition had any ~bjecti~,n~ and Mrs Callen stated that date would be

PUBLIC DANCE PERMIT~ Application ~iied by Mrs. Carmen D~ Sanchez, on behalf of
Seciedad Protectcra FemenJl #11~ for permit to conduct a public dance,
February 16, 1969, at the Carpenter's Hail, was submitted and granted, sub-
ject to previsions ~of Chapter 4.16 c~f the Anaheim Municipal Code, as
recommended by the Chief cf Police, on m.<ption by Councilman Dutton, seconded
by Councilman Clark. MOTION CARRIED,
~EpUEST FOR REMOVAL OF PARKING METERS NORTH OLIVE STREET~ Petition protesting
the use of parking meters on Olive Street, between Lincoln Avenue and
Chartres Street, was submitted, together with report and recommendations of
the City Engineer and Pc~lice Department.
Mro Max White, t[8 North Olive Street, addressed the City Council
~ support of subject request, stating that he was out of the country when
the meters were installed and that he resents having to pay for the privi-
lege of parking in front :~f his home~ He noted that there were no parking
meters in a comparable l~cation, ~? block away, and asked that those on
North Olive Street be remcved~
Mr0 Bob Martin, owner cf property located at 108, 112 and 116
North Olive Street, advised they requested the installation of the parking
meters on the basis that turn-over parking space is necessary for the
business establishments in the area, and since their installation, business
has greatly increased~ He noted that there are no qity Parking Lots in the
proximity of their businesses~
Mro F. R. Waite, owner of apartment at 121 North Olive Street,
~xoted that two businessmen in the area had signed the petition he circulated
objecting to the parking meters; that he would like to see them removed,
at least in front of the residential properties; and suggested a six months'
~ria] removal period~,
Mr~ M~rtin observed that many cars are parked in the metered area
ail day long and do not receive a citation; and that insufficient parking
facilities are provided £or apartment dwellcr~ in the area,
Mayor Pebley noted that insufficient parking space is provided
commercial establishments in the area, as wello
On recommendation of the City Engineer, Councilman Krein moved
that determination of the subject request be deferred to the meeting of
~anuary 28, 1969, for further study and report by the Traffic Engineer~

Mr, '['~wnsend rep:..rted that Web Service C, mpanv makes a net pr,:~fit of
$2.50 per laundry machine, and is ta~ed S] 00 per machine under the existing
Code; that the City cf Anaheim is c~nl~:' .nc agency which impo.sos taxes which
affect the operation of this business, and felt that this tax is unnecessary.
He further felt that the funds derived by the City, fr~m this tax did not
justify it~ impositi~-n~

system.
]n answer to questions ir,sm Councilman Ciark, the City Atte~rney reported
that vending machines are taxed at the rate .?f 3~00 per machine, and that
laundry ma ",ines were formerly taxed at the same rate. A request for reduc.-
tion of this tax was received, and after careful c ns tderat i, 'n the license
tax was reduced to the present rate ~-f $1~00 per machine, ?n the basis that
it is the service of the machine which is being s.~ld, rather than a consumer
product. He noted that fc>llowing this reduct~(~p ,~f the license tax a suit
was fi]ed by Mr~ Bl::~emfield of Web Service C.~.mpany, which was found in favor
of the (itv of Anaheim. He n(ted that the p.'iicies f ~ther surrounding
cities are ,,'cry s~milar t~ that ef the t. ity ~ f Anaheim; and n,~ted that the
Court drew a parallel between the tax paid by laundry>mats and the tax paid
by Web Service Company which are almost identical 'n a per machine basis~
He referred to a survey c,:~nducted by the Finance Direct~;r in August of 1968,
indicating t'hat most cities do not tax such businesses ,n the basis of gross
receipts.

