moved that temporary sidewalk waiver be granted, providing that no

area reserved for future sidewalks;.further, that temporary waiver of
sewer connections be granted, subject to the condition that should any
plumbing connection be installed on subject site, the entire sewer fee
for the site .will be paid to the City. Councilman Kre~ seconded the

CONDITIONAL USE PERMIT NO. 109~ Communication dated January 25, 1965, from
3ohn B. Thorpe, of Taco Villa; Inc., was submitted requesting elimination
of Condition No. 6~ City Planning Commission Resolution No. 224~.Series
1960-61, granting subject Conditional Use Permit for a drive-in~ ~estaurant,
and further requesting return of bond posted to guarantee installation of
block wall on the southerly boundary of subject property, as required by
said condition; property located on the west side of Brookhurst Street,
approximately 340 feet south of Orange Avenue.
It was noted by the City Council that subject and adjacent
properties have been reclassified to O-1 zone under Reclassification
64-65-48, Ordinance No. 2091.

218 West Lincoln Avenue, was reviewed by the City Council together with
reports from the Building and Planning Departments.
On motion by Councilman Krein, seconded by Councilman Pebley,
said sign permit was granted, as requested. MOTION CARRIED°
ABANDONHD VBHICL~S - WINSTON ROAD: Communication d~ted January 2~, 1965,
from Donald 5o and Ruth A. Hohenhaus, 113-C West Winston Road, protesting
vehicles apparently abandoned on West Winston Road, was submitted together
with photographs' illustrating damaged and unsightly automobiles parked on
vacant property and in a private driveway. Also submitted were reports
from the Police and Planning Departments, and the Sanitation Division
of the Public Works Department.
The City Attorney advised that basically, abandoned vehicles
are governed by the State of California Motor Vehicles. Code, and there is
no authority for the City to remove vehicles stored on private property,
unless requested to do so by the property owner. That under the circumstances,
it would appear to.be a matter of a civil nature between property owners.
Mayor Chandler asked if Mr. or Mrs. Hohenhaus was present and
wished to address the City Council. There was no response.
At the conclusion of Council discussion, the foregoing matter
was referred to the City Attorney for further investigation; the final
results thereOf to be reported to Mrs. Hohenhaus.

Later, during the meeting, Mrs. Ruth A. Hohenhaus requested
permission to address the Council, and apologized for her late arrival.
She advised that she also represented others in the neighborhood, however,
they are the owners of the five apartment rental units and the office
building on the northwest corner of Anaheim Boulevard and Winston Road.
She stated their objections to several unsightly automobiles apparently
abandoned on vacant property located on the south side of Winston Road,
and to another which is parked on private property at 139 West Winston
Road. She reported that they contacted the owners of said private property
requesting that the tenants be requested to remove this automobile, but
nothing has been done to correct the situation.
Mrs. Hohenhaus further advised that the presence of-these ~
abandoned and damaged vehicles has resulted in others being accumulated on
the vacant property, brought there from the nearby Santa Aha Freeway. She
requested that steps be taken to eliminate this detrimental situation.
Mayor Chandler re-stated the City's position in this matter as
earlier reported by the City Attorney.
Mrs. Hohenhaus then asked if a limited parking zone could be
established along Winston Road.
She was advised that a recommendation from the Traffic Engineer
would be necessary before consideration to limitin~ parking could be given.
No further action was taken by the City Council.
RECLASSIFICATION NO, 62-65-64, CONDITIONAL USE PERMIT NO, $57 AND TENTATIVE
TRACT NO, 4250 - EXTENSION OF TIME: Request of Howard F. Frye, Empire Financial
Corporation, dated January 25, 1965, for one year extension of time to
Reclassification Noo 62-63-64, Conditional Use Permit No. 357 and Tentative
Tract No. 4230, was submitted together with reports from the Planning
Department and City Engineer.
One year extension of time was granted by the City Council, on
motion by Councilman Krein, seconded by Councilman Dutton. MOTION CARRIED.
CONDITIONAL USE PERMIT NO, 200: City Council consideration of petition dated
January 6, 1965, signed by approximately sixteen residents of the 1300 and
1400 block on West Ball Road, requesting removal of debris and certain struc-
tures~ and th~ planting of parkway trees along the Ball Road frontage, was
continued from the meeting of January 26, 1965; Lutheran Home property ·
located at 891 South Walnut Street.
Because of a possible conflict of interest, Councilman Schutte
withdrew from the discussion and action on this issue~ and left his chair at
the Council Table°
Memorandum report dated January 14, 1965, from the Planning
Department-Development Review, was read by Mayor Chandler, noting that
an addition to the facility was recently constructed in accordance with
conditions of Conditional Use Pemnit No. 200. The City Council reviewed
plot plan sketch of the property reflecting the structures in question,
together with Exhibit NOo 1, as approved under subject conditional use
permit.
Mr. Gilbert Io Huffman, 1312 West Ball Road, advised that during
the construction period, residents of the area were assured that two of the
small buildings would be removed after the addition was completed, and that
the parkway on Ball Road would be planted with palm trees. He reported that
much of the debris has been removed.
Mr. Huffman was invited to the Council Table to review the sketch
and indicate the structures to which be'referred.
In conclusion, Mr. Huffman further advised that because of un-
sightly conditions existing on the property, a proposed purchase of his
home was not consummated, and he requested that the structures be removed
or relocated on the property.

