MINUTES: Minutes of the Anaheim City Council meeting held July 14, 1970, were
approved on motion by Councilman pebley, seconded by CoUncilman Clark.
WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Clark moved to waive
the reading in full of all ordinances and resolutions, and that consent to
the Waiver of reading is hereby given by all Councilmen, unless after read-
ing of the title, specific request is made by a Councilman for the readin;g
of such ordinance or resolution. COuncilman Thom seconded the motion.

PUBLIC HEARIN~ - VARIANCE NO. 2182: Submitted by A.H. Shipkey, Incorporated, to
permit the establishment of a passenger car and truck tire sales facility with
outdoor service on C-2 zoned property located on the north side of Lincoln
Avenue, east of Harbor Boulevard, with waiver of:
a. Permitted uses in the C-2 Zone.
The City Planning Commission, pursuant to Resolution No. PCT0-101,
denied said variance.
Appeal from action taken by the City Planning Commission was filed
by Arthur H. Shipkey, Applicant, and public hearing scheduled this date.
Zoning Supervisor Charles Roberts noted the location of subject pzo-
perry, the existing uses and zoning in the immediate area, and briefed the
evidence submitted to and considered by the City Planning Commission.
Mr. Roberts reported meetings with the Applicant subsequent to the
City Planning Commission hearing indicated he would submit revised plans to
provide for construction at the rear of subject property, thus allowi~ some
operating activity to be carried on indoors and thereby reducing some of the
noise.
Arthur H. Shipkey stated he needed additional space to permit him
to enlarge his business. Mr. Shipkey noted his original application was for
a general tire service, not specifically a truck service. He added that his
truck tire service comprised 10% of his total business, and of the 10%, only
1% comes into the yard, the balance is taken care of off his premises.
Councilman Thom noted that Mr. Shipkey had indicated, if he were
lowed to expand his business by the use of subject property, he would remove
a shed on his property now located next to the Union Service Station. Mx. Ship-
key said this was his intention and he would so stipulate, and in addition ad-
vised of his intention to paint the buildings on the existing location within
the coming week.
Mr. Shipkey presented revised plans indicating removal of one exist-
ing building used as a bicycle shop, thus allowing creation of a drive=through
to the alley and enlargement of a second building to provide storage and indoor
working area.
The Council reviewed the revised plot plan.
In answer to Councilman Pebley's query on ~d~ere old tires would be
stored, MX. Shipkey stated he planned to build a bin at the rear of the property
for this purpose, and also advised that these Junked tires would be periodic=
ally removed to another facility on Broadway.
MX. Shipkey stated he .would like to remove an existin~ four-foot block
wall at the rear of subject property and said the property owner adjacent tc hie
property at the rear had indicated the block wall impeded hie using hie ~ara~e.
He added that the two property owners behind the block wall had signed the pe-
tition endorsing subject proposal.
Councilman Dutton asked how he would operate both places if he was
granted permission for this second facility aCross the street from hie preeen~
operation. MX. Shipkey answered he would like to Operate as is for approxi-
mately one year, or until he could set subject property cleaned, but would
like to be able to use subject property for chansin~ some tires in the mean-
time.
In answer to Councilman Thom's inquiry, Mr. 8h!pkSy said he ~ould be
agreeable to a condition of removal o£ unsightly bulldinSs on subject proper~y
within a year.
Mayor Dutton asked if anyone wished ~o address the C~oll in oppo-
sition.
Mark Metzler, o~ner of property at 316-318 We~ Lincoln Avenue,
stated he felt I~. Shipkey's operation should be classified lndultri&l, and
t'~us did not beloG$ in what is now the downtown Anaheim area.

