Murdoch ASSISTANT CITY MANAGER: Robert M. Davis ASSISTANT CITY ATTORNEY: John Dawson CITY CLERK: Dene M. Williams PERSONNEL DIRECTOR: Roy Hetssner Mayor Dutton called the meeting to order. RECESS - EXECUTIVE SESSION: At the request of the City Manager, Councilman Thom moved to Recess to Executive Sessiofl, for the purpose of discuss- ing personnel matters. Councilman Pebley seconded the motion. MOTION CARRIED. (9:02 A.M.). AFTER RECESS: Mayor Dutton called the meeting to order, all members of the City Council being present. (10:15 A.M.). EMPLOYEE NEGOTIATIONS: 'Mayor Dutton advised the Council had again reviewed the information furnished by the employee associations and discussed it with the Staff to determine if there was any appropriate reason to changa their final offers; however, after reviewal it was felt each item brought up by the associations had been considered prior to the making of the fi- nal offers. Therefore, he added, there was no feeling on the part of the Council that any change in the final offers should be made. The City Manager advised that, although not to be included in a memorandum of understanding, the Council, in its discussion, had agreed there would be no change in the uniform policy in the Parks and Recrea- tion Department, unless there was a majority indication by vote on the part of the employees affected, Jake Petrosino, representing the A.M.E.A., thanked the Council for allowing A.M~E.A. representatives to make their presentation and ad- vised the Council's decision would be taken under advisement. Mayor Dutton and the City Manager left the Council Chambers, and Mayor Pro Tem Pebley assumed Chairmanship of the meeting. (10:20 A.M.). HANDBILLS: Councilman Clark expressed his concern regarding a recent handbill distributed to residences advertstng an "adult only" movie, and the fact that delivering it door-to-door made it available to children, He added that the fact that'a coloring book was distributed at the same time made the package attractive to children, Mr. Clark asked that the Administrative Staff and City Attorn- ney's office be instructed to research present ordinances or investigate the possibility of adopting a new ordinance to insure this type of mater- ial cannot be distributed as a hand-out. Councilman Stephenson advised that, although distasteful, ac- cording to a Supreme Court ruling, the matefial in question could not be ruled obscene and stated that the only way it could be controlled is by electing officials Who would change the laws. Assistant City Manager Robert M. Davis advised that a law govern- ing what type of material can be distributed to homes could be considered an infringement of the right of free speech although the City Attorney's office, at this time, is investigating possibilities. Assistant City Attorney John Dawson advised that the City Attor- ney's office had reviewed the movie in question and had suggested a con- tinuity be made for possible presentation in court; however, legal defi- nitions of obscenity still would make it difficult to get a court order prohibiting continued showing of the movie. He stated his office would 70-533 Hall, An..~heim, California - COUNCIL MINUTES - October 7, 1970, 9100 A.M. investigat~ possible ordinances governing the type of nmterial distributed in such a manner that it-WoUld be available to children; however, this.could be difficult to enforce, : Councilman Clark invited Mrs. Alfred Moreno, 2659 West Rome, to address the Council. Mrs. Moreno presented a petition purportedly containing 1,567sig- natures of citizens objecting to the handbill in question, and asked that laws bepassed to prevent residents from being subjected to that~type of ma- terial again. Mrs. Moreno also raised objection to distribution of handbills at the time children are enroute to school. In answer to cOUncilman Thom's suggestion of an ordinance prohTbit- ing distributioh of door'to-door material, as had been done in:Fullerton, Assistant City Attorney Alan watts advised that that ordinance is Under liti- gation at this time. He further advised that the possibility o~filing a charge under the recently-adopted Penal Code gainst distributing harmful ma- terial to children under the age of 18 is being investigated. Councilman Pebley recommended filing the charge, even if it would not hold up in court; Councilman Clark recOmmended the charge be filed against Loew's Theatres, and not the distributing firm. Councilman Stephenson advised that there presently is.a require- ment under a solicitor's license where persons wishing to distribute that type of material, or solicit, must go before the Police Department for a permit and be recorded; h~oWeVer, quite Often these firms get in and out~ be- fore they can be caught. He reiterated the material in question.Unfortunately could not be ruled obscene, according tb the. interpretatiOn~of the laws. On motion by Councilman Pebley, seconded by councilman Clark, the petition °bJ~ctfng to the advertisement was returned to Mrs. Moremo, as re-. quested. MOTION CARRIED. ~.. OF UNDERSTANDING: Personnel Director Roy Heissner advised that a two-year memo of understanding had been signed with the A.M.E.A. for a 7-1/2% salary increase, effective September 25, 1970, and a 7% salary in- crease the second year. He added that the memo of understandt~$ also in- cluded rate increases for health insurance for the next two yearS, and a ions-term disability insurance program; wherein the City will pay the full
