The Mayor declared Resolution No. 64R-108 duly passed and adopted.
PRIVATE PATROL APPLICATION - Jo R. BUESING: Application of J. R. Buesing for per-
mission to establish a Private Patrol in the City of Anaheim, was deferred
from the meeting of February 11~ 1964, pending further investigation.
Mr. Buesing was present, and submitted a letter from Mr. Ken Reaf-
snyder concerning the qualities of "Dirk", a Patrol Dog, and was prepared to
show a film demonstrating his police abilities (said letter was read in full).
Chief of Police Mark Ac Stephenson advised that since the last
Council meeting, he and Mr. Buesing have reviewed the Police report prev-
iously submitted, that a couple of discrepancies have been noted; however,
these discrepancies are minor and do not change the original report to a
great degree.
On the basis of the Chief of Police investigation and recommenda-
tion, said application was denied, on motion by Councilman Dutton, seconded
by Councilman Schutte~ MOTION CARRIED.
CALIFORNIA PEACE OFFICERS' TRAINING: Chief of Police Mark A. Stephenson presented
a check in the amount of $1~629.60 from California Peace Officers' Training
Fund, representing reimbursement to the City of 5~ of salary paid to seven
officers for a five-week special training course.
On motion by Councilman Ghandler~ seconded by Councilman Krein,
said check was received and ordered forwarded to the Director of Finance for
deposit in the proper fund. MOIION CARRIED.

CONDITIONAL USE PERMIT NO. 229: Request of F. Thomas Zak, Project Engineer of
Chrysler Motor Corporation, £or relie£ of twenty-foot P-L Zone~ established
at the southeast corner, along Los Angeles Street and Ball Road £rontage,
and request £or approval o£ revised plans of landscaping~ were submitted and
reviewed together with report of Planning Department-Development Review.
Mr. Zak advised that the contractor is ready to install underground
conduit for the lighting system~ and they would be willing to post a bond
pending further Council action°
Discussion was held concerning Council directive to City Planning
Commission to consider reduction of the P-L Zone along the east side of South
Los Angeles Street from Ball Road to Cerritos Avenue. Also noted was the
fact that this directive did not include any Ball Road frontage.
On motion by Councilman Chandler, seconded by Councilman Dut~on,
posting o£ a $500.00 cash bond was authorized~ pending decision on reduction
of P-L Zone and setback requirement, it being understood that this action
will in no way pre-determine action on pending zoning. MOTION CARRIED.
On motion by Councilman Schutte, seconded by Councilman Dutton,
the City Planning Commission was requested to include in their study~ pres-
ently being made~ the south side of Ball Road frontage to the first alley
east of Los Angeles Street. MOTION CARRIED.
RECLASSIFICATION NO~ 63-64-42 AND VARIANCE NO. 1604: Submitted by Allen E. Bard-
well (Leonard Smith, Agenl), requesting change of zone from R-A to R-3,
property briefly described as located on the north side of Ball Road,
approximately 170 feet west of Webster Street; and further requesting per-
mission to construct a twenty-seven unit apartment building~ waiving one-
story height limitation, sideyard requirements, and 1~ garage requirements,
to permit construction of carports.
Public hearing was held November 19, 1963, and January 28, 1964,
at which time said hearing was closed and application referred back to
the City Planning Commission to be considered in conjunction with Reclassi-
fication No. 63-64-62.
Communication was submitted from Mr. Smith, dated January 29,
1964, requesting Lot 20 and the south 241.51 feet portion of Lot 1, Block
"A", of Tract No. 787, be deleted from Application Nco 63-64-62 and con-
sidered under original Application, No. 63-64-42.
Mr. Kreidt reported that Reclassification No. 63-64-62 was
considered by the City Planning Commission yesterday~ and will be recommend-
ing an amendment to the General Plan of the Webster Street area, from
approximately Orange Avenue %o Ball Road~ to low medium density; and that
Reclassification No. 63-64-62 be approved, subject to conditions; that
rezoning be accomplished separately as development occurs~ and construction
be limlted to one-story within 150 feet of any single family subdivision or
R-1 property.
Mro Kreidt further advised that plans of 63-64-42 have been
revised to one-story construction, and would now come within the recommen-
dations that will be forthcoming on Reclassification No. 63-64-62.
On motion by Councilman Chandler, seconded by Councilman Dutton,
request to withdraw subject property from Reclassification No. 63-64-62
was granted. MOTION CARRIED.
RESOLUTION NO. 64R-109: Councilman Schutte offered Resolution No. 64R-109
for adoption, authorizing preparation of necessary Ordinance, changing %he
zone as requested, subject to the following conditions:
1. That the owners of subject property pay to the City of Anaheim the sum
of $2.00 per front foot along Ball Road for street lighting purposes.
2o That completion of these Reclassification proceedings be contingent
upon the granting of Variance Nco 1604.