Mr. Metzler advised of the e~pense.incurred in upgrading his own
building because he felt the whOle area soon would be improved. He added,
if Mr. Shipkey wished to enlarge his operations this would worsen the pres-
ent traffic problem, rather than alleviate it.
Henry Bosch, 338-350 West Lincoln Avenue, referred to the varieus
meetings held two years ago about plans the City had for upgrading the Cen-
ter City Area westerly to Harbor Boulevard. As a result, he averred, con-
siderable money for new and improved'buildings had been spent by him and
Mr. Metzler, the Bank of America, and Home Savings and Loan Association,
specifically. He added that this area ordinarily is the first impressior~
visitors coming from the west have of Anaheim, and he believed Mr. Ship-
key's operations were industrial and should be in an industrial area.
Mayor Dutton invited the Applicant to again address the Cooncil.
Mr. Shipkey declared his operation was commercial and not indus-
trial; that he does not solicit truck business into his place of business,
but prefers to send equipment out to work on trucks away from his operation.
Mr. Shipkey said he too was attempting to upgrade the area by
cleaning up subject property and removing unsightly buildings, and in the
process will be able to provide offstreet parking for equipment, employees
and customers.
It was determined sufficient evidence had been presented, and
Mayor Dutton declared the hearing closed.
Councilman Stephenson questioned whether Mr. Shipkey's expandec.
operations would be in keeping with other ~fforts to upgrade the area,
.stating he felt perhaps enlarging the operations would be detrimental to
the overall appearance of the area.
Councilman Thom said he felt the area would be upgraded by Mr.
Shipkey's removing the existing "eyesore" bicycle shop building and re-
habilitating a second structure on subject property. He also felt that
subject proposal would be a compatible use, since Mr..Shipkey's operation
is presently surrounded by service stations and tire stores on both side,s'
.of the street.
Councilman Dutton said he did not feel subject proposal was in
the best interest of the City, since it did not conform with Site Develop-
ment Standards. He stated he would be more in favor of it if a new buil¢.-
~ing'was constructed, rather than remodeling an existing one, and although/
.imProvements are supposed to be completed within one year, there Was no
guarantee they would be.
RESOLUTION NO. 70R-373: Councilman Thom offered Resolution No. 70R-373
for adoption, granting Variance No. 2182, subject to the following amended
conditions recommended by the 'Interdepartmental Committee:
' 1. That the owner(s) of subject property shall deed to the City
of Anaheim a strip of land 10 feet in width from the centerltne of the al-
ley for alley-widening purposes.
2. That trash storage areas shall be provided in accordance with
approved plans on file with the office of the Director of Public Works.
3. That all air conditioning facilities shall be properlY shielded
fro~ view.
4. That any parking area lighting proposed shall be down-light-
ing of a maximum height of 6 feet, which lighting shall be directed away
from the property lines to protect the residential integrity of the area.
5. That subject property shall be developed substantially in
accordance with plans and specifications on file with the City of Anaheim
marked Exhibit No. 1, Revision No. 1, to be implemented within a period
of one year.

6. That Condition No. 1, above mentioned, shall be complied with
prior to the commencement of the activity authorized under this resolution,

7. That Condition Nos, 2, 3, 4, and 5, above mentioned, shall be
complied with prior to final building and zoning inspections.

~BLIC. HEARING, - CONDITIONAL USE PERMIT NO 1181: Submitted by Frank Krogman, to
establish on-sale beer in a proposed beer bar limited to adults only, on C-1
zoned property located south and west of the southwest corner of Magnolia
and La Palma Avenue.
The City Planning Commission, pursuant to Resolution No. PC70-98,
denied said conditional use permit.
Appeal from action taken by the City Planning Commission was filed
by Judy Nelson, operator of subject establishment, and public hearing sched-.
uled this d~te.
Zoning Supervisor Charles Roberts noted the location of subject
property is within a small, commercial shopping center, and briefed the evi-
dence submitted to and considered by the City Planning Commission. Mr. Rob-
erts stated that a conditional use permit (NO. 1109) for this establishment~
had been granted in 1969 for On-Sale Beer and Wine,'.in. conjun~ion~With
a restaurant; however, subsequently the City Planning Commission and Planning
Staff were informed the operation was being conducted solely as a beer par-
lor, and the Applicant~ who either is in the process or already has purchased
the property, desires to continue to operate it as a beer parlor.
Mayor Dutton asked if anyone wished to address the Council; there
being no response, declared the hearing closed.
Councilman Stephenson asked if there had been complaints from the
neighborhood or the Police Department on subject establishment. Councilman
Clark, who owns property in the area, said he knew of none.
Councilman Pebley said his experience has shown that a beer parlor
in a shopping area can help to bring customers into that shopping center.
In answer to Councilman Dutton's query of what in the area attracts
children, and thus would make the establishment undesirable from that point,
Mr. Roberts indicated a cold drink stand on a corner..,

