CITY ATTORNEY: Preston Turner, Present. CONTINUED PUBLIC H~ARING: RECLASSIFICAI$ON NO, F-57-58-4~: Submitted by Charles R. Laraway, requesting R-3 zoning on property described as Tentative Map, Tract No. 3095 (near the northeast corner of Manchester and Crescent Avenues). Ihe City Planning Commission, pursuant to their Resolution No. 256, Series 1957-58, recommended said reclassification, subject to the filing of R-3 Deed Restric- tions, which will include that on the north lots, next to R-1 Single Family Rsstden- rial units, the multiple family dwellings be kept to only one story in height. Said hearing was continued from the meeting of 3une 3, 1958. Ihe Mayor asked if anyone wished to address the Council. Mrs. Chamie addressed the Council advising that the plans of this develop- ment are presently in the engineering stage. Mr. R. W. Mungall, Secretary of the City Planning Commission, presented a plot of the territory between Euclid Avenue and the Santa Aha Freeway, showing a possible street pattern for the area~ which plans were review and agreed to by practically all of the land owners involved. Said map was placed upon the bulletin board for all to review. Mr. William B. Stewart, representing Charles R. Laraway, addressed the Council and asked if the zoning could be granted, subject to the street layout and as approved by the City Planning Commission, as they had met with the neigh- bors and agreed that lots adjoining R-1 would be single story multiples~ and if the zoning could be changed to R-3, subject to these conditions, then they would be in a position to complete engineering and building plans. The Administrative Officer reminded, that the required R-3 Deed Restric- tions would have to be filed and necessarily include limiting the structures on the north tier to lots to single story. Further discussion was held regarding locating R-3, backing up against Crescent Avenue. It was reported that Crescent Avenue will be a 90 foot secondary high- way and that this limitation would be in keeping with the City's policy of not allowing residential to front on major highways. ~ouncilman A. J. Schutte entered the meettnq, 7s25 Mr. O=Brian addressed the Council stating that they were in agreement with the conditions as imposed by the City Council, however, requested that the action of the City Council imbody the fact that they be required to build according to the drawings submitted and further, that they not be allowed to grade-up beyond the level of the property to the north. N[r. Wilson, owner of the property to the west,addressed the Council favoring the R-3 zoning, however, asked if their approval of the R-3 zoning would preclude them from objecting to the street pattern. He was advised that the street pattern, as submitted, was in a tenta- tive form only, and was a plan that would have to necessarily have additional engineering study prior to adoption. Mr. Wilson reiterated the fact that they did not object to the R-3 zoning, however, they did not want to be placed in a position of being screened off from Crescent Avenue by a wall or a fence. 2745 Ci t~~Anahe im~_Ca i i f orn~i_9_a~_ June .i0_~, 1958 ~- 7: 00 P.M. With reference to drainage, George E. Holyoke, City Engineer, advised that at the present time they did not know what might necessarily have to be done~ however, if the 2,vel was raised, and was over six inches in height, there would be required a retaining wall for the protection of the adjacent property. Mr. Don Vaughn, resident of Cottonwood Circle, addressed the Council and suggested in relation to the R-! development, that the R-3 properties be assessed more than the $25.00 per lot for the acquisition of parks and recreation sites. ~ Ih,re being no further discussion, the Mayor declared the hearing closed. :RESOLUIION NO. 4569; Councilman Coons offered Resolution No. 4569 and moved for its passage and adoption, authorizing the City Attorney to prepare necessary change of zone as requested, subject tc the recommendations of the City Planning Cc~nission and furtheI subject to the foilowing: i. That the Deed Restrictions include a provision limiting the tier of lots adjacent to the single family residential properties on the north to single story. e That the single story multiple family residential units be similar in architectural character to the two story multiple family structures as included in the plans and submitted in and made a part of the application° That a fence or wall be required on the north side of Crescent Avenue if it is deemed necessary by the City Council at the time of acceptance of the Tenta{ive Map .(Deed Restrictions). Provision be made for right~of-,way for the proposed flood control channel. Dedication ~nd improvement of Crescent Street,according to the Master Plan of Streets and Highways,be provided. F-57-58-52: Submitted by Athens Oil Corporation~ requesting C-3, C-1 and R-3 zoning on property located, briefly, on the east and west sides of Euclid Avenue~ north of Crescent Avenue. The City Planning Commission, pursuant to their Resolution No. 259, Series 1957-58, recommended that said reclassification be approved as shown on the map~ except the following: i. That the C-3 use for a service station at the northwest corner of Euclid and Crescent be eliminated. That any multiple-family residential next to R-1 single family resident- ial on the north be kept down to only one story. The filing of Standard C-1 and R.