The Mayor inquired as to what the Lutheran Home plans for the
structures in question.
Mr. A. 3. Schutte, on behalf of the Lutheran Home, advised
that two of the buildings referred to are garages, with a tool shed
attached to one, and these structures have met all requirements of the
State Welfare Department, State Fire Marshall and the Anaheim Building
Department. Because additional facilities are planned for the westerly
portion of the property, these buildings cannot be relocated.
Concerning the Ball Road frontage, Mr. Schutte advised that
landscaping on the narrow parkway would be accomplished when location of
ingress and egress to the property has been determined.
Mr. Huffman advised that the existing conditions have reduced
the property value in the area, and that he was unable to obtain an FHA
Appraisal of his home. He noted the dust emanating from subject property,
and requested that the City of Anaheim plant trees in the Ball Road
parkway.
Mr. $chutte advised that the Lutheran Home Board of Directors
have authorized him to purchase homes on the south side of Ball Road,
as it was not their intent to cause a financial loss to anyone.
At the conclusion of the discussion, Councilman Dut!on moved
that Council consideration of this matter be continued to Ma~ch 9, 1965,
1:30 P.M., pending visual inspection of the property. Councilman Krein
seconded the motion. MOTION CARRIED.

seconded by Councilman Dutton, award of contract for Work Order No. 6004,

invalidity and unreasonableness of certain requirements of dedication and
reservation for street purposes as conditions of approval of a subdivision

purportedly resulting from Anaheim Police Unit No. 2658 striking her
parked vehicle on November 20, 1964, was denied and referred to the City
Attorney and City Insurance Carrier, on motion by Councilman Schutte,
seconded by Councilman Dutton. MOTION CARRIED.
CLAIM AGAINST THE CITY: Claim filed by Odie Willard Coffey for personal
injuries and property damage purportedly resulting from forcible entry
by the Anaheim Police Department, premises located at 944 Pepper Street,
on or about October 31, 1964, was denied and referred to the City Attorney
and City Insurance Carrier, on motion by Councilman Schutte, seconded by
Councilman Dutton. MOTION CARRIED.
BUSINESS LICENSE FEE - MARTIN LUTHER HOSPITAL: Request of C. J. Georgette,
Assistant Administrator of Martin Luther Hospital, for exemption of
business license fee for the hospital, was submitted together with copy
of the United States Treasury Department Communication declaring the
hospital exempt from Federal Income Tax, as a charitable organization.

