F-57-58-~9: With reference to the request of Mr. Halvorsen to eliminate from the deed restrictions Item No. 7,"Nothing contained herein shall prevent any future owner, with the permission of the governing body~ at that time, from altering any or all of these deed restrictions", was brought up by Mr. Murdoch, who reported that he, Mr. Halvorsen, and Mr. Turner met in an effort to arrive at an agreement with reference to the deed restrictions. Mr. Turner advised the Council that this condition was made a part of all the deed restrictions at the suggestion of the title company and explained the reasons therefor. Councilman Coons moved that Mr. Halvorsen's request to remove Article No. 7 from the Deed Restrictions, be denied, on the advice of the City Attorney. Councilman Schutte seconded the motion. Public hearing was held 3une 3, 1958, at which time said hearing was closed, and action by the City Council deferred to 3uno 17, 1958, and again to this date, to allow additional time for the working out of satisfactory arrangements with adjacent property owners. Ihe City Planning Commission, pursuant to their Resolution No. 247, Series 1957-58, recommended said reclassification, subject to conditions. Councilman Coons reported to the City Council, his conversation with Mr. Miller, resident in the area, and also Mrs. Menzie, Authorized Agent of the Applicant, relative to a compromise and agreement to allow the use of this property satisfactory to all. Mrs. Menzie and Mr. Miller were present at the meeting. RESOLUTION NO. 4621: After further discussion and consideration, Councilman Coons offered Resolution No. 4621 and moved for its passage and adoption, authorizing the preparation of necessary ordinance reclaissifying this property as requested, subject ,to the applicant's filing deed restrictions.limiting the construction to one-story; that the maximum number of units, as aP~ be six (6)units; and if the parcel is divided into two parcels, that the maximum number of units be restricted to three units per parcel; that the City Planning Commission's restrictions against entrances from Berry Street and Ball Road be waived to allow entrances to each of these parcels, if it is divided~ from adjacent streets. Robertson and State Farm Mutual Auto Insurance, in the amount of $274.91, for damage to parked automobile caused by a limb falling from a tree, was submitted.