-3 Deed Restrictions of the City of Anaheim. 4. 'I'he City Council adopted Resolution of Intention No. 4555 at the meeting of June 3, 1958, approving the C-1 portion of this reclassification and continued consideration of the R=3 zonin9 to this meeting toaliow~ for a survey of the area to be made. The Mayor asked if anyone wished to address the Council. Mr. George M. Mort, representing the Developers,addressed the Council and agreed to certain limitations imposed upon the property in the 9ranting of the R-3 zoning and stated that he did not submit plans of the buildings, however, expected to be governed by an architectural committee and that the buildings would be equal or better to those proposed for the Laraway Development. That they also expect to file a subdivision map on this property. F-56-57-1: Submitted by Leighton D. 3aeger~ requesting C-1 zoning on property located~ briefly, on the east side of South Placentia Avenue, between Anaheim-Olive Road and East Santa Aha Street. Mr. Robert Foster, Attorney representing Westport Development Co., addressed the Council advising his reasons for making the following motion: He moved that Condition No. 4 of Resolution No. 3465, passed by the City Council, September ]i, 1956 and reading '~That the south side of the property be reserved for parking and the north side be allowable for the erection of buildings", be deleted. That relief was being asked of this one condition so that they can go ahead and comply with the other conditions as set forth in said resolution. Mr. Coolidge, representing the Owners in the tract to the south of this property and advised that in the original resolution granting the C-i zoning, protection was provided to the residents at the south by the establishment of a parking area, and stated further they had no objections to the R-3 use, that their only objection has been to the two story structures, and if the parking requirement is removed, requested restrictions be imposed limiting construction on the south of this property to one story buildings. He further advised that they did not want commercial establishments this close to their homes and pr, feted the R-3 with the requested limitations. RESOLUTION NO. 4571~ At the conclusion of the discussion between the City Council and those interested, Councilman Coons offered Resolution No. 4571 and moved for its passage and adoption, amending Resolution No. 3465 to read~ '~That the zoning be changed from R-A to C-1 on lots 1 and 15, and that the balance cf the property be rezoned R-3, subject to the following conditions: 1. That a six foot masonry wall be erected on the south side of the property. 2. Lots 9 thru 14. be limited to single story in height. 3. CONTINUED PUBLIC HEARING: AMENDED VARIANCE NO. 8237 Submitted by Louis Hennig~ requesting permission to operate an automobile service plant consisting of auto painting~ upholstering~ body and fender repairing~ glass replacement and light automobile maintenance on property described as the southerly portion of that triangular parcel of property located south of Vermont Street, adjacent to Manchester Avenue on the east. The City Planning Commission, pursuant to their Resolution No. 220~ Series 1957-58, granted said variance, subject to the following conditions: 1. The erection of the buildings as shown on the plot plan. 2. The providing of landscaping in front of the buildings and next to the Santa Aha Freeway. 3. The filing of Standard Deed Restrictions of the City of Anaheim for M-1 Light Manufacturing. The erection of a 6 ft. masonry wall from the east building to the end of the parking area to the North on account of residential development to the East. 5. Limiting the hours of operation between 7:00 A.M. and 7:00 P.M. Appeal from action taken by the City Planning Commission was filed and public hearing held May 6, 1958 and continued to this date. The Mayor asked if anyone wished to address the Council. Mr. George Weber~ resident on Cottonwood Circle addressed the Council referring to the requested R-3 zoning in this vicinity and requested that the entire area be considered at one time. Mr. Donald Vaughn addressed the Council in opposition to the g~anting of the variance and requested the entire area be considered at one time and indicated he favored the proposed R-3 zoning in the area. Mr. Hennig addressed the Council advisin9 that the only objections there has been to the variance were f2om Mr. Vaughn and Mr. Weber~ that no objections have been received from the property owners on the south side of Vermont nor to the east or west. That this variance would have a buffer zone of 425 feet as a protection to the people in Cottonwood Circle. He further called attention to the manufacturing business and trailer parks already establish- ed near this location. A picture of the buildin9 proposed to