3. That Condition No. 1 above-mentioned be complied with within a Period of
180 days from daie hereof~ or such further time as the City Council may

"~xhiblt Nos. 1~ Revision No. 1, through 5",as amended and applicable
tO single-story structure.
5. That the structural height limitation of one-story within 150 £eet of
R-1 Zone, Single Family Residential property, be maintained.
6. That tree wells shall be provlded at approximately £orty (40) foot
intervals in the Ball Road pa6kway abutting subject property; that
plans for said tree wells and 'planting of trees therein shall be sub-
mltted to and approved by the Superintendent of Parkway Maintenance.
Said tree wells shall be planted with trees prior to Final Building
Inspection.
7. Reclassification to be subject to appropriate action for amendment to
the General Plan.
8. That a six foot masonry wall, or its equivalen%~ shall be constructed
along the north and west property lines, prior to Final Building Inspec-
tion.
9. That a bond in an amount and form satisfactory to the City o£ Anaheim
shall be posted with the City to guarantee the installation of a six
foot masonry wall along the east property line, prior to Final Building
Inspection.

A RESOLUTION OF THE CiTY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETER-
MINING THAT TITLE i8 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING
SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE

Mayor Coons declared Resolution No. 64R-109 duly passed and

RESOLUTION NO. 64R-110: Councilman Schutte offered Resolution No. 64R-110
for adoption~ granting Variance No..1604, in part, granting waiver of side-
yard requirements, and one and one-fourth garage requirements to permit the
construction of carports, subject to the followin9 conditions:
1. That sidewalks be installed along Ball Road as required by the City
Engineer, and in accordance with standard plans and specifications on
file in the office of the City Engineer, prior to Final Building
Inspection.
2o That the owners of' subject property pay to the City of Anaheim the sum of
$25~00 per dwellin9 unit to be used for Park and Recreation purposes,
said amount to be paid at the time 'the building permit is issued°
3o That trash storage areas be provided in accordance with approved plans
on £ile in the office of the Director of Public Works, prior to Final
Building Inspection.
4. That the variance be granted subject to the completion of Reclassifica-
tion No. 63-64-42.
5. That the rear and side walls of the proposed carports be finished with
exterior building materials, that enclosed storage cabinets of a minimum
dimension of thirty-six (36) inches by forty-two (42) inches high,
running the entire width of each carport, be provided at the rear wall~
and that adequate bumper guards be provided to protect the interior
walls of the carport, prior to Final Building Inspection.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING VARIANCE
NO. 1604,
On roll call the foregoing Resolution Noo 64R-110 was duly passed

