Mr. Stone reported that as. of May 25, i965, 193 establishments have been inspected, of which 112 qualified for the Health Award; 81 fa,iled to qualify and 8 declined to participate in the program. Further, 22 estahltshements h~ve been re-inspected, all of which retained the Health Award. PUBLIC HEARING - ~OUSE MOVING PERMIT~ Application filed by James W. Gilmore (Robert Stewart, Bay Housemovers) for permission to move a dwellin~ from 3630 West Westminster Boulevard, Santa Ana, to 2966 Stoneyhrook Avenue, Anaheim, was submitted together with reports from the Building Division and Zoning Division of Development Services Department. Mr. Robert Stewart, 10611 Lexington, Stanton, California, appeared on behalf of the applicant and noting that the Zoning Division reported that the property was not zoned for a single-family residence, being less than one acre in size, asked what assurance they would have of obtaining the required zoning. Mr. Mickelson reviewed the past zoning actions on subject pro- perty advising that the first development was the adjacent apartment project, and with the dedication of Stoneybrook Drive, a parcel less than one acre was created and a conditional Use permit granted to permit a service station at the corner. At this time the proposal is to utilize the easterly 85 feet of the parcel on which the service station is located for a residential lot; the subject property would be the only R-1 lot between existing commercial and an R-3 development. Further, under the circumstances, subject property could he considered for either R-3 or C-1 zoning. The Mayor Pro Tem asked if anyone else wished to address the Council, there being no response, declared the hearing closed. Further discussion was held by the City Council, at the con- clusion thereof, Councilman Dutton moved that action be withheld pending zonin9 application .and hearing thereon, and that this public hearing be continued and the City Clerk be authorized to re-advertise and re-schedule said issue to be considered concurrently with zoning application. Council- man Schutte seconded the motion. MOTION CARRIED. PUBLIC HEARING. RECLASSIFICATION NO, 6~-65-115 AND CONDITIONAL USE PERMIT N0.691~ Initiated by the Planning Commission to consider a change of zone from C-3 to C-1 and grant permission to operate an existing service station within 75 feet. of R-1 zoned property~ property briefly described as the southwest corner of Broadway and Euclid Street (existing use established under Reclassification No. 61-62-56). PUBLIC HEARING = PROPOSED ABANDONMENT: Pursuant to Resolution No. 65R-356, duly published in the Anaheim Bulletin May 20, 1965, and notices posted in accordance with law, public hearing was held on the proposed abandon- ment of a small portion of Miller Street, lying between La Palma and Mira- loma Avenues. Mr. Maddox advised that with the abandonment, Miller Street will still be a 90-foot right-of-way. Vickers for entertainment permit for the Odyssey Restaurant, 1490 South Anaheim Boulevard (Trio - organ, saxophone and drums), was submitted and granted for a period of one year, subject to the recommendations of the Chief of Police, on motion hy Councilman Dutton, seconded hy Councilman Schutte. MOTION CARRIED. SIDEWALK WAIVER: Request for waiver of sidewalk requirement at 653 South Velare Street, filed hy Albert Gudes, was submitted together with report from the City Engineer. On motion by Councilman Schutte, seconded by Councilman Dutton, said request was denied in accordance with City Engineer recommendations. MOTION CARRIED. 8680 CiSy Hall, Anaheim, California - COUNCIL MINUTES - June 1, 1965, 1:30 P.M. SIDEWALK WAIVER - BOND: Request of waiver of sidewalk requirement and cancel- lation o~ improvement bond (61-62-26) filed by Mrs. Lloyd Ro Pettengill was submitted. The City Engineer recommended that a temporary sidewalk waiver be denied except in that area between the two pilasters which support the porch roof of the house, and that a temporary asphaltic concrete sidewalk be constructed adjacent to the curb in that area, and that the bond be held until sidewalk is accomplished as recommended. On motion by Councilman Du%ton, seconded by Councilman Schutte, temporary waiver of sidewalk was granted only in that area recommended by the City Engineer, subject to the requirement noted above° MOTION CARRIED. RECLASSIFICATION NO, 62-63-131: Request of 3oe Levesque, President of South- east Mortgage Company, to amend Condition No..4 of Resolution of Intent 63R-729~ to permit construction of a service station at the southeast corner of Orangewood Avenue and Harbor Boulevard~ and also requesting Condition Noo 3 of Ordinance Noo 1949 pertaining to vehicular access rights to Orangewood Avenue be deleted~ was submitted together with reports and recommendations from the City Engineer and Planning Division of the Development Services Department. Kent Burr of Wilshire Oil Company of California for deletion of Condition No. 6, Resolution No. 65R-271, pertaining to the requirement of access drives along the westerly and southerly property lines of subject property, briefly described as located at the southwest corner of Ball Road and Beach Boulevard, was submitted together with reports from the City Engineer and Planning Divi- sion of Development Services Department. (Councilman Chandler entered the meeting, 2:12 P.M.) Mr. Mickelson reported that the 20-foot alley alon9 the westerly and southerly boundaries was a requirement to provide a secondary access for the total parcel, complying with Section 18.40.070-5 of the Anaheim Municipal Code; that development was originally planned for a service station at the corner and a shoppin9 center surrounding said station. Mr. Burr advised that they recent17 purchased the property and were prepared to comply with all requirements. However, at the present time, there were no plans for development of the balance of the property. On motion by Councilman Schutte, seconded by Councilman Chandler, removal of Condition No. 6 as requested, was