"WHEREAS, on March 13, 1970, Lt. JG Leo G. Yoder, attached cc
VRF-32, stationed at the North Island Naval Air Station in San Diego, Cai~.-
fornia, successfully maneuvered his disabled A-4C Jet Skyhawk to one of
the relatively few vacant parcels of land within this City where it crashed;
and
WHEREAS, in the immediate vicinity of the crash site, there is
a heavily populated residential area, the Anaheim Stadium and several large
industrial concerns; and
WHEREAS, Lt. Yoder without regard for his personal safety piloted
his crippled aircraft to a safe crash site, ejecting only moments before
the crash, thereby, averting a tragic catastrophe; and
WHEREAS, the members of the City Council are extremely grateful
that Lt. Yoder suffered no serious injuries as result of this heroic deed.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Anaheim and on behalf of the citizens of Anaheim, that Leo G. Yoder be
publicly co~ended for his courageous action taken on behalf of the welfare
and safety of the people of Anaheim.
A~N'D, BE IT FURTHER RESOLVED that this Resolution be spread in
full upon the minutes and a copy thereof forwarded to Lt. Leo G. Yoder via
his Commanding Officer.

REPORT - FINANCIAL DEMANDS AGAINST THE CITY: Demands against the City, in the

CONTINUED PUBLIC HEARING - CONDITIONAL USE PERMIT NO. 1147: Submitted by Louis
B. Minter, to erect a billboard which exceeds the maximum permitted display
area on C-1 zoned property located on the east side of Brookhurst Street,
north of Lincoln Avenue, with waivers of:
a. Maximum permitted height within 300 feet of a residential
structure.
b. Distance fr°m a residential structure.

2. That subject property shall be developed in accordance with the
provisions of the Billboard Ordinance; provided, however, that said billboard
may be located 70 feet from a residential structure as granted by the above
waiver.
Appeal from action taken by the City Planning Commission was filed
by Mr. Jay Kingry, Pacific Outdoor Advertising Company, Agent, and public
hearing scheduled February 17, 1970. Public hearing was delayed to March 10,
1970, at the request of Mr. Kingry, and continued to March 24 at the request
of Mr. Kingry and Mr. Louis B. Minter, to enable them to clarify some points
and also allow them to make their presentation before a full Council.
Zoning Supervisor Charles Roberts noted the location of subject
property, the existing uses and zoning in the immediate area, and briefed
the evidence submitted to and considered, by the City Planning Commission,
stating the requested sign would be 39-1/2 feet high, and have a total dis-
play area of 674 square feet.
Councilman Clark raised the question of whether large billboards
have been approved for the advertising company of Foster & Kleiser.
Mr. Roberts advised there had been' but not in a situation similar
to this one.
In answer to Councilman Clark's query as to whether some billboards
have been taken away from Pacific Outdoor Advertising Company by passage of
the Billboard Ordinance, Mr. Roberts advised the ordinance did take several
billboards off the Freeway, however, since this ordinance was adopted there
have been 65 additional billboards constructed in Anaheim, and Pacific Out-
door Advertising Company has developed 6 of those.
Councilman Dutton asked why the sectional map did not show a shore
street throu~ from Brookhurst to Lindsay.
Mr. Roberts informed him that was a private driveway.
Mayor Clark asked if the Applicant was present and wished to address
the City Council,
Mr. Jay Kingry, representing Pacific Outdoor Advertisin$ Company,
recallin$ the loss of 5 or 6 billboards on the Freeway, due to the Billboard
Ordinance, said he felt no other company would object to their bein~ 8ranted
this conditional use permit, because of chose losses. He also stated that
there had been no objection to their request, either from other companies or
residents in the general area involved.
Mr. Louis B. Minter, 502 North Bedford Drive, Beverly Hills, the
Applicant, read the following excerpt from a letter he wrote to the City
Plannin8 Commission on January 6, 1970:
"The purpose of this letter is to respectfully advise you that the
City of Anaheim has requested me to dedicate 20 feet of the frontase of the
real property upon which the above-numbered permit is requested. I merely
wish to call to your attention that I have communicated to the Division o.f
Engineering an arrangement of exchanging the 20 feet for certain other rights,
which would be a substantial money saving to the City of Anaheim."

Assistant City Manager Robert M. Davis recommended dedication of
the aforementioned 20 feet for street widening be required in conjunction with
the conditional use permit, if granted.

Mr. Minter stated dedicating the proposed 20 feet of land for
street widening would cut their parking spaces from 5 to 3, and they could
only be replaced by covering the channel. However, he felt something on
this could be worked out with the Engineering Department.
RESOLUTION NO. ?0R-138: Councilman Schutte offered Resolution No. 70R-138
for adoption, granting Conditional Use Permit No. 1147, as requested, sub-
ject to the conditions recommended by the City Planning Commission, and
with the additional requirement of the dedication of 20 feet along Brook-
hurst Street, for street widening purposes.
Prior to the vote, Councilman Dutton advised that, according to
the letter submitted by the Applicant to the City planning Commission, this
appears to be a violation of the existing Sign Ordtnande, in exchange for
a 20-foot dedication of land for street widening, to which he objected.

RELEASE OF LIEN: On receipt of notice from the Director of Public Works that
payment in full had been received for the 1966 sidewalk repair at 162
West Lincoln Avenue, it was moved by CounCilman Pebley, seconded by Coun-'
cilman Krein, that the lien against said property for this sidewalk repair
be released. Y~'~"~ON CARRIED.
WAGNER PROPERTY - TAXES: The Assistant City Attorney advised that the funds
held in escrow to pay the City's pro-rata share of taxes on the Wagner
property was insufficient by $64.89.
On motion by Councilman Schutte, seconded by Councilman Pebley~,
reimbursement to the Henry Wagner Estate in the amount of $64.89 was au-
thorized. MOTION CARRIED.
MOTHER COLONY HOUSE ADVISORY BOARD APPOINTMENT: Mr. Cortez Hoskins was ap-
pointed a member of the Mother Colony House Advisory Board, to replace
Mr. R.E. Fttzwater, who resigned, on motion by Councilman Pebley, seconded
by Councilman Schutte. MOTION UNANIMOUSLY CARRIED.
ADJOURNMENT: Councilman Pebley moved to adjourn. Councilman Krein seconded
the motion. MOTION CARRIED.

approved on motion by Councilman Dutton, seconded by Councilman Pebley.

WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Schutte moved to
waive the reading in full of all ordinances and resolutions, and that con-
sent to the waiver of reading is hereby given by all Councilmen, unless
after reading of the title, specific request is made by a Councilman for
the reading of such ordinance or resolution. Councilman Krein seconded
the motion. MOTION UNANIMOUSLY CARRIED.