SIGN REQUEST: Request of Rich Sign and Neon Company on behalf of West-Lin
Cleaners for permission to erect a non-conforming sign at 3156 West Lincoln
Avenue, was deferred from the meeting of January 28, 1964, to allow the
applicant an opportunity to obtain approval of other businesses of an inte-
grated sign for the area.
Communication was submitted and read, dated February 17, 1964,
from Leonard Kessler, owner of West-Lin Cleaners, advising of his attempt to
obtain an integrated sign, and the reasons adequate signin9 for his business
was necessary. Said letter further advised that~ should sign permit be
granted, the two existing signs advertising subject business would be
removed.
Also submitted were pictures showing existing signs in the area.
Discussion was held by the City Council; at the conclusion thereof,
on motion by Councilman Dutton~ seconded by Councilman Chandler, sign permit
was granted, subject to the removal of the two existing signs advertising
West-Lin Cleaners, and further subject to no projection over the property line.
MOTION CARRIED.
REQUEST, MARKALL INC.: Request for permission to establish a display portable
classroom demonstration unit and office on property located at the southwest
corner of Gilbert Street and Lincoln Avenue, was considered.
Mro Bagnall, President of Markall Inc.~ presented brochures and
specifications of the portable classrooms they manufacture, and advised that
a location is necessary to display the equipment to school superintendents
and members of Boards of Trustees, and other interested parties; and that
the next thirty to ninety days was the critical period for their business.
It was noted by the City Council that the request is for a commer-
cial use of property in an R-1 subdivision, which could not be permitted
without reclassification of the property; further, subject property by deed
restrictions is prohibited for commercial useo
Mr~ Bagnall agreed to processing a zoning application~ and further
advised that they hope to purchase the property, and if the permit is granted,
improve the location with an attractive display that would be a credit to
the general area°
Discussion was held by the City Council and it was reported that
previous applications for commercial use of subject property had been made,
and that in each instance, strenuous objections to any commercial use of the
property were made by the residents of the tract. It was determined that
the applicant should endeavor to loca~e ~he business on property presently
zoned for this activity. Thereupon, on motion by Councilman Chandler,
seconded by Councilman Krein, said request was denied. MOTION CARRIED.

PROPOSAL - SOROPTIMIST CLUB OF ANAHEIM: Proposal of Soroptimist Club of Anaheim
to obtain a show wagon to be donated to the City of Anaheim for use in ~he
Park and Recreation Department, was submitted and read.

Mrs. Monica Lombardo and Mrs. May Belle Spencer~ members of the
Soroptimist Club, were present and addressed the Council concerning the
project and their proposal.
Mro John Collier, Park and Recreational Director, advised that
in his opinion, the equipment would be of considerable use, as it was
extremely flexible~ being self-contained and portable, and could be utilized
for several different activities°
Mr~ Collier further reported that the initial cost of the unit
was $9,860~00, and additionaI~ optional equipment, such as portable genera-
tore, etc.~ was available°
Terms of the proposal were discussed, and intent of Condition No.
2 considered~ it was suggested that the President and Board of Trustees of
the Soroptimist Club meet with the City Attorney to work out details of a
formal proposal.
At the conclusion of the discussion, on motion by Councilman
$chutte~ seconded by Councilman Dutton~ tentative approval of the project
was given, subject to final approval after details of the proposal are
further clarified. MOTION CARRiED.
~EQUEST - WAIVER OF BUSINESS LiCENSE~ SOCIALIST LABOR PARTY: Request of Mrs.
Helen Long that the "Weekly People~' is a non-profit undertaking~ and as
such~ be recognized as not sabjecZ to business license fee, was submitted.
The City Attorney reported 'that according to his interpretation,
under the City of Anaheim Ordinance, this activity is operated for a profit.
Further, his office has advised the Socialist Labor Party that they may dis-
tribute their literature within the City of Anaheim without charge~ specifying
'Free~ Donations Acceptable~', and if they do so, it would not be subject to
any regulations or business license.
On motion by Councilman Dutton, seconded by Councilman Schutte~
said request was denied~ based upon the City Attorney's interpretation of
the City ordinanceo MOTION CARRIED~
REQUEST - WAIVER OF BUSINESS LICENSE~ LIBRES FOUNDATION~ INC.: Request of Jo Ro
McEntee for waiver of business license fee~ was submitted.
Based on the verbal opinion given by the City Attorney, that this
activity is operated for a prof:it~ and under' the terms of the City ordinance
falls wilhin the category requiring business license, said request was
denied by the City Councit~ on motion by Councilman Dutton, seconded by
Councilman Sc~utzeo MOTION CARRIED.
EXTENSION OF TIME - RECLASSIFICATION NOo 63-64~9 (CONDITIONAL USE PER~IT NO~ 452):
Request of Alex Lo Fishman and Eo Lee Schultz for 180 day extension of time

will be dedicated by document, rather than tract map.