After hearing read in full the title of Ordinance No. 2116 and
having knowledge of the contents therein, Councilman Krein moved the

REQUEST - R & M TRANSPORTATION COMPANY: Communication dated February 8, 1965,
from R & M Transportation Co., requesting temporary permit to park
commercial vehicles for four to six weeks, on property zoned C-3 and
located at 3081 West Lincoln Avenue (Owner - Henry Plou),-was submitted
February 9, 1965, and continued to this date a% the r~quest of Mrs, Pfeilo
Mayor Chandler asked if anyone wished to address the City Council
in opposition to the request.
Mrs. A. D. Prell, 3064 West Lincoln Avenue, advised that she
resides directly across the street from subject property, and engines of
large trucks currently parking there are started up as early as 4:00 A.M.,
and left running for an hour or more. She inquired as to provisions of
the Anaheim Municipal Code concerning storage and maintenance of such
vehicles°
Mayor Chandler advised ~hat a permanent 6s~' Of this nature would
require an M-1 zone.
Council discussion was'~eld, and at the'conclusion thereof,
Councilman Krein moved that said temporary permit be denied. Councilman

PARKING - LA PALMA PARK, ANAHEIM-FULLERTON MUNICIPAL COURT: Administrative
AtdeJohn Roche reported on negotiations with the County of Orange regarding
easement for parking and recreational area on the Anaheim-Fullerton
Municipal Court property, north of Anaheim Boulevard. He called attention
to plot plan posted on the east wall of the Council Chamber, advising
that through an exchange of property with the County of Orange, the
northerly portion of Homer and Swan Streets and Parry Avenue could be
abandoned, and 465 paved parking spaces provided, with an additional
300 parking spaces on a turfed area, which would be used for softball

diamonds, etc., under the auspices of the City's Park and Recreation Depart-
ment. Further, a decorative entrance-to the Municipal Court facility would
be provided on Homer Street.
Mr. John Collier, Parks and Recreation Director, advised that
costs of developing the area would be reduced if a posit'On, was tuff,ed
as suggested, and he was of the opinion that the two additional softball
diamonds would be well used.
Council discussion was held, and Mr. Roche further advised that
the County of Orange has indicated th6tr approval of the proposed plan.
It was his recommendation that the City Council adopt the plan of development
for the Municipal Court area, and enter into an agreement with the County
of Orange, setting forth certain terms for the exchange of property and
the responsibility for maintenance costs of the parking easement.
.Further discussion was held, and concern was expressed that,
once designated as a park and recreation site, it would be difficult to
effect any change to the use of the turfed area.
It was the consensus of Council opinion that future plans of the
County of Orange for the proposed acquisition of property on the north side
of Romneya Drive should be considered, before action by the City is takbn
on the plan in question. No further action was taken by the City Council.
RESOLUTION NO, 65R-104 - LA PAIA~A-RIO VISTA ANNEXATION: Excerpt from the
Minutes of the City Planning Commission Meeting held February 15, 1965,
recommending that the La Palma-Rio Vista Annexation be considered favorably
by the City Council, was submitted and reviewed.

report and recommendation of the City Attorney, Councilman Kretn moved that
the effective date of amendment to agreement between the City of Anaheim
and the Board of Administration of the State Employees Retirement System
be changed from January 29, 1965 to January 22, 1965. Councilman Pebley
seconded the motion. MOTION CARRIED.

PUBLIC HEARING - RECLASSIFICATION NO, 64-65-80 AND CONDITIONAL'bSE PERMIT
NO, 667: Initiated by the Anaheim Planning Commission proposing a change of
zone from R-A to C-i, and permission to operate an existing restaurant
with on-sale beer and wine; property located on the south side of Ball
Road, approximately 344 feet east of Brookhurst Street (2162-2170 West
Ball Road).
The City Plannin9 Commission pursuant to Resolution No. 1496,
'Series 1964-65, recommended approval of said reclassification,
unconditionally; and pursuant to Resolution No. 1497, Series 1964-65,
granted said conditional use permit, unconditionally.
