1962/11/076238 City Hall, Anaheim, California - COUNCIL MINUTES - October 30~ 1962~ 3:00 P,M.~ ZONING CONTINUANCES: Councilman Chandler suggested that pending conditional use permits, variances and reclassifications which have been pending for a period of time be reviewed for possible termination, and that the City Attorney's office be requested to compose the wording concerning the amount of time to be placed on these actions, which would cause them to automati- cally become void after the expiration of one extension of time. The entire City Council was in accord with the above suggestion. CITY POLICY - SEAL OF THE CITY OF ANAHEIM: Mayor Coons reported that the Union Bank Building in Orange has in the entry a replica of the City seals of Orange County cities, and advised that the officials of the bank have made arrangements to make the moldsof the very excellent replicas available to the cities, and thereupon moved that it be a Policy of the City Council to install one of these plaques of the seal of the City of Anaheim on every municipal building we build now or in the future. CONTINUED PUBLIC HEARING, HOUSE MOVING PERMIT~ CARL F. BURNETT: Application by Carl F. Burnett to move a dwelling from Stanton House Movers Yard, Buena Park, California to 705 West La Verne Street, was submitted to the City Council October 30, 1962, and continued to this date to allow the City Attorney's office to determine the legality of granting said permit permit- ting a second dwelling on this R-1 lot. Assistant City Attorney Joseph Geisler reported that the best method to comply with the request would be for the applicant %0 file Record o£ Survey £or a lot spllt~ and request a variance~ or conditional use perrnit~ to allow more than one dwelling on subject property. Carl F. Burnett, 705 West La Verne Street, addressed the Council advising that he has commenced processing Record of Survey and variance, and 'the matter is scheduled for the November 26s 1962 agenda of the City Planning Commission. On the recommendations of the Assistant City Attorney, it was moved by Councilman Dutton, seconded by Councilman Krein, that said application be continued to December 11, 1962, to allow the applicant sufficient time for the filing of a variance and Record of Survey for a lot split. RECLASSIFICATION NO. 60-61-38 - REVISED PLANS: Revised plans submitted by Harry Knisely, Attorney for the applicant, in connection with Reclassification No. 60-61-38, filed by Richard E. and Mable Ostroot relative to R-3 and C-1 zoning, property located at the northeast corner of Nutwood Street and Ball Road, were reviewed by the City Council together with recommendations of the City Planning Department. Mr. Knisely came forward to the Council Table, and discussion was held concerning the revisions. Councilman Chandler moved that revised plans marked Exhibits "A-i" through and including Exhibit "A-a"~ be approved as submitted, subject to the development review of garages facing Nutwood Street. Councilman Dutton seconded the motion. MOTION CARRIED. RECLASSIFICATION NO. 62-63-3 - REVISED PLANS: Revised plans submitted by Dr. John J. Magrann in connection with Reclassification No. 62-63-3 were reviewed by the City Council together with recommendations from the City Planning Department. RESOLUTION NO. 62R-975: Councilman Schutte offered Resolution No. 62R-975 for adoption. Refer to Resolution Book. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE COMPROMISE OF CERTAIN EMINEN/ DOMAIN LITIGATION. (Henry Steinbrink, et al, $24,019.00) On roll call the foregoing resolution was duly passed and adopted by 'the followin9 vote: AYES: COUNCILMEN: Dutton, Chandler, Schutte, Krein and Coons. Wright, requesting change of zone from R-A to C-i, property located on the east side of Euclid Street approxima'tei¥ 82 feet south of Cris Avenue. Public hearing before th~ City Council was held August 21, 1962 and continued to October 16, 1962, at which time said public hearing was closed and action by the City Council deferred %o this date. At the request of Mr. and Mrs. Wright, dated November 7, 1962, for thirty day continuance, Council action on Reclassification 61-62-121 was deferred to December a, 1962, 3:00 P.M., on motion by Councilman Krein, seconded by Councilman Schu%%e. MOTION CARRIED. Councilman Chandler requested the record to show that he did not participate in the discussion, nor vote on this issue. CONTINUED PUBLIC HEARINGS~ AMENDMENTS TO 'TITLE 18~ CHAPTERS 18.52~ "M-i~" and 18.