signed by 44 area residents, and received at open meeting.
Zoning Supervisor Charles Roberts noted the location of subject
four.R-l~parcels, existing'uses and zoning in the'immediate area, and
briefed the evidence submitted to and considered by the City Planning
mission.
Mayor Dutton asked if the Applicant was present and wished to ad-
dress the City Council.
Joseph F. Grant, 4662 Howard Street, Los Alamitos, advised)be-
cause~the original protest petition mentioned his proposed 'large sign~he
had withdrawn his waiver request and thus could provide a drive'through
for customers and ample off-street parking through the required setback.
He also believed his expected enrollment of 100 children would not cause
any unnecessary.additional traffic in the area, since subject property is
close to the major thoroughfare of Knott Avenue.
Mr. Grant stated subject property could be made more attractive
by his proposal, and this could help the whole area become more attrac-
tive and valuable, rather than a low-rental area. He also felt a pre-'
school nursery and facilities for teaching children having learning dif-
ficulties was desirable, in a residential area.
In reply to Councilman Dutton's questioning his statement subject
petition could not "with any honesty" be denied, Mr. Grant stated he be-'
lieved this property would not remain residential because of the close
proximity of heavily-traveled Knott Avenu~ which supposedly is to be wi,
dened.

Councilman Pebley suggested a peti. tion for the proposed project
Knott Avenue, or other arterial streets, would be more appropriate.
Mr. Grant replied he formerly sought a location in the City of St~.:n-
ton, and they also require a separate zoning action; to his knowledge, neither
City has a zone where this activity can be conducted as a matter of right.
Mayor Dutton asked if anyone wished to address the Council in op-
position.
Mrs. James E. Westbury, 3434 Thornton Avenue, stated she had copied
subject proposed plans and passed them around the neighborhood before circu-
lating the protest petition submitted at this meeting. Mrs. Westbury objected
to the additional traffic that would result from subject proposal; and furt~er-
more objected to the "low-rental area" reference. She stated Hanson Elementary
School presently has a curriculum for giving poor readers special instruction,
and thus additional outside facilities are not needed.
Herbert Bass, 3408 Thornton Avenue, objected to subject proposal
because of the additional traffic hazard it would create.
Mayor Dutton asked if anyone else wished to address the Council;
hearing no response, declared the hearing closed.
RESOLUTION NO. 70R-375: Councilman Clark offered Resolution No. 70R-375 for

2, 1970, at Carpenters Hall, 608 West Vermont Avenue, was submitted and granted
subject to provisions of Chapter 4.16 of the Anaheim Municipal Code, as reccm-
mended by the Chief of Police, on motion by Councilman Stephenson, seconded
by Councilman Clark. MOTION CARRIED.
VARIANCE NO. 2054 (67-68-98) - REQUEST FOR INCREASED NUMBER OF STRUCTURES: Action
taken by the City Planning Commission on request of Apollo Development Cor-
poration for amendment to City Planning Commission Resolution No. PC69-27,
to increase from 13 to 33 the number of homes having less than the required
1,525 square-feet in an R-2-5,000 Zone was submitted.
The City Planning Commission, at their meeting held July 13, 19702
by Motion, granted said amendment to Variance No. 2054, based on the fact
that the proposed homes were comparable in quality to the exterior of homes
selling at $35,000.00, and that there would be no small homes built adjacent:
to the existing R-1 homes to the east and north.

