A map showing the existing set backs of residences and businesses presently established on Bali Road was placed on the bulletin board and explained by Mr. I~ungailo Mr. Albert S. Hecht, Jrt, representing Ball Investment Company, addressed the Council and presented an artist~s rendering and a plot plan of the proposed commercial development to be at 'the southeast corner of Ball Road and Brookhurst Street° He advised that they plan to set back approximately 22 feet from the curb line of Ball Road and that their plans had to be revised due to the fact that there is a 20 foot by 20 foot well site located in a position which necessitated reducing the size of one of their buildings; that the well is presently abandoned and not used~ however~ it is in joint ownership and prior negotiations regarding the quit claiming of the other interests were unsuccessful. In his opinion~ the establishment of this commercial development would materially increase the value of the Miller property and he requested that the Council allow them to proceed with their present plans, setting back not more than 22 feet from the curb or approximately 10 feet from the sidewalk. Mr..John Zitny, representing signers of the petition and owners of property on the south side of Ball Road, addressed the Council and advised that their interest was in the establishment of the uniform set back; that the two new established buildings set back 60 feet and 70 feet from the existing curb l~ne of Ball Road, and to allow a range from 10 foot set back to 70 foot set back would injure their property. ~678 Ciry Hall, Anaheim, California, May 13, !9~8 - 7:00 P.M Mr~ Munga!i reported the average set back on Ball Road was 38.2 feet. Hiltscher, requesting C-.i and R-3 zoning on property located on ~he north side of Piacentia Avenue, north of La Palina Avenue. Hearf. ng on the above reclassification was continued from the meeting of ~ay l, 1958 to allow for inspection of the area in question. The City Planning Commission, pursuant to their Resolution No. 230, Series 1957~:$8, recommended said Reclassification be approved as amended to R-3 i~ultipie~-.Fam~iy Residential, and C=.i, Neighborhood Commercial, in accordance with the land use study which was made a part of the application, and further subject tO: i~ The filing of the Standard Deed Restrictions of the City of Anaheim for C-:i, Neighborhood Commercial and R-3, Multiple Family Residential. 2o The deeding to the City of Anaheim of 53 feet from the centerline of Placent~a Avenue to the City of Anaheim for future street widening. 3. Warren Schutz, Attorney representing the Applicant, addressed the Council and reviewed the past history regarding this requested rezoning! that at ~he suggestion of the City Council an ~ngineer had been imployed to make a land study, which study has the approval of the City Planning Commission. In referring to the zoning in the immediate vicinity, ~r. Schutz further advised that they were willing to limit the R-3 un, ts to single story or have a limitation established regarding windows or line of vision for those units to be constructed along the east property line adjacent to the single family residential tract. Mro McDan~el, Engineer, addressed the Council, calling attention to the overall character of Placentia Avenue, being a State Highway, and pointed out that ail of the recent development in this general vicinity has been of a commercial nature~ that this area is not intended to be a major shopping center~ but separate parcels where individual businesses can locate. That the owner would l~ke to develop this property for sale and if this petition is approved, he Js prepared to f~.le proper deed restrictions, setting up an architectural committee and also is prepared to furnish the City the necessary area for street w[dening, however, they do request to hold up on the actual improvement unt[;, such time as the owner has actually sold one parcel of property along Placpnt~a Aveoue and was prepared to actually construct something in this area. ~qr. Schutz requested that the City Council again refer this application back to the C~ty Planning Commission for consideration of the ~r .... re area to be R-.~3 w~th the exception of the C-3 at the corner and as out- aed om the map~, c~osed. There being no further discussion, the Mayor declared the hearing On the recommendation of the Administrative Officer, the Application was referred back to the City Planning Commission for reconsideration in light of the Applicant's request that the corner of Pla.centia Avenue and Cypress Street be zoned C~3 and the balance of the property be zoned R-3, in substance to the pict map as presented, on motion by Councilman Coons, seconded by Counc~iman Schutte. MOTION CARRIEF. TRACT NO. 3288 .