tc report the proceedings in this hearing,was requested to continue to act as such

Mayor Pearson called the meeting to order.
Mr. Dale Hughes, 615 South Clara Street, addressed the City Council
and presented a summary of their objections to the granting of Variance No. 948,
(Jehovah s Witnesses~ Inc.)~ Copies of said summary were submitted.
Mr. Elmer Guy, Attorney, representing the Applicant s moved to strike
each and ali of the objections void and stated his reasons therefor.
City Attorney, Preston Iurner, informed the Council regarding evidence
receivable in a quasi judicial hearing such as this and thereupon, the City
Council moved to deny the motion of Mr. Guy, and receive the summary statement
as submitted by Mr. Hughes.
Mr. Hughes was cross-examined by Mr. Guy and showed two photos for
identification that Mr. Guy had not yet offered as evidence.
Mr. Lyle D. Titus, Photographer, was sworn for the purpose of testifying
as tc the taking of pictures of other Jehovah'c Witnesses Churches. Mr. Titus was
l~oweu to leave the meeting for the purpose of securing his notes, which he made
showing the location and the date the photo were made of the Churches as pictured.
Hughes. During the absence of Mr. Titus, Mr. Guy continued to cross-examine Mr.
Persons in the audience objecting to the granting of Variance No. 948~
who had not previously signed a petition of objection, stood and gave their names
for the record.
Mr. Guy continued, and moved to strike all of Paragraph No. 9 of Mr.
Hughes summary of objection, which motion was denied on motion by Councilman
Coons, seconded by Councilman Schutte. MOTION CARRIED.
Mr. Fred Schubert, Real Estate Broker, residing at 616 Clara Street
was sworn and testified regarding the effect the establishment of a church at
this location would have on the value of surrounding properties.

Mr. Titus returned and Mayor Pearson declared a five minute recess to
allow time for him to identify, from his notes, the pictures taken of other Jehovah's
Witnesses Churches.
After recess, the meeting was again called to order by Mayor Pearso~ all
members being present~ with the exception of Councilman Fry, who was absent from
the meeting.
Mr. Iitus returned to the Witness Stand and testified that he had taken
a series of photos of various churches and buildings in which the Jehovah's Witnesses
conducted their religious services, which photos he identified and gave the location
of each of the churches of which photos were taken and the following photo were
admitted in evidence as protestants' exhibits. Said photos were excepted by the
City Council as evidence and marked '~Opponents' Exhibit A", ~Protestants~ Exhibit
A-l, A-2 and A-3~ and the motion of Mr. Guy to strike this evidence was denied
by the City Council on motion by Councilman Borden, seconded by Councilmand Coons.
MOTION CARRIHD.
Mr. Robert Sherman, 435 South Fann was sworn and testified upon question-
ing by Mr. Hughes, among other things the reasons why he purchased his home at
this certain location.
lhe motion made by Mr. Guy to strike this testimony was denied by the
City Council on motion by Councilman Schutte~ seconded by Councilman Coons.
MOTION CARRIED.
The motion made by Mr. Guy to strike the portion of the testimony with
reference to Mr. Sherman's experience was denied by the City Council on motion by
Councilman Coons, seconded by Councilman Schutte. MOTION CARRIED.
Mr. Hughes made a concluding statement for and on behalf of the group
in opposition and requested that the City Council deny Variance No. 948.
Mr. Guy requested to call additional witnesses and explain facts he
wanted~ and also requested to introduce additional matters as evidence.
Mr. Hughes objected to the admission of these documents and after
discussion, request was denied.
In order to determine the sentiment of those present, the Council
requested that those in the audience~living in the area of the proposed church,
in opposition to the granting of the variance, to stand and then requested that
those living in the area of the proposed church in favor of the granting of the
variance to stand.
Mrs. John Campbell, 408 Farm Street was sworn and testified regarding
the interview with her made by Mr. Guy and the Reporter.
Communication dated June 10, 1958, from Mr. and Mrs. Frank Kirchenski,
in opposition to the variance, was submitted and read and Mr. and Mrs. Kirchenski
were sworn and testified that this statement was written by them and expressed
their feelings regardin9 this matter.
In relation to further testimony, Councilman Borden moved that this
hearing be closed. Councilman Schutte seconded the motion. MOTION CARRIED.
HEARING CLOSED.
Ihen, Mr. Guy made the motion that the Applicant has substantially
complied with the Ordinance requirements and that no variance was necessary~
and the City Council should set aside their former order revoking the building
permit and reinstate said permit. Proceeded to state the grounds of the motion.
Councilman Coons moved that the Council take the entire issue under
consideration, that they review all the testimony~ pictures~ maps and items
as stipulated to, that they visit the site of the property and render a decision
~uly 8: 1958. Councilman Schutte seconded the motion. MOTION CARRIED.

RURCHASE: Administrative Officer reported informal bids received for the purchase
of one (1) International Cub Tractor with C. E. C. Hydraulic Attachment and three
(3) Toro Spartan Mower Gangs with Pneumatic Tires and recorm~ended the purchase be
made from Covina Equipment Company, price $2,965.30. Said purchase was authorized
by the City Council, as recommended by the Administrative Officer,on motion by

RECLASSIFICATION NO. F-57-58-28: Submitted by Broadway Hale Stores, Inc.,
requesting R-3 zoning on property located west of Loara Street, north of the
Orange County Flood Control Channel.
Submitted for Council consideration, pursuant to Condition No. 4,
Resolution No. 4359, were revised plans of the proposed apartment projecT,
The revised plans were placed upon the bulletin board for all to
review and a group of interested people came forward to review and discuss the
revised plans.
Mr. Bud P'lone, designer and builder, and representing the Broadway
Hale Stores, Inc., explained the revised plans; that the single units would
have 455 square feet, the one bedroom units, 690 square feet, and the two bedroom
units, 816 square feet; that in the total development, 37% of the.land will be
covered by buildings.
Reference was made to the filing of the required deed restrictions
within the 60 day time limit as established by the Resolution of Intention°
It was determined that the deed restrictions were placed in the hands
of the City of Anaheim within the 60 day period and that the delay was no fault
of the Applicant, as the documents were withheld by the City Attorney for
checking whether they were executed by authorized persons. As result of the
checking, it was found that the documents were signed by authorized persons
and were in correct form when originally presented to the City.
Councilman Pearson moved to extend the time to June 15, 1958 to