$6~ "M-2;" Pursuant to City Planning Commission Resolutions Nos. aS1, Series i962-63 and 482, Series 1962-63, public hearing was held before the City Council October 9, 1962 and continued to this date to re-draft pro- posed amendments in accordance with Council recommendations. City Planning Director Richard Reese addressed the Council explaining that since the last public hearing on proposed amendments to Title 18, Chapters 18.52 and 18.56 of the Anaheim Municipal Code relating to M-l, Light Manufacturing, and M-2, Heavy Manufacturing, Zones, meetings have been held with the Plannin9 and Zoning Committee of the Chamber of Commerce, the Board of Realtors, and two meetings of the Interdepartmental Committee, resultin9 in more suggested revisions. City Attorney Preston Turner ruled that said revisions were substantial and the proposed amend- ments should be referred back to the City Planning Commission prior to 6240 Qity Hall~ Anaheim, California - COUNCIL MINIffES - November 7~ 1962, 3:00 P.M. further consideration by the City Council, and thereupon recommended a two week continuance to allow for the completion of suggested revisions by the Interdepartmental Committee. On motion ~y Councilman Schu%%e, seconded by Councilman Chandler, City Council public hearings on subject proposed amendments were continued · to November 207 1962, 3:00 P.M. MOTION CARRIED. Mr. Lou Herbst, Herbst Brothers Metal Products, addressed the Council stating that he had been a member of %he Planning and Zoning Com- mittee for two years and has been working on the M-1 and M-2 Zoning amend- ments. In his opinion, the term "non-industrial uses" (referring to service businesses, e%c.) should be changed to, "the following related industrial uses". He did not believe that large industrial centers should have recreational businesses encroaching on their industrially zoned properties. Further, in his opinion the twenty feet of landscaping required, together with ten feet from the right of way, making a %oral of thirty feet land- scaped area, should De reduced to a ten foot requirement, thereby providing an additional %eh feet for parking. He proposed that the parking areas be planted at intervals, not necessarily in strips, thereby beautifying large blacktopped areas. In answer to Council ques'Zioning, Mr. Herbst stated that the Planning and Zoning Commii. tee did not favor any residential zoning directly across from industrial zoning. SIGN REC~UEST: Application was submitted by Tidewater Oil Company requesting permission to erect a non-conforming sign at 2000 East Center Street. Plans were reviewed by the City Council and report from the Building Department noted. Discussion was held by 'the City Council; at the conclusion thereof, Councilman Krein moved said request be granted, subject to the provision that there be no projection over the property line. Councilman $chutte seconded the mo'tion~ MOTION CARRIED. SIDEWALK WAIVER~ 1175 CHERRY WAY: Request of George T. Wieczorek for waiver of sidewalk requiremen% at 1175 Cherry Way, was submit%ed. Mr. James Maddox, City Engineer, reported on sidewalks presently installed in the area, and that subject parcel and the parcel on each side thereof, were the only ones wi%hodt sidewalks tn that side of the street; because of the close proximi%'y of the Patrick Henry School, felt the sidewalk was needed and thereupon recommended the request for waiver be denied. On %he recommendations of the City Engineer, Councilman Dutton moved sald request for waiver of sldewalk requirement be denied. Councilman Schu%te seconded the molion. MOiION CARRIED. VARIANCE NO. i465 - EXTENSION OF TIMF: Request of Florence Fitzgerald dated October 11, i962, for 180 day extension of 'time to comply with conditions of Variance No. 1465, was submitted. Said request was granted on motion by Councilman Schutte, seconded by Councilman Krein. MOTION CARRIED. PRIVATE PAIROL: Appiicaz!on of Aetna Maintenance Company, Inc., doing business as Aetna Plant Protection Co., for Private Patrol Permit, was submitted. Said perml% was granted in accordance with the recommendations of the Chief of Police, and subject to 'the provisions of Chapter 4.60 of the Anaheim Municipal Code, on motion by Councilman Chandler, seconded by Coun- cilman Du'tton. MOTION CARRIED~ CITIZENS~ CIVIL DEFENSE CO~ITTEE - RESIGNATION: Communication dated June 20~ 1962, from Mr. Stanley Weintraub tendering his resignation from the Anaheim Citizens~ Civil Defense Committee, was forwarded to the City Council by Paul L. PURCHASE - STREET LIGHTING: The City Manager reporied on informal bids received for the purchase and installation of eight Marbelite street lightin9 stan- dards, as follows, and recommended acceptance of the low bid, that of E. D. Johnson and Company, in 'the amount of $3,706.60 (including tax); E. D. Johnson and Company, Anaheim Gilbert & Stearns, Santa Aha Grimes Electric, Santa Ana $ 3,706.60 No Bid 4,306.60 On the recommendations of 'the City Manager, Councilman Dutton moved that the low bid of E. D. Johnson & Company be accepted, and purchase authorized in the amount of $3,706.60. Councilman Chandler seconded the motion. MOTION CARRIED. PURCHASE OF EQUIPMENT: The City' Manager reported on informal bids received for the purchase of concrete foundation and footings for the Hannum Sub Station, as follows, and recommended acceptance of the Iow bid, that of Jezowski and Markel in the amount of $3,488.00: Jezowski and Markel, Santa Aha Bert Bledsoe, Fullerion R. D. Pence, Sania Aha $ 3,488°00 5,075.00 No Bid Mr. George Oelkers, Director of Public Utilities, advised that this work was included in the contract with Bechtel Corporation for design and writin9 of specifications on certain items in the Hannum