~ i782: Wt. Harry Coolidge addressed the Council regarding Tracts No. 3288 and 1782, and requested information as to the status of Tract No. 3288° He advised that those in the area were interested in protecting their property values and objected to any two story structures adjacent to their high value single fam]ly residences. Memorandum from the City Planning Department was submitted and read by R. ~. Wungall~ Secretary of the Anaheim City Planning Commission. It appears that the zoning of the area within Tract No. 3288 is presently R-1 as result of approval and recordation of final tract map. Variance No. 795 was granted for C~i and C-3 on the Placentia Avenue frontage of this property cc the strength that the property was presently zoned C-1. Pursuant to Reclassification No. F-56~57-1, further investigation revealed that said mmclassification had never been completed. Tract No. 1782 is presently zoned P~i~ pursuant to Ordinance No. 1210 (F-55-56-27) which zone allows R~3 use,~ This matter was referred to the City Attorney with power to act, motion by Councilman Fry, seconded by Councilman Schutte. MOTION CARRIHD. VARIANC5 NO. 951: Subnitted byA. Dean and Ruth Narath, requesting permission to move a one family residential dwelling to the rear of property located at ~1712 Haster Street. The City Planning Commission, pursuant to their Resolution No. 237, Series 1957-58, granted said Variance. Action by the City Council was deferred at the meeting of May 1, 1958 for further investigation regarding the width of Haster Street. ::!,680 City Hall, Anaheim, California~ May 13~ 1958 - 7:00 P.M. The Administrative Officer reported that he had checked the property and had the Engineering Department make a survey showing the distances from the center I!ne of the street of each of the structures in the area. North of the property considered is residential and north of this is a residential subdivision. That the requirement of dedication for street widening would be detrimental to the ~x~sting use of the property, which uae is not proposed to be changed by the grantin? of this application, and thereupon, recommended that the Variance be granted without the street widening requirement at this time. Mr. Narath addressed the Council and agreed to the future dedication of 10 feet on Naster Street when determined necessary and requested by the City of Anaheim~ it was moved by Councilman Fry~ seconded by Councilman Coons that Variance No., 951 be granted, subject to an agreement to dedicate 10 feet upon request for the widening of Haster Street. The City Planning Commission approved Tentative Map of Tract No. 2026, subject to the following conditions: 1~ That should this subdivision be developed as more than one subdivision, each successive subdivision thereof shall be submitted in tentative form for approval. 2. Engineering requirements. Mro A. R. McDaniel, Engineer for the tract, addressed the Council and explained changes shown upon the map in red pencil indicating their plans w~th reference to street pattern. Mr. ~urdoch, Administrative Officer, recommended acceptance of the tentative map with the stipulation that any extension out to the west would be ~nto an area that could logically be extended out to Loara Street, the exact location of that street would depend on what the possibility o~ getting out to Loara Street would be. Councilman Coons moved that Tentative Map of Tract No. 2026, as outlined by the City Administrative Officer and as shown in red on the corrected copy of the map be approved. Councilman Fry seconded the motion. MOTION CARRIED. RECLASSIFICATION NO. F-57.-58-48: Submitted by Norbert W. Jansen, requesting ~3 zoning on property located, briefly, on the south side of Ball Road~ between Palm and Lemon Streets. Public hearinq was ordered to be held .June 3, 1958, 7:00 P.M. on motion by Councilman Fry, seconded by Councilman Coons. MOTION CARRIED. 2684 Citf Hall~ Anaheim: California; May 13~ 1958 - 7;00 _VARIANCE NO. 958: Submitted by Ko E. Stevens, Palm Motor Lodge, i101 North Palm Street, requesting permission to suspend an overhead motel sign, eight feet over City property. The City Planning Commission, pursuant to Resolution No. 247, Series L957-58, granted said Variance for an overhead sign to be suspended eight feet over City property, subject to the Applicant furnishing to the City Building Department engi. neer~ng data on the s~gn. ~,,Ir. Stevens addressed the Council and advised he had been originally required to set back farther 'than other property in this area and if granted the Variance~ would agree to move the sign, if and when the street is widened. Discussion was held w~th reference to other properties in this area and the already constructed signs, and it was the opinion of the City Council that this property should have the same prfvilege as others in the area~ and thereupon~ the Coupcil took no further action. Mr. Holyoke~ City Engineer~ requested clarification as to the conditions of zoning of South East Street, wfth reference to the P-L zone and the entry way off East Street. %!r. !,~urdoch reported that the Ordinance adopted by the City Council changed zoning on the front [50 feet from R-,3 to M~i and P-L, the depth of the P.