disapproved, however, upon receipt of the description of the portion of property on which the service station is to be constructed, and compliance with conditions noted, that portion of Reclassification No. 64-65-95 be separately zoned to allow service station development without conformance with alley requirements until building permits are obtained for t~e balance of the property. MOTION CARRIED. RECLASSIFICATION NO, 64-65-26: Request of William J. Review of action taken by the City Planning Commission was requested by Councilman Chandler and the City Clerk authorized to schedule public hearing before the City Councllo VARIANCE NO, 1701: Submitted by Hugh Ac and Dorothy Mo EdmonsoD, re- questing waiver of certain provisions of Chapter 18o62 pertaining to signing the Howard Johnson Development, to be located in that triangular section bounded by the Santa Aha Freeway, Harbor Boulevard and Manchester Avenue. CONDITIONAL USE PERMIT NO, 699: The City Clerk reported that Conditional Use Permit No. 699 is to he reconsidered hy the City Planning Commis~iono RECLASSIFICATION NO, 64-65-53 AND NO, 64-65-92: Request of E. R. McCoy, President of McCoy Motor Company, for approval of plans projecting erection of one and two-story Butler Metal buildings to be in addition to new car showroom a.~d office structure,' was submitted together with re- port from the Zoning Division of the Development Services Department. Mr. McCoy addressed the Council and brought the plans to the Council Table for review. Discussion was held by the City Council, Mr° McCoy, Mr. Bill Miller and Mr° Alan Orsborn. TRACT NO. 5409: Mr. Murdoch reported that the major portion of subject tract was presently located in County territory (3ohnson Annexa- tion) north of the Riverside Freeway and south of the Santa Aha River, and contains 87 R-1 lots. He further reported that all fees have beer] paid and required bond posted with the County of Orange, and recommended approval of said map. Final Map of Tract No. 5409 was approved in accordance with the recommendations of the City Engineer, on motion by Councilman Dutton, seconded by Councilman Chandler. MOTION CARRIED. ORANGE UNIFIED SCHOOL DISTRICT, PROPOSED ELEMENTARY SCHOOL - NOHL RANCH: Planning Commission at their meeting held May 24, 1965, recommended approval of the Nohl Ranch Elementary School site° City On motion by Councilman Schutte, seconded by Councilman Dutton, the City Council concurred with said recommendation. Mrs. Mabel Yorba, 5521 Santa Aha Canyon Road, reported that she was the owner of approximately 10 acres on the south side of said road, and that the balance of the triangle was owned by Bernardo Yorba, and further advised that she would object to the abandonment of the road because it was needed for access to her property. Mr. Maddox reported that the street in question was presently a State Highway and not yet under the control of the City, and no possible abandonment could be considered until approximately 90 days after State Relinquishment. There being no further evidence submitted by those present, the hearing was declared closed. Mr. Geisler brought to the attention of the City Council and applicant, Section 17.08.070 of the Anaheim Municipal Code pertaining to multiple family subdivisions which requires secondary access or alleys, and advised, in his opinion, that an R-2 development would require re- design of the tract map. In answer to Councilman Dutton's question, Mr. Mozer advised that a study with an alley pattern was made, however accordzng to his z'eacl- lection, it was never presented to the City; further, a tract with an alley design would probably cause the loss of some lots, and he did not know at this time what the developer would prefer. PUBLIC HEARING - RECLASSIFICATION NO, 64-65-118 AND VARIANCE NO. 1700: Sub- mitted by Don M. Lander, et al, requesting change of zone from C-O to C-l, to allow construction of. a neighborhood shopping center, and further requesting waiver of minimum required side yard width on the southerly property line; property briefly described as having frontages on the south side of Ball Road and the east side of Dale Street (2780 West Ball Road). The City Planning Commission pursuant {o Resolution No. 1602, Series 1964-65, recommended approval of said reclassification, subject to the following conditions: 1. That a new bond in the amount of $2,800.00 be posted with the City of Anaheim o__r that the General Insurance Company of America issue an endorsement which would transfer Bond No. 519587 from Reclassifi- cation No. 64-65-2 to Reclassification No. 64-65-118. That street improvement plans shall be prepared and all engineering requirements of the City of Anaheim along Ball ~O~d and Dale Street, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be completed as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer. 3. That Condition Nos. 1 and 2, above mentioned, shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. 4. That the completion of these reclassification proceedings is con- tingent upon the granting of Variance No. 1700. 5. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1 and 2. Mr. Mickelson ~oted the location of subject property and the existing uses and zoning in the immediate area, summarizing the evidence submitted to and considered by the City Piannlng Commission. He advised that the C-O zoning was approved under reclassification No. 64-65-2, and Bond No, 519587 was posted under said reclassification for the improvement of Dale Street and Ball Road. Plans and the files were reviewed by the City Council. The Mayor Pro Tem asked if anyone wished to address the City Council for or against subject applications, there being no response, declared the hearing closed. Piersall, Councilman Chandler mOved that the Director of Public Works be instructed to forward to the appro- priate legislators a letter of opposition to Senate Bill 81 in its present form, and that the City Clerk be authorized to certify to the-approval of said letter by the City Council.
