Ward, requesting permission to use existing residence for plubmin9 shop and residence at 1819 West La Palma Avenue° The City Planning Commission, pursuant to their Resolution No. 142, Series 1957-58, granted said Variance, subject to the followin9 conditions: 1o The deeding of 57 feet from the centerline of Wo La Palma Avenue for street widening. 2. Engineering requirements, including the obtaining of an encroachment permit for the front steps of the dwelling to be in the parkway. Review of action taken by the City Planning Commission was ordered by the City Council and public hearing held. The Mayor asked if anyone wished to address the Council. There was no response. Mayor Pearson stated that although he had the greatest sympathy for any- one operating their own business who wants to live in the building where it can be used as both his residence and shop, he felt such a use would be detrimental to other properties in the area° Councilman Coons stated that others along this street were required to set back 65 feet and to allow this would result in the building projecting into the parking area~ Administrative Officer, Keith 4. Murdoch, advised that the location in question was West of the swimming pool and if the street dedication was reduced to 53 feet the steps of the residence would still be in the parkway. Mr. Ward advised that he intended to build a 30 foot by 50 foot building to house all the plumbing supplies and that there would be no change to the residence; that his office would be in an existing small building at the rear of the house. Other facts were considered, such as the legal liability of the City by 2463 City Hall~ Anaheim~ California~ January 14~ 1958 - 7:00 P~M. allowing the steps of the house to extend into a public right-of-way, a time limit on the Variance, and also the width of the sidewalk at this location, should the Variance be granted° Councilman Schutte moved that the hearinq be continued for two weeks (January 28, 1958) and that the people in the area and those on the north side of La Palma, from Euclid Avenue to the 3ohn Marshall School, be notified of the continuance for the purpose of considering the Variance and determining the setback in this area. Kimes, requesting permission to construct a 40 unit motel, manager's quarters and swimming pool on property located on the north side of Katella Avenue, approximately 345 feet west of Harbor Boulevard. The Mayor declared the foregoing Resolution duly passed and adopted BUSINESS LICENSE: Three representatives o£ Southern Cali£ornia Association o£ Cabinet Manufacturers, 9126 South Western Avenue, Los Angeles 47, California, addressed the Council regarding the fees required for business licenses for contractors and subcontractors, and advised that in their opinion, the $100.00 per year minimum license fee for those who did not have an established place of business was grossly injust. They felt that it should be on a lower minimum rate and on a sliding scale based on volume. When asked for their suggestion regarding this licensing, they in- formed the Council that they would like to see the fee be established on the same basis as the sales tax or a gross receipt b~sis. VARIANCE NO. 897: Communication of protest received from Ruth R. Eason, regarding multiple dwellings in the vicinity of Acacia Homes was withheld pending action of the City Planning Commission on this application. VARIANCE NO. 823 (AS AMENDED): Submitted by Louis Hennig, requesting permission to construct an automobile service center on property described as that triangular parcel of land located on the south side of Vermont Street, east of Manchester Avenue. The City Planning Commission, pursuant to their Resolution No. 146, Series 1957-58, granted said Variance subject to the following conditions: 1. Oelkers, Director of Public Utilities, purchase of Edison Company facilities located on Lincoln Avenue between Euclid Avenue and Crescent Way (28 consumers) at the total cost of $6,546.80 was authorized on motion by Councilman Wisser, seconded by Councilman Schutte. Dierberger for extension of time, as established pursuant to Resolution No. 4163, Condition Number 1, was submitted and read. Councilman Coons moved that 90 days extension of time be granted. AMBULANCE, CRAN~ - JUDKINS: Mr. Judkins addressed the Council and advised he was established in business from June 1, 1957 to January 2, 1958 and expressed appreciation to the City Council for the granting to him of the business license and also allowing him one-half of the police calls. He felt he had, in all probability, a better chance of making a go of this business than the average person because of being established and well known in the community. He stated he had given good service to the community and clean competition to the Crane Ambulance and made every effort to make a success of the business, but now knows that this area cannot support two services. Knowing this fact, he felt that some type of protection should be given to Dick Crane and that permit for the same operation should not be given to someone else. He further advised that since his close of business he has returned to the Crane Ambulance as General Manager and assured the City of the same high-type caliber services they have received in the past. When asked what type of protection he could suggest, Mr. 3udkins answered that the granting of a franchise would afford the needed protection. Mr. Crane addressed the Council and advised that a franchise would protect not only the operator but the City and place the City in direct control of the services by either demanding improvement of service or equipment. CITY PARK CONCESSION: The Administrative Officer reported the result of an analysis made and taking into consideration that the concession is more of a service than a profit making venture, recommended it continue to be a City operationo PROPOSED CON~V~RC~AL ZONING: Discussion was held regarding the C-4 restricted zoning as proposed in Ordinance soon to be considered by the City Council, which will apply to the East Center Street area° POLICY OF THE COUNCIL - SERVICE STATIONS: Councilman Coons moved that policy of the Council be that service station plans not be subject to architectural control. Councilman $chutte seconded the motion° MOTION CARRIED. FIRE HYDRANTS - MOTELS: Recommendations of Fire Chief, Edo J. Stringer, was reported upon by Mro Murdoch. As each case has an individual characteristic which would make it difficult to set down a fixed pattern that would be fair to all concerned, in his opinion it would be better to fight a fire from the hydrants on the street. CITY SEAL: Discussion was held regarding which seal should be used in the re- modeling of the Council Chambers, that appearing on the letterhead or the official seal of the City. It was also considered that the official seal of the City should read "founded 1857" instead of "reorganized June, 1888". This was ordered to again come before the Council at a later meeting.