On motion by Councilman Clark, seconded by Councilman. Thom, the
City Council sustained the action taken by the City Planning Commission
in .revising Variance No. 2054 to increase from 13 to 33 the number of struc-
tures having less than 1,525 square-feet of floor area. MOTION CARRIED.
SAFETY CROSSING DEVICES - VICINITY OF JOHN MARSHALL SCHOOL: Three petitions
for safety crossing devices in the vicinity of John Marshall School were
submitted, as follows:
1. Petition dated July 8, 1970, submitted by Georgia Fenster-
macher, 2163 Catalpa Avenue, containing approximately 49 signatures, re-
questing a crossing guard at all times at Maple Street and La Palma Ave-
nue.
2.. Petition submitted by Margaret M. Baley, 910 Fairview Street,
dated July 13, 1970, containing approximately 54 signatures, requesting
crossing guards at the corners of Falmouth Avenue and Brookhurst Street,
and Maple'Street and La Palma Avenue.
3. Petition submitted by Councilman Clark, July 14, 1970, con-
taining approximately 217 signatures, requesting a pedestrian light on.
· Brookhurst Street at Falmouth Avenue.
Also submitted was correspondence from Bruce Nestande, dated
July 23, 1970, and State Assemblyman Kenneth Cory, supporting a request
for a pedestrian light on Brookhurst Street at Falmouth Avenue.
The Council reviewed reports from the City Engineer, recommending
a crossing guard not be employed on La Palma Avenue and Maple Street, other
than during the regular school year; and that traffic signals with pedes-
trian pushbuttons not be installed, and further that the existing painted
crOssWalks be removed and "Not a Crosswalk" signs be installed on Brook-
hurst Street at Falmouth Avenue.
City Engineer James P. Maddox suggested an asphalt sidewalk on
the north side of La Palma Avenue, east of Brookhurst Street, where regular
sidewalks do not now exist, would alleviate the situation at this time.
Mr. Maddox added that, although a traffic ~ignal on Brookhurst Street at
Falmouth Avenue may be reasonable in four to five years, at the present
time their studies show it is completely unjustified.
Discussion brought out the fact that a crossing guard during the
school year cost approximately $1,600.00, whereas a traffic signal costs
$18,000.00 to $20,000.00, not including annual maintenance costs.
Councilman~Dutton asked what the situation would be when the
Brookhurst-La Palma interchange is modified. Mr. Maddox replied this modl'
fication is scheduled for 1972 or 1973, and would bring a new offramp from
the Santa Ana Freeway, northbound, onto La Palma about midway between Maple
and Brookhurst, and that crossing would be signalized.
... Councilman Stephenson asked the cost of a pedestrian signal. Traf-
fic Engineer Edward Granzow advised a pedestrian signal costs about $10,000
to $12,000.
Mr. Granzow said he would be concerned about installing a pedes-
trian signal adjacent to two intersections, and that there still would be
the problem of left-turning vehicles through the crosswalk, since Brook-
hurst would be the only crossing controlled.
Mayor Dutton invited petitioners to address the Council.
Thomas Th°mure, 2215 Fa!mouth, stated there was a need for cross-
ing protection for children during .summer months and outside school hours,
as. well as during school hours.
Mr. Thomure said some Scoutmasters are reluctant to accept mem-
bers from the west side of Brookhurst Street because of the problem of
assuring that the' children get back across the street safely. Mr. Thomure
said the requested traffic signal did not necessarily have to be at the