felt gross receipts wc~uld be a proper basis fc~r taxation for this type of

would contact Mr~ Blcomfield te see if he desired t' prepare a further presen-

CALIFORNIA Bi-CENTENNIAL TREE~ Reference was made by' the City Manager to the sug-
gestion contained in correspondence from the Orange County Bi-Centennial Com-
mittee that a special tree be planted to commemorate California's 200th Birth-
day. He recommended that the City of Anaheim participate in this observance
by planting a tree on one of the dates suggested~
I'he City Council concurred with the recommendation of the City Mana-
ger, and requested that the matter be handled administratively as to date,
s?ec~es and location, Councilman Dutton suggested the date of July 1, 1969,
as thc most apprc, pria~e for the tree.-planting ceremony,
ORDINANCE NO, 2624~ The Deputy City Clerk noted that final reading of Ordinance
No. 2624, regulating the manner of outdoor advertising of motel and hotel
rental rates, would be in order~
Mr., David Alani, owner of the Bahia Motel, received permission to
address the City Council~ He stated that it is his practice to charge a higher
rate on weekends and holidays in order to make a profit, and felt that the
30~da~ notice of a rate increase as required under Ordinance NCo 2624 would
be proh~ib[t[ve.
Councilman Dutton ~ndicated he would vote against adoption of the
ordinance on the basis that fraudulent advertising practices are covered
under exf~ting State Laws, and noted the absence of any action to attempt
to control practices felt to be fraudulent under this law, He felt that
any problem could be worked out within the Motel-Hotel organizations, rather
than by adopting a City ordinances, Mayor Pebley concurred with this opinion.
i'i~e City Attorney pointed out that it is difficult to administer
the State Laws of this nature covering business and professional codes; that
there ~s no special agency in existence which is designated to investigate
alleged violations.

Mr. Alani inquired whether ne would be allowed to continue his
practice of advertising rates as follows, under the new ordinance: $6,00
per day, Sunday through Th~sday, and $8.00 per day, Friday, Saturday and
Holidays during the winter season; $10,00 per day, Sunday through Thursday,
and $14~00 per day, Friday, Saturday and Holidays during the summer season°
?he City Manager indicated this practice could be continued, as along as he
posted the rates on his sign in that manner and complied with the conditions
~f the ordinance>
Mr~ Fritz Losness, owner of the Skyview Motel, addressed the
Council, favoring the adoption of subject ordinance and related instances
of rent lowering in the Disneyland area and the procedure taken by the Motel
Association members to gain cooperation of all motel owners.

PUBLIC DANCE - REQUEST FOR REDUCTION OF POLICE OFFICERS RE~UIREDg The City Manager
reported that the request of Mr. Porfie Peralta on behalf of Sociedad Prog-
resista Mexicana ~24, for a reduction in the number of police officers re-
quired in connection with public dance permit granted January 7, 1969, was
reviewed ~.~ith the Chief of Police, who recommended that the requirement be
lowered to three officers in this instance, since no difficulties have been
experienced with the activities sponsored by this organization.
On motion by Councilman Dutton, seconded by Councilman Krein, the
number of officers required to police said dance was reduced to three for
this event only~ MOTION CARRIEDo
A review of policies affecting the determination of the required
number of officers necessary to police such events was requested by general
consent oi the City Council.
REQUEST FOR USE OF BILLBOARD - FAIR HOUSING COUNCIL OF ANAHEIM: Request of
Mro David $. Collins, on behalf of the Fair Housing Council of Anaheim, for
temporary use cf a billboard was submitted~
Mr, ~o]lins, 1077 West Ball Road, distributed material to the City
Council which depicted the copy proposed tc be posted on an existing bill-
board located on property adjacent to the Santa Ana Freeway near the Harbor
Boulevard turn-off~ He noted that the proposed copy which read "Good Neighbors
Come In Ai! Colors," would be displayed for a period of approximately six
months, and he would be responsible for the removal thereof by the end of
June.
Fir.. ~.ollins felt that the local 1mage would be enhanced by the display
of the proposed copy and outlined the positive benefits which could result.
Mrs loan dansen, 743 Eugene Place, also a member of the Fair Housing
Council ~! Anaheim, reported the preliminary results of a survey conducted
for tl~e purpose of obtaining housing for minority and low-income groups, and
urged Council support of the proposed bi~]board use.
Mr~ Bob Johnson, President. el the Orange County Fair Housing Council,
called attention to an incident three years ago which resulted in unfavorable
publi~itv t,~ the County, and felt that approval of the billboard would help
overcome any detrimental effect to the community image° He noted that the
cost o~ the proposed project would be between $100~00 and $200~00~ that the
City of Long Beach paid for such display, and he expressed the hope that the
City of Anaheim would also, h~wever, their organization would assume the
expense, if necessary, (Mayor Pebley left the meeting at 4:00 P.M., and
Mayor Pr~-Tem Schutte assumed chairmanship°)
The City Attorney reported that the billboard under consideration was
one presently in violation of the City and Sta. te Codes~ and the sign company
has been r<~quested t<! have said billboard removed,
In v~ew of the foregoing information, no further Council action was
taken~
CONVENTION CENTER - ARCHITECTURAL. SERVICES AGREEMENT: The City Manager reported
on a proposed amendment to the agreement between the City of Anaheim and
Adrian W~i]sc~n and Associates, to permit additional architectural services
in the amount of Sa,800.O0 to prepare necessary plans and documents to bring
the Box Off,ce to bid, notlng that architectural supervision during the course
of construction would not be included in the amended agreement°
On recommendatSon of the City Manager, Councilman Krein moved that said
amendmen~ be authorized in the a~ount of $4,800~00~ Councilman Dutton

