Bergeson, of Martin Luther Hospital, gave the Invocation. FLAG SALUTE: Councilman Pebley led the Assembly in the Pledge of Allegiance to the Flag. MINUTES: Minutes of the Anaheim City Council regular meeting held February 24, 1970, were approved on motion by Councilman Pebley, seconded by Councilman Dutton. MOTION CARRIED. WAIVER OF REA~)ING - ORDINANCE AND RESOLUTIONS: Councilman Krein moved to waive the reading in full of all ordinances and resolutions, and that consent 'to the waiver of reading is hereby given by all Councilmen, unless after reading of the title, specific request is made by a Councilman for the reading of such ordinance or resolut'iom, Councilman Dutton seconded the motion. MOTION UNANI- MOUSLY CARRIED. REPORT - FINANCIAL DEMANDS AGAINST THE CITY: Demands against the City, in the amount of $822,508.98, in accordance with the 1969-70 Budget, were approved. CONTINUED PUBLIC HEARING - CONDITIONAL USE PERMIT NO. 1147: Mr, Jay Kingry, rep- resenting Pacific Outdoor Advertising Company, and Mr.~ Louis B. Minter, Owner, requested~e public hearing be continued to March 24, 1970, in order to clarify a few points and also to enable them to make their presentations before a full Council. Councilman Pebley moved that the public hearing be continued to March 24, 1970, 1:30 P.M., as requested. Councilman Krein seconded the motion. MOTION CARRIED. PUBLIC MEARING - RECLASSIFICATION NO. 69-70-10 AND VARIANCE NO. 2121: Submitted by George Collman and Horace Morlock, requesting a change of zone from County of Orange Al, to City of Anaheim, R-2-5,000, to establish a 44-1ot subdivision, on Portion "A"; and from County of Orange Al, to City of Anaheim R-3, to es- tablish a 157-unit one and two-story apartment complex, on portion "B". County A1 zoned property located at' the northeast corner of Kellogg Drive and Orange- thorpe Avenue. Requested waiver on Portion "A" only: a. development of single-family residential structures adjacent to arterial highways. ~ The City Planning Commission, pursuant to Resolution No. PC70-10, recommended said reclassification be approved, and that by so doing Title 18, Zoning,'of the Anaheim Municipal Code b~ amended to exclude the above-described property from the County Al, General Agricu~tural District, on Portions~"~' and "B", and to incorporat~ said property into the R-2-5,000, Single-Family Residential Zone on Portion "~', and R-3, Fmltiple-Family Residential Zone on Portion "B", upon the following conditions: Portion "A" Only: 1. That these reclassification proceedings are granted subject to completion of annexation of subject property to the City of Anaheim. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $125.00 per single-family unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. Portion "B" Only_: 1. That these reclassification proceedings are granted subject to completion of annexation of subject property to the City of Anaheim. 2. That ordinances reclassifying the property shall be adopted as each parcel is ready to comply with conditions pertaining to such par- cel, provided, however, that the word "parcel" shall mean presently exist- ing parcels of record and any parcel or parcels approved by the City Coun-. cil for a lot split. 3. That the owners of subject property shall deed to the City of AnaheiTM a strip of land 45 feet in width from the centerline of the street along Kellogg Drive, including a 25-foot radius property line return or cutoff at the Orangethorpe Avenue-Kellogg Drive intersection, for street widening purposes. 4. That all engineering requirements of the City of Anaheim along Kellogg Drive, 0rangethorpe Avenue and Post Lane, including prepara- tion of improvement plans, and installation of all improvements such as curbs and gutters, sidewalks, street grading and paving, drainage facili- ties, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; that street lighting facilities along Kellogg Drive, Orangethorpe Avenue and Post Lane shall be installed as required by the Director of Public Utilities, and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the instal- lation of the above-mentioned requirements, 5. That the owners of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Kellogg Drive, Orangethorpe Avenue, and Post Lane, for tree planting purposes. 6. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 7. That fire hydrants shall be installed as required and deter- mined to be necessary by the Chief of the Fire Department~ 8. That a 6-foot masonry wall shall be constructed along the north property lime of Portion "B". 9. That subject property shall be served by underground utilities. 10. That all air-conditioning facilities shall be properly shielded from view. 11. That any parking area lighting proposed adjacent to the single- family residential subdivision shall be down-lighting of a maximum height of 6 feet, which lighting shall be directed away from the property line to protect the residential integrity of the area. 12. Prior to the introduction of an ordinar~e rezoning subject property, Condition Nos. 3, 4, and 5, above mentioned, shall be completed. The provisions or rights granted by this resolution shall become null and void by action of the City Council unless said conditions are complied'with within 180 days from date hereof or such further time as the City Council may grant. 13. That Condition Nos. 6, 7, 8, 9, 10, and 11, above mentioned, shall be complied with prior to final building and zoning inspections. 