Sub Station. Specifications were received September 20, 1962 for these concrete footings; purchase requisition was issued the same day. [he Purchasing Department attempted to obtain olds, but because of the complexities of the job, only two out of several companies offered bids, both over the $2,500. limitations. Mr. Oelkers further explained that the annual holiday load increase will occur in less than six weeks; each year the Hannum Sub Station load has greatly zncreased, and a peak of over 700 amps ls expected this year, well in excess of their rated capacity. He reported load capacities of other sub stations and advised 'that they cannoi effectively relieve the Hannum Sub Station. Further, if there is failure of equipment a% this station, the whole area would black out, whereas an overload could result in the station's being blown up. Discussion was held by 'the City Council, the City Manager, Assis- tant City Attorney and Director of Poblic Utilities, and Mr. Murdoch explained thai according to projections made b'y o,r consulting firm, the re would have been time to advertise for bids for this work; but the electrical demands on the system have increased at a fas'Let rate than anticipated. Mr. Oelkers advised that %he problem wocld occur again, but specifications are in the final stage of completion for a mobil Sub Station which can be placed in any Sub Station, and which will relieve zhis urgency or threat to security which we are now experiencing. In view of %he drgency of %he situation and for the safety and welfare of 'the western portion of %he community, and because of the close proximity of the Christmas lighting period creating a peak load beyond the measure of safety, thereby likely causing equipment failure and a calamity by the blowing up of the Sub Station by a peak overload, it was moved by Councilman Krein, seconded by Councilman Chandler, that the informal bid of Jezowski and Markel be accepted and purchase in the amount of $3,a88.00 authorized. CITY PLANNING COMMISSION RESOLUTION NO. 510~ SERIES 1962-63: ResoluLion No. 510, Series 1962-63, of the Anaheim Planning Commission recommending that it be the wrihten policy of the Planning Commission and the City Council, that the re-filing of identical petitions for reclassification, conditional use permit, and/or var:ance not be accepted less than six months followin9 the denial of an original petition, was submitted. 6242 City Hall, Anaheim~ California - COUNCIL MINUTES - November 7, 1962, 3:00 P.M. It was moved by Councilman Schutte~ seconded by Councilman Chand- ler, that it be the written policy of the Council to require a six-month period before the re-filing of an application on an identical parcel of property for an identical use. MOTION CARRIED. Discussion was held concerning re-hearings and the possible inclusion of these requests in the above six month policy provision. Mr. Murdoch read in full Council Policy No. 105, and no further action was taken by the City Council. ORANGE COUNTY PLANNING COMMISSION - PROPOSED REZONING: Mr. Robert MacMahon, 560 California Federal Savings Building, addressed the City Council regardin9 property on the north side of Lincoln Avenue between Rio Vista Street and property just west of the Santa Aha River. Mr. MacMahon stated that he represents proper~¥ owners in the area, and that 'the County Planning Commis- sion proposes to revert approximately thirteen of the eighteen acres, which were zoned C-1 in April of i962, back to R-I and A-R-O~ al%hough said owners of 'the property in question did not make such a request. Further, he pro- poses to request the County Planning Commission to postpone any action on said rezoning until they have had Lime to investigate further. Mr. MacMahon pointed out that dedications for future street widening have been made along Lincoln Avenue, and deed restrictions imposed on the properties relative to setbacks, etc. Further, the Alpha Beta Market is nearing completion on the corner commercial property. Planning Director Richard Reese reported that in his opinion the initial thoughz behind the proposed zonin9 to a more restrictive use came about at a hearing by the Orange County Planning Commission on a recreation center proposed for some of the commerc~ai property. The City Clerk read from the minutes of March 21, 1962, pages 4720-4721, the action taken by the City Council on Orange County Plannin9 Commission proposed land 'use district changes. It was moved by' Councilman Chandler, seconded by Councilman Dutton, that the City Council reaffirm the policy previously stated~ and communicate to the Orange County Planning Commission and/or Board of Supervisors that the City of Anaheim has no interest so paramount in the zoning of property under consideration that would require the removal of already established zoning and vested rights included therein. BICYCLE LICENSING: The City Manager reported on the present method of licensin9 bicycles in the City of Anaheim, and recommended a change in procedure of licensing whlch would result in better control and facilitate return of stolen or lost bicy'¢les. Mr. Murdoch