The City Council of the City of Anaheim met in adjourned regular
meeting.
PRESENT: COUNCILM£N: Pebley, Dutton, Schutte, Krein and Chandler.

The meeting was called to order by Mayor Chandler.
CONVE~TION CEN~ER SITE: Because of a possibility of conflict of interest, Mayor
_Chandler withdrew from the meeting, and Chairmanship of the meeting was .
~ssumed by Mayor Pro Tem Dutton.
Mr. Geisler reported on a proposed settlement on the original
Selected site for the Convention Center Facility (Katella Avenue and
Harbor Boulevard), and reviewed the basic provisions contained in the
proposed Settlement Agreement and Supplemental Settlement Agreement,
providing for City possession of the property except the interest alleged
bY the Kay Estates. Total cost to the City for the 55. acres $4,520,165.00
or $82,185.00 per acre.
Mr. Geisler further advised of his assurance of title policy,
on all but seven and one half acres of the site, and was of the opinion
that upon final disposition of the suit involving the seven and one half
.acres~ the City will be reimbursed for the loss of possession of the
property pending the litigation which is now outstanding.
In conclusion of the report, Mr. Geisler recommended that the City
Proceed with this site if determined by the City Council to be the best site
for the Convention Facility, and that the cost per acre is justified.
Regarding financing, Mr. Geisler advised clear title will be
~equired for financing; however, the City will have a title policy on
approximately 47 acres in an estimated three or four weeks, which is more
than sufficient for the facility itself, including parking.
Discussion was held not only on the provisions of the Settlement
Agreement and Supplemental Settlement Agreement, but also methods regarding
financing of the project.

Mr. Geisler explained that the Supplemental Settlement Agreement
changed two basic provisions:
1. Expenditure of an additional $10,000 by the City of Anaheim.
2.. The limitation on the investors to $300,000, as it involves the title
of the claim of the Kay Estates.
Mr. Murdoch reported on the analyzation of various alternate
sites, both in the Disneyland area and remote from the Disneyland area.
He advised that as of this time the only sites available for immedi-
ate possession are those remote from the Disneyland area, presenting the fol-
lowing additional cost factor; altering the site plan for this facility to
accommodate a new location at an approximate cost of $10,000 plus a 30 day
delay. If the plan required reversing, the additional cost would be
approximately $60,000 inasmuch as the plans are now 100 percent complete,
and would involve an estimated 90 day delay.
Mr. Murdoch further reported that in addition to the time
delay and additional cost involved, a further cost would be anticipated by
an increase in the price of steel in June and again in the third quarter.
In conclusion Mr. Murdoch advised that with the settlement worked
out with the various attorneys and property owners pertaining to the
original site, it would be his recommendation to proceed with the original
site.
Mr. Dexter Penman, 1807 West Katella Avenue, asked for an
expression from the City Attorney as to the likelihood of success of the
trust deed holders (Boller group),'if their claim is litigated.
Mro Geisler replied that he had not read ail of the pleadings
in the case, and therefor could not express an opinion. He further advised
that he had been informed by the property owners that the sale price of
the property is at a lower figure because of the litigation.
After further questioning by Mr. Penman concerning the, Boiler
and Associates claim, Mr. Geisler stated he did not feel he need to
explain his analysis of the Boller and Associates case. Further, he
advised that the question before the City Council at this time was
whether or not they were willing to pay an average of $82,185 p~r acre
with the contingency, because of the status of the seven and one half
acres, that the price would be an effective price of $88,840 per acre!
as to how the total amount of money would be divided was not the issue
before the City Council.
Mr. Geisler reported that if the City Council approved the
Settlement Agreement and Supplemental Settlement Agreement, it would be
subject to court approval, and until a court decision, negotiations for
alternate sites should not be abandoned.
Mr. 3oseph C. Whitman, 1850 Benedict Canyon Drive, Beverly Hills,
addressed the Council commending the City Attorney on the handling of the
problem concerning the original convention center site.
Mr. Douglas Farley, of the Visitor and Convention Bureau,
advised of his deep concern in this matter, since several firms have
already committed their future business to this area, and because of the
size of these meetings, it very nearly precludes them from obtaining
other locations for 1967.
The Mayor Pro Tem asked if anyone else wished to offer any
comments on the matter. There was no response.