-L zoning to be on the front 60 feet running West from East Street, 25 feet of the 60 feet was required by the Ordinance to be landscaped, then a driveway 12 feet in widzh must be put in parallel Zo East Street. Parking can be adjacent to th~s driveway. Back of the P-:,L zone an industrial building can be built that would be 60 feet from the property line of East Street. The Ordinance specifies that there will be only one operdng from East Street to this property, between ?~ater and South ~treets. Follo~ng this action and after Mr. Johnson purchased a portion of the property, Mr,~ Johnson took the City to Court to see 5f he could get a driveway opening from East Street. It was Mr. Murdoch's understandfng that said openfng was granted by the Courts. City Attorney, Preston Turner, advised that it was his understanding that the reason it was granted by the Court was because there had been one entrance agreed by the City Counc~.l ;[n the action of zoning. The 16 foot drive- way was not required to be d ~ ed.~cated~ it was a private driveway which the property owners were required to establ[sh and maintain, the property at that time being ~il under one ownership. The Court held since this entrance was not specified ~n any particular location other than approximately in the center, there was no reason why it could not be established in front of the Johnson property. ~r. 3ohnson did not have an easement over this driveway and was unable to get to his property from any other point. PETITION: Petition was received at open meeting regarding the unkept property belonging to the City of Anaheim located on the east side of Raleigh Street, a parcel approximately 277 feet by 20 feet. Upon investigation it was learned that said property was in private ownership, that of the H~f!er Construction Company, and the matter was referred to the Administrative Officer. ~ Mr. Howard Ewing, 819 North Paulina Street, addressed the Council requestin9 a '~Not a Through Street" sign to be placed on La Palma Avenue for the information of those traveling the Freeway and who do not know that La Palma Avenue dead ends at the railroad tracks. MOTION CARRIED. ~JILER INSURANCE: The Administrative Officer recommended extension of the ~oiier Insurance Policy to include an additional 25 pieces of equipment owned by the fity~ three year policy, $825.00 premium, and further recommended the replacement of two boilers that do not meet inspection. It was moved by Councilman Borden, seconded by Councilman Coons that the two pieces of equipment be replaced and that the insurance be extended to cover additional equipment as recommended by the Administrative 'Officer, and further~ that necessary funds be transferred from the Contingency Fund to meet th~s expenditure. PUBLIC HEARING - VARIANCE NO. 948: Reporters Virginia Talmage and Miss Dalton were sworn in by the City Attorney and requested to take down in shorthand the proceedings of the public hearing, and Mrs. Talmage was requested to transcribe the same into long hand, to the best of her ability, said transcript to be made a part of this record. Variance No. 948, submitted by Anaheim Congregation of Jehovahs Witnesses, Inc., requesting permission to erect a church on a parcel of land less than one acre in area, located at 1751 Orange Avenue (the north side of Orange Avenue, between Farm Street and Culbertson Drive). The City Planning Commission, pursuant to their Resolution No. 234, Series 1957-58, denied Variance No. 948 to erect a church on less than one acre, for the reason that the subject property is under one acre in size, Appeal from action taken by the City Planning Commission was submitted by the presiding Minister and public hearing ordered. Written notices of said public hearing were mailed May 8, 1958, and Notice of Public Hearing was published in the Anaheim Bulletin, May 9, 1Q58. The Mayor asked if anyone wished to address the Council. City Attorney, Preston Turner, advised the City Council that this was an appeal from the decision of the City Planning Commission, and advised on what basis the matter should be determined and the requirement of law with reference to giving persons both for and against the issue a reasonable time to be heard. Mr. Elmer R. Guy, Attorney representing Jehovahs Witnesses, addressed the Council and made a motion that the Council have an order revoking their pre- vious action taken in cancelling or voiding the Building Permit granted, upon the grounds that the record will show that this lot is eight tenths of one square foot short of one acre as determined by Stephen W. Bradford, Licensed Land Surveyor, which, in his opinion, was a substantial compliance of the code