corner of Brookhurst and Falmouth, as long as it is across Brookhurst between
the Freeway and La Palma Avenue.
Mr. Granzow advised if a signal were to be installed at that loca-
tion, it most likely would be the east leg of Falmouth Avenue and west leg of
Grayson, rather than Falmouth itself.
Mr.' Thomure said five children already have been hurt crossing at
this location.
Mr. Granzow explained three children were injured when the brakes
failed on an automobile, and one'was a bicyclist who rode out of Falmouth
without stopping.
Mr. Granzow advised the Brookhurst-Falmouth crossing is not among
the 30 they feel are most in need of signalizing. Since approximately 10
traffic signals are installed each year, unless the situation should change,
Mr. Granzow said it would probably be three to five years before this crossing
would meet necessary warrants to be considered for signals.
In answer to Councilman Stephenson's question, Mr. Granzow advised
there presently are 22 crossing guards employed during the school year.
Councilman Thom suggested the possibility of accelerating the in-
stallation of crossing signals.
Councilman Pebley said perhaps some such means as a 5% property ~tax
increase, or a 10% entertainment tax, or even deferring additional parks, woald
allow acceleration of the installation of traffic signals.
Councilman Stephenson said if an additional tax is to be considered
it should not be an entertainment tax, since that would be a levy of tax on
residents of other cities and states for a strictly local problem.
The City Manager said, along with other Budget considerations, he
would like to go over allocations with the City Engineer to determine the fea-
sibility of diverting some street surfacing funds to acceleration of traffic
signal installations.
Dennis Ebert, 915 North Holly, acting as a crossing guard on his own
time at La Palma Avenue and Maple Street for this year's summer school session,
said there have been a number of close calls where children would have been
hurt if he had not gone into the street to stop vehicles.
Mr. Ebert said there are several pre-kindergarten and pre-first grade
children attending the summer school session, and he felt if the school was open
for these small children a crossing guard should be provided.
Councilman Dutton reminded Mr. Ebert the City has no jurisdiction
over what the schools offer for summer classes. He added he felt the parents
should assume some responsibility for the safety of their children.
Mrs. Peggy Baley, 910 Fairview Street, said she believed summer school
attendance no longer is voluntary, that it is necessary if you want your chil-
dren to be prepared in advance of regular school.
Mrs. Baley said, as a parent, she is willing to pay her proportionate
share of the cost of a crossing ~uard at La Palma and Maple.
Councilman Stephenson made ~ motion ~9 not employ a crossing guard

The City Manager advised making any change in crossing guard
services would entail a change in City Council Policy.
=Councilman Clark stated he did not feel crossing guards should
be employed just for summer school hours.
Councilman Pebley stated rather than employing a crossing guard.
for summer school, as well as regular school hours, he would 'support in-
stalling a crossing signal.
At the suggestion of Councilmen Pebley and Dutton, action on
subject request was deferred until further-studies can be made on the pos-
sibility of shifting some Budget priorities.
Councilman Stephenson withdrew his motion.

NATIONAL ANALYST~, INC. - BEER-TASTING SURVEY: Assistant City Attorney John
Dawson reported a request from National Analysts, Inc., to conduct a beer-
tasting survey for one month, commencing August 3, 1970, in an Anaheim
shopping center.
Zoning Supervisor Charles Roberts reported the City Planning
Conunission had considered the request and voted it be determined at a
public hearing.
Mr. Dawson advised the Alcoholic Beverage Control Office permits
.the function of beer and wine tasting, and stated time was of the essence
since the survey was scheduled to begin August 3rd.~
On recommendation of the City Manager, Councilman Stephenson
moved to approve a Beer-Tasting Survey by National Analysts, Inc., at an
Anaheim shopping Center, as a temporary use, not to exceed one month from
August 3, 1970. Councilman Dutton seconded the motion. MOTION CARRIED.
MOTHER COLONY HOUSE ADVISORY BOARD APPOINTMENT: On motion by Councilman Stepken-
son, seconded by Councilman Clark, Mrs. Dorothy Ulvestad was appointed to