further advised that after investi- gation, it was determined that the better method would be to permanently stamp the license number on the frame of the bicycle, and to license each one only one time, unless '[he bicycle changed owners, total fee $1.00, and fifty cents for transfer of license. On motion by Councilman Dui%on, seconded by Councilman Chandler, the City Attorney's office was authorized to prepare an amendment to the Anaheim Municipal Code regulating the licensing of bicycles in accordance with the City Manager's recommendations. CIVIL DEFENSE - USE OF PUBLIC SCHOOLS: Mr. Robert Davis, Assistant City Manager, referred to a communication from the Orange County Civil Defense Planning Board concerning a policy agreed upon for the use of schools as emergency aid hospitals and welfare centers in case of a disaster. The City Manager ~xplained that there would be an agreement between the County Schools and the City for the proposed use, whereby those schools close to the Anaheim city limits would probably be assigned to the City of Anaheim jurisdiction in an over-all master plan. The City Council requested the City Attorney to review the pro- posal and deferred action on the proposed agreement to November 13, 1962. Brock, 1219 Fremont Street, representing the people who signed the petition in opposition which he circulated, said petition includin9 a total of 206 signatures, addressed the Council in opposition being of the opinion that as result of the proposed development, there would be traffic and trash pick-up directly Oehind their homes, and within twenty-five feet from their bedroom; that in his opinion, the requested R-3 would be spot zonin9 of multiple in a single family resi- dential area, which the home owners are trying to improve as rapidly as economically possible; that h~s interest is nor in whether Ber~;ley Street remains a dead-end street or continued out to Ball Road, but rather their coneern was as 6o the aotual developmen-t of the property, and were opposed to apartments direc'tl¥ in bac~ of their homes. Mr. Brock submitted a letter from Mrs. G. L. Hinkson, 1231 Yremont Street, adjacent to subject properiy, in opposition ~o ~he requested rezoning and apartment development. With reference to the petition of opposition submitted at the previous hearing, he advised that the signatures obtained from the residents in Buena Park were all property owners adjoining s~bject property. He further advised that he did not represent Westridge Home Owners Assooiation, only himself and those people who signed the petition of opposition wh~oh he circulated. 6252 City Hall~ Anaheim, California - COUNCIL MINUTES - November 7~ 1962~ 3:00 p.M, Mrs. Patrick Ochoa, i. 330 Oriole Street, addressed the Council in opposition, and with reference to 'the petition requesting the re-hearing~ she advised thai Westridge Home Owners did noi circulate the petition of protest; further, that only thirty-one signatures of the 206 signatures obtained were residents of Buena Park, the remainder of the signatures being from residents in fract No. 3501 in Anaheim; that all residents in the area were 9iven notices of the hearing by mail, as well as the property being posted and the door 'to door contact by those circulatin9 the petition, and therefore she was of 'the opinion that the reasons sub- mitted as a oasis for the requested re-hearing were not justified. Mr. John McMahon, i0090 Blanche Circle, Buena Park, addressed the Council in opposition, and questioned what assurance they would have that a development would ee single story if the property was zoned R-3. The Council explained 'the Code requirements pertaining to two- story development within i50 feet of single family residential. Discussion by the Council noted 'that the curbs and street improvements were constructed in such a manner to indicate that future extension of Berkley Street was considered. Mr. Bob Mann, 12i5 Fremont, addressed the Council in opposition, advisin9 that Mr. Collins and Mr. Bowman, also opposed to the development~ were in the audience. He referred to the newspaper article appearing in ihe Garden Grove News, dazed July 8, i962, stating that there is becoming a dangerous high rate of apartment houses in Anaheim. Mrs. Catherine Brock, l~19 Fremont, addressed the Council in opposition to the apartment development, being of the opinion that any further concession in their area would tend to devalue their property. Mr. Kniseiy in rebuttal again referred to the map he previously presented, indicaLing seven neighbors abuttin9 'the subject property in favor of the deveiopmenl, and two against. He further explained their proposed plans, and called attention ~o the layout for traffic flow within · the development. He felt the development would enhance the neighborhood, and referred to a similar development in Santa Aha, where the values of the adjacent property were increased, and slipulated that the proposed develop- ment would be of high caliber. Mayor Coons was of the opinion that no new additional evidence had been submitted, and 6herefore declared the hearin9 closed.