It was noted that multiple famlly zoning was pending on the
property to the East, a small portion of which is within the City of Anaheim~

Mr~ Fish advised that if the wall was constructed, it would deny
the adjacent property to 'the East access of the proposed easterly alley
in Tract No. 5063~
At the conclusion of the discussion, it was moved by Councilman
Schutte, seconded by Councilman Kreln, that the applicant be permitted to
post a bond in the amount of $2,500.00 for a period of one year, prior to
final building inspection, in lleu of construction of the wall. MOTION
CARRIED~
ORANGE COUNTY STREET NAMING COMMITTEE: Mr~ Thornton E. Piersall, Director of
Public Works~ reported on meeting held February 4~ 1964~ concerning the
re-naming of Grand Avenue, Glassell Street, Dowling Avenue, Kraemer Avenue~
and Carolina Avenue.
On motion by Councilman Coons, seconded by Councilman Krein, Mr.
Piersall was directed to indicate ±o the Orange County Street Naming Com-
mittee that there was no special significance to the name of "Dowling
Avenue", as far as the City of Anaheim is concerned, and that the City of
Anaheim will yield to whatever name the other cities select. MOTION CARRIED.
RECLASSIFICATION NO. 60-61-40; Planning Department - Development Review reported
that building plans for an R-3 development was presently pending on subject
property, and recommended that subject reclassification for C-1 zoning be
terminated~ prior to final building inspection of the R-3 development.
RESOLUTION NO. 64R-112: Councilman Dutton offered Resolution No. 64R-112,
terminating ail proceedings in connection with Reclassification No. 60-61-40.

to have temporary facilities until this job is readvertised, and the project
completed. The temporary facilities to be located, perhaps~ between the
Sixth Green and Seventh Tee~ and Thirteenth Green and Fourteenth Tee.
WORK ORDER NO. 4600 AND WORK ORDER NOv 4501 - WILLIAM D~ GRESCHNER CON%CANT: On
the recommendation of the City Attorney, it was moved by Councilman DuO'on,
seconded by Councilman Chandler~ that liquidated damages on a settled basis
in the amount of $2,100~00~ and adjusted utility charges in the amoun~ of
$3,285.35, be approved. MOTION CARRIED.
WORK ORDER NOo 4501, CENTRAL LIBRARY - CHANGE ORDER NO. 12: On the recommenda-
tion of the City Engineer~ Change Order No. 12, Credit $9,354.009 was
approved~ on motion by Councilman Dutton~ seconded by Councilman Chandler.

WORK ORDER NO. 4600~ POLICE FACILITIES - CHANGE ORDER NO~ 16: On the recommen-
dation of the City Engineer, Change Order No. 169 Credit $450.009 was

CITY GASOLINE CONTRACT: On motion by Councilman Krein, seconded by Councilman
Schutte9 continued purchase of City gasoline requirements under County of
Orange contract for the next ~welve months, was authorized. MOTION CARRIED.
FINANCIAL AND OPERATING REPORTS: Financial and Operating Reports for the month
of 3anuary9 1964, were ordered received and filed, on motion by Councilman
Krein~ seconded by Councilman Chandler° MOTION CARRIED.
EXPENSE ACCOUNTS - CITY COUNCILMEN: Discussion was held concerning the estab-
lishment of a fixed amount per meeting to cover expenses incurred by each
Councilman in the preparation for said meeting, similar to the expense
account established and recently increased for members of the City Planning
Commission.
Mayor Coons reported that over the past two years~ he maintained
a record of expenses incurred, and those directly attributable to Council
meeting preparation would average approximately $80.00 per month. This
amount did not include expenses incurred for attendances to special meet-
ings or functions attended in the office of Mayor. Further, in his opinion9
the average amount was conservative~ as it was practically impossible to
maintain an accurate record of mileage~ and time lost in the operation of
one's businesso
Councilman Schutte stated that he would estimate his expenses
closer to $200.00 per month°
Mr. Geisler advised the Council of their right to submit an
itemized statement of expense for reimbursement~ and further advised that
many cities have established a regular amount as it is rather difficult for
anyone to keep a record of actual expense. In his opinion, as long as the
amount established was reasonable and one that has been carefully considered,
it could be legally accomplished.
It was further determined that such fixed expense amount would be
for expense incurred in the ordinary Council meetings; that any specific or
additional City business authorized by the City Council would be reimbursed
upon submittal of itemized statement.
Based on the testimony given by Mayor Coons and Councilman Schutte,
Councilman Chandler moved it be the finding of the City Council that $25.00
per meeting for Councilmen, and $50~00 per meeting for Mayor, is a reasonable
amount for expense account for the preparation for any regular or special
called meeting~ and that the City Attorney be instructed to prepare an
amendment to Section 1.04.380 of the Anaheim Municipal Code accordingly.