14. That the owners of subject property shall pay to the City of Anaheim the sum of $75.00 per mUltiple-family unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 70- 118 City ~1.1, An~heim,i California - COUNCIL MINUTES - March 10, 1970, ~:30 P.M. The City Planning Commission, pursuant to Resolution No. PC70-11, granted said variance, subject to~'the followingconditions: 1. That this variance is granted subject to the completion of Re- classification No. 69-70-10, now pending. ~ 2. That subject property shall be developed substantially-in ac- cordance with plans and specifications on file with the City of Anaheim, marked Exhibit No. 1, Revision No. 1, for Portion "C' only. The Deputy City Clerk introduced correspondence received this date from the Orange County Planning Department, comm~nt!ng,~that~ mul~tipl.e-family divisons. Mr. Charles Roberts, with the aid of a sectional zoning map, noted location of subject property, the existing uses and zoning in the immediate area, and briefed the.evidence submitted to and considered by the City Plan- ning Commission. Mayor Pro Tem Schutte .asked if the Applicant was present and wished to address the City Council. Mr. Jeffrey Millet,~511 South Brookhurst Road, Fullerton, Agent, in answer to the correspondence from the Orange County Planning Department, felt they were inconsistent in their recommendations since it was his belief the~Orange County Master Plan shows a commercial corner on this property. The Mayor Pro Tem asked if anyone else wished to address the City Council; hearing no response, he declared the hearing.closed. RESOLUTION NO. 70R-124: Councilman Pebley offered Resolution No. 70R-124 for adoption, authorizing thepreparation cf necessary ordinance changing the zone as requested, subject to the conditions recommended by the City Planning Com- mission. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETER- MINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. TENTATIVE TRACT NO. 7103:' Developer-Engineer, Millet, King and Associates, Inc.; property located on the east side of Kellogg Drive, north of Orange- thorpe Avenue, containing 44 proposed R-2-5,000 zoned lots. The City Planning Commission, at their meeting held February 9, 1970, approved said Tentative Map, subject to the following conditions: 1. That the approval of Tentative Map of Tract No. 7103, Re- vision No. 1, is granted subject to the approval of Reclassification No. 69-70-10 and Variance No. 2121. 2. That should this subdivision be developed as more than one subdivision, each subdivision thereof shall be submitted in tentative form for approval° 3. That in accordance with City Council policy, a 6-foot mas- onry wall shall be constructed on the westerly property line separating lot Nos. 11, 12, 33, 34, and 35 and Kellogg Drive, except that for corner lot Nos. 12 and 13, said wall shall be stepped down to a height of thirty (30) inches in the required front yard setback. Reasonable landscaping, including irrigation facilities, shall be installed in the uncemented por- tion of the arterial highway parkway the full distance of said wall; plans for said landscaping to be submitted to and subject to the approval of the Superintendent of Parkway Maintenance. Following installation and acdeptance, the City of Anaheim shall assume the responsibility for main- tenance of said landscaping? 4~ That all lots within this tract shall be served by under- ground utilities. 5. That the vehicular access rights, except at Street and/or alley openings to Kellogg Drive shall be dedicated to the City of Anaheim. 6. That drainage easements and facilities shall be provided as required by the City Engineer. 7. That'Street names shall be approved by the City of Anaheim prior to approval of a final tract map. 8. That the owner(s) of subject property shall process the abandonment of Woodwind Lane (formerly Orchard Drive) being 40 feet wide along the northerly boundary of Tract No. 7103, Revision No. 1, from Post Lane to Kellogg Drive; and, Post Lane - 60 feet wide - northerly of the proposed alignment of Woodwind Lane. ANNEXATION: Pursuant to Resolution No. 70R-28, duly published in the Anmheim Bulletin and the Placentia CoUrier, February 4 and 11, 1970, and written notices mailed to the owners of property accord- ing to the last Equalized Assessment Roll, public hearing .was held on proposed annexation of uninhabited territory known and designated as the Miraloma- Coronado Annexation. The Deputy City Clerk reported that no written protests had been filed in her office. Mayor Pro Tem Schutte asked if anyone wished to address the City Council; there being no response, declared the hearing closed. Calhoun was submitted for partial refund of the license fee paid for the'King Kue Family Billiard Room, 613 North EUclid Street. ORANGE COUNTY USE VARIANCE NO. 6401: Excerpt from the Minutes of the City Planning Commission meeting held March 9, 1970, recommending denial of the requested batch plant, industrial buildings, truck storage and related uses, proposed in the M-1 Light Industrial zone located on the west side of Richfield Road, south of Orangethorpe Avenue, was submitted. On motion by Councilman Krein, seconded by Councilman Dutton, the recommendations of the City Planning Co~nission were sustained and ordered forwarded to the Orange County Planning Commission. On the recommendation of the City Engineer, Councilman moved that Final Map, Tract No. 60'86 be approved. Councilman Pebley seconded the motion. MOTION CARRIED. CLAIMS AGAINST THE CITY: City Attorney, and ordered referred to the insurance ~carrier~ on motion by Councilman Pebley, seconded by Councilman Dutton: a. Claim submitted by Roland Ladd for personal property damages purportedly sustained on or about February 4, 1970, res~lting from accident involving a City vehicle. b. Claim submitted by Jack C. TAX RATE STATEMENT: On motion by Councilman Dutton, seconded by Councilman Pebley, the following Tax Rate Statement was approved and adopted as follows: "IN CONNECTION WITH $17,035,000 GENERAL OBLIGATION BOND ISSUES TO BE SUBMITTED AT BOND ELECTION ON APRIL 14, 1970 IN THE CITY OF ANAHEIM.