be built was submitted and N~. Hennig agreed to make this picture a part of the variance and build the building accordingly and also agreed to the acceptance of the variance contingent on 2749 ci.ty. Hg~.l,. A.nahei~. The City Planning Commission, pursuant to their Resolution No. 223~ Sec'les i957~58, granted said variance, subject to certain conditions. Review of action taken by the City Planning Commission was ordered by the City Council and public hearing was held May 6, 1958, at which time Reso!ution No. 4501 was adopted, denying said variance. Reconsideration of this matter was ordered by the City Council 20, 1958. Communication dated June 9, 1958 from Mr. John M. Kent, Attorney representing Mr. and ~Lrs. Mr. Wetzler addressed the Council urging the granting of the reclassifica- tion and requested waiver of the non-residential clause in the the required deed restrictions for approximately five (5) years to allow a photographer to live on the property on which there is a house approximately twelve (12) years old. Mr. Seward addressed the Council and stated that he was the owner of the property on which a trade was anticipated and that there would be no trading of his property with the Wetzler property. A Gentleman addressed the Council advising that if this photographer was allcwed to reside on this property and operate his business from this location, Anaheim would receive the sales tax from its operation. There being no further discussion, the Mayor declared the hearing closed. RESOLUTION NQ. 4573: Councilman Fry offered Resolution No. 4573, authorizing the preparation of necessary ordinance changing the zone as requested, subject to the recommendations of the City Planning Commission and further subject to a 90 day · time limit for the conditions as set forth, to be met. Ihe Mayor declared the foregoing Resolution duly passed and adopted. REOLASSIFICAIION NO. F-54-55-26: (Ordinance No. 1027) Request of Albert F. Hecht, Jr., for the Ball Investment Company, for clarification of Reclassification No. F- 54-55-26, with reference to established setback line on the south side of Ball Road, from Brookhurst Street to Empire Street, was submitted and read. Mr. Hecht requested that the setback line run from the west line of Lot 2, rather than from the corner of Brookhurst and Ball Road. Although the property on Lot No. 1 of Tract No. 162 'Home Croft Tract" had been zoned C-l, with the exception of the corner, 150 feet by 150 feet~ which was zoned C-2, pursuant to Ordinance No. 1027 and no commercial development commenced, it was the conculsion of the City Council that the setback as established by them at the meeting of May 20, 1958 (Page 2697), be required. That is, from Brookhurst Avenue to Empire Street. FINAL MAP: TRACT NO. 1353: Subdivider, Huntington Development Company. Tract located between Sunkist Street and Placentia Avenue, south of and adjoining the Riverside Freeway, and contains 102 lots. George E. Holyoke, City Engineer reported that the Final Map of Tract No. 1353 was substantially the same as the Tentative Map previously approved. That the bonds have been presented and the fees paid and recommended the approval of sam map. Final. Map of Tract No. 1353 was approved by the City Council on motion by Councilman Schutte, seconded by Councilman Coons. MOTION CARRIED. City Hal__l, Anaheim,..Qalifornia, June ~0~ 1958 - 7:00 P.M. 2751 FINAL MAP: IRACT NO. 3199: Subdivider, George Holstein. Tract located west of Euclid Avenue, south of Ball Road, and contains 25 lots. George E. Holyoke, City Engineer,reported that the Final Map of Tract No. 3199 was substantially the same as the Tentative Map previously approved. That bonds have been presented and fees paid, and recommended the approval of said map. Final Map of Tract No. 3199 was approved by the City Council on motion by Councilman Coons, seconded by Councilman Schutte. MOTION CARRIED. FINAL MAP: TRACT NO. 2972: Subdivider, Raymond Barnes. Tract located north of Romneya Drive, east of West Street and contains 6 lots. George E. Holyoke, City Engineer,reported that the Final Map of Tract No. 2972 was substantially the same as the Tentative Map previously approved. That the bonds have been filed and all necessary fees paid, and access to the street is provided by deed to Mr. Barnes, from Lesser Enterprises, and recommended approval of said map. Final Map of Iract No. 2972 was approved by the City Council on motion by Councilman Fry, seconded by Councilman Borden. MOTION CARRIED. VARIANCE NO. 972: Submitted by Anthony Brothers, Incorporated, requesting permission to construct and operate a swimming pool sales display and sign on property described, briefly, as located on the east side of Harbor Boulevard, north of Orangewood Avenue. The City Plannin9 Commission, pursuant to their Resolution No. 271, Series 1957-58, granted said variance, subject to the following conditions: 1. The dedication of 60 feet from the centerline of Harbor Boulevard to the City of Anaheim for street widening. 2. The erection of the building and display pools in accordance with the renderin9 and plot plan presented. 