The City Planning Commission pursuant to Resolution No. 1014,
Series 1963-64~ granted said conditional use permit, subject to the follow-
ing conditions:
1. That the owners of subject property shall deed to the City of Anaheim a
strip of land 57 feet in width, from the center line of the street,
along Sunlis't Street for street widening purposes.
2o That the owners of subject property shall deed to the City of Anaheim a
strip of land 53 feet in width, from the center line of the street,
along Lincoln Avenue for street widening purposes.
3. That street improvement plans shall be prepared and all engineering
requirements of the City of Anaheim along Sunkist Street and Lincoln
Avenue, such as curbs and gutters, sidewalks, street grading and paving,

mum Site Development Standards, provided that stone or masonry materials
shall be used for the exterior walls, that a shake roof shall be con-
structed, as stipulated by the petitioner, and that revised elevations
incorporating said materials shall be subject to the approval of
Development Review prior to issuance of a building permit.
8. That at such time as the orange trees on the rear portion of subject
property are removed that any plan for the development of said portion
of subject property other than black top shall be submitted to and
subject to the approval of the Planning Commission prior to the issuance

At the request of Councilman Schutte, review of action taken by
the City Planning Commission was ordered by the City Council and public
hearing scheduled~
Mro Kreidt noted the location of the property~ the zoning existing
and pending developments in the immediate area. He summarized the hearing
held before the City Planning Commission~ and advised that no one appeared
in opposition~
Reference was made to Exhibit No. 5 of Planning Study No. 38-112-4,
previously considered by the City Council, which according to the research of
Mro Kreidt was the last action of the City Council concerning this area.
Regarding notice of public hearing before the City Plannin9 Commis-
sion, Mr. Kreidt reported that the property was posted, and written notices
were mailed in excess of 300 feet, because of the relatively undeveloped
area.

Ihe Mayor asked if the applicant or his agent wished to address the
Council.
Mro Robert Fo Waldron, Attorney representing the applicant~ 2020
North Broadway~ Santa Aha, reported that also present were Mr. 3. $. Difilippo,
Real 5state Appraiser, who made a study of this area in regard to this hear-
lng, and Mr. Io So Brundige, Property Representative of Standard Oil Company,
and Mr. R~ Co Runion, Engineer for Standard Oil Company, who were present to
answer any technical questions relative to the proposed use.
Mr. Waldron advised that subject property was a portion of approxi-
mately twenty acres, on which there is the family residence, and the balance
of the parcel is presently being used as a citrus grove°
Mr. Waldron reported that the State Division o£ Highways is
presently negotiating for the acquisition of 8.411 acres of the total parcel
for a freeway, which will cut through the approximate center area between
Sunkist and Rio Vista Streets~ that an off-ramp is planned approximately 125
feet from the corner of Sunkist Street and Lincoln Avenue, with Lincoln
Avenue designed to 9o under the freeway; further, the State condemnation
includes all of the Lincoln Avenue frontage, with the exception of this
120 feet.
Reference was made to the service station use approved at the
intersection of Lincoln Avenue and Rio Vista Street~ and