REQUEST - PROPOSED AGRICULTURAL PRESE~~: The City Manager
reported on request received from the Orange County Planning Commission for
recommendation regarding the establishment of an agricultural preserve on
~ertain property generally located south of Ball Road between the Anaheim
City Limits and the Santa Ana River, (Schutte, et al)o He noted that the
property is an area which is presumed will ultimately be annexed to the City
of Anaheim~
}~e recommended that no objection be filed by the City and that
provisions of the contract indicate that should land be withdrawn from the
preserve within the JO-year term, any payments which would be made in lieu
of taxes not collected, be distributed to the appropriate tax-levying
~risdictionso
Councilman Dntten moved that the Orange County Planning Commission
~ notified tha~ the City of Anaheim w~shes to make no protest to the pro-
posed agricultural preserw~, and that a representative of the City be
a~tthorized to attend the hearing, Councilman Krein seconded the motion.

MERIT AWARD - ORANGE COUNTY CHAPTER OF AMERICAN INSTITUTE OF PLANNERS: The City
Manager submitted correspondence received from the Orange County Section of
the California Chapter of the American Institute of iPlanners, indicating
that the City of Anaheim was granted a merit award for citizen participation
in planning capital improvements~
REPORT - RESIDE~% COMPLAINT NO PARKING ZONE - BROADWAY AT HARBOR BOULEVARD: Re-
port of the City' Engineer was submitted, regarding a resident complaint
resultSng from prohibition of' parking in order to establish left-turn pockets
on Broadway at the intersectic, n of Harbor Boulevard°
By general consent of the City Council, action was deferred to a
later date to allow for further study and recommendations°
POSSESSORY INTEREST TAX - ANAHEIM STADIUM~ The City Attorney reported that he had
recently ]earned of the hearing before the Appeals Board for the possessory
interest tax assessment, which has been scheduled for the morning of Friday,
January 17, 19690 He stated that no official notice has been received by
his office as yet, but as soon as the time and place of the hearing have been
ascertained, he will notSfy the Councilmen~ He noted that it is the intent
of his office to request a continuance~
NOMINATIONS~ CULTURAL ARTS COMMISSION: Mayor Pebley reported that Chas. Ao
Pearson has declined to serve as a member of the Cultural Arts Commission
due ~o ]ack of' time because of other civic commitments.
PAR~ AND RECREATION COMMISSION~ Mayor Pebley suggested the name of
Bob Cecil t~ fill one of the vacancies o~ the Park and Recreation Commission.
It was noted that Mr~ Cecil resides in the Savanna School District, which
District ~s presently considering participating in the joint recreational
program~
Council discussion followed, and it was their consensus that the
vacancy created by the resignation of Jack Co Dutton (term expired June 30,
]968) be filled at this time, and the vacancy created by the resignation of
Sam Punter (term expires June 30, 1971) be held open, pending determination
as to the participation by the Savanna School District°
PLANNING COMMiSSION~ Mayor Pebley suggested Paul Pletz be added
to the l~st of other names suggested for appointment to the Planning Com-
mission to fill the vacancy created by the resignation of Robert W. Mungall
(term expires June 30, 1969)~
The City Manager recommended that the City Clerk prepare a ballot
listing ali persons recommended to fill existing vacancies on the Park and
Recreation Commission and the City Planning Commission, to be voted upon
at the next meeting~
By general consent, the City Council instructed the City Clerk to
prepare ~uch a ballot for the meeting of January 21, 1969.
STB~IUM COMMiSSiON~ Councilman Du~ton requested the City Clerk search the
records to ascertain whether official recognition and commendation had been
extended to the Stadium Commission.