3. Improvements on Harbor Boulevard as required by the City Engineer. Representative of the Applicant agreed to the compliance of said conditions as contained in Resolution No. 271 of the City Planning Commission, within a six month period. No further action was taken by the City Council. .VARIANCE NO, 97~: Submitted by E. E. Singman, requesting permission to erect a neon sign advertising pharmacy. Sign to be installed above the roof of building located at 601 South Palm Street. The City Planning Commission, pursuant to their Resolution No. 272~ Series 1957-58, granted said variance, subject to shutting the sign off when the pharmacy is closed. No further action was taken by the City Council. VARIANCE NO. 974: Submitted by Jerry Yocky, requesting permission to waive Cfty Code requirements pertaining to lot widths from 70 foot f~ontages to 60 foot frontages on property described as Tentative Tract No. 2721 (south side of Crescent Avenue, between Magnolia and Gilbert Avenues). The City Plannin9 Commission, pursuant to their Resolution No. 273, Series 1957-58, granted said variance. No further action was taken by the City Council. 2752 City Hall~ Anaheim, California, June 10, 1958 - 7:00 P. M. TEN/ATIVE MAP: TRAC'r NO. 2721: Subdivider, Jerry Yocky. Tract located 546 feet e@st of Magnolia Avenue on the south side of Crescent Avenue, and contains 24 R-1 lots. Ihe City Planning Commission recommended said Tentative Map, subject to 't/hat should this subdivision be developed as more than one subdivision, each successive subdivision thereof shall be submitted, in tentative form, for approval". Tentative Map of Tract No. 2721 was approved by the City Council on the recommendation of the Engineering Committee and City Planning Commission, with the provision that a cul de sac street be provided at the south end of this street~ on motion by Councilman Coons, seconded by Councilman Schutte. MOTION CARRIED. VARIANCE NO. 975: Submitted by Ronald E. Maahs, et al, requesting permission to operate a flower shop at 7381 Lincoln Avenue (north side of Lincoln Avenue, west of Western Avenue). The City Planning Commission, pursuant to their Resolution No. 274, Series 1957-58 granted said variance, subject to the following conditions: 1. Subject to improvements on Lincoln Avenue as required by the City Engineer. No further action was taken by the City Council. VARIANCE NO. 976: Submitted by Capitol. Outdoor Advertising Corp., requesting permission to erect a temporary directional sign advertising the sale of houses and lots within Tract No. 3147. Property located at the southeast corner of Euclid and Katella Avenues. (Tract located on the south side of Cerritos Avenue, approximately 1200 feet east of Nutwood Street). The City Planning Commission, pursuant to their Resolution No. 275, Series 1957-58, granted said variance, subject to the nine conditions established by the City Council for such signs. No further action was taken by the City Council. VARIANCE NO, 977: Submitted by Dr. William A. Bumstead, requesting permission to erect a commercial neon sign at 1715 West La Palma Avenue. (Location of his business authorized,pursuant to Variance No. 867). The City Planning Commission, pursuant to their Resolution No. 276, Series 1957-58, granted said variance, subject to the sign being turned off by i0:00 p. M. each evening. No further action was taken by the City Council. VARIANCE NO. 978: Submitted by Robert W. and Marjorie L. Mr. Dale Hughes, 615 South Clara Street, addressed the City Council an~ presented a summary of their objections to the granting of Variance No. 948, (Jehovah s Witnesses~ Inc.). Copies of said summary were submitted. Mr. Elmer Guy, Attorney, representing the Applicant s moved to strike each and ail of the objections void and stated his reasons therefor. City Attorney, Preston Turner, informed the Council regarding evidence receivable in a quasi judicial hearing such as this and thereupon, the City Council moved to deny the motion of Mr. Guy, and receive the summary statement as submitted by Mr. Hughes. Mr. Hughes was cross-examined by Mr. Guy and showed two photos for identification that Mr. Guy had not yet offered as evidence. Mr. Lyle D. Titus, Photographer, was sworn for the purpose of testifying as te the taking of pictures of other Jehovah's Witnesses Churches. Mr. Titus was allowed to leave the meeting for the purpose of securing his notes, which he made showing the location and the date the photo were made of the Churches as pictured. Hughes. During the absence of Mr. Titus, Mr. Guy continued to cross-examine Mr. Persons in the audience objecting to the granting of Variance No. 948, who had not previously signed a petition of objection, stood and gave their names for the record. Mr. Guy continued, and moved to strike all of Paragraph No. 9 of Mr. Hughes summary of objection, which motion was denied on motion by Councilman Coons, seconded by Councilman Schutte. Mr. Fred Schubert, Real Estate Broker, residing at 616 Clara Street was sworn and testified regarding the effect the establishment of a church at this location would have on the value of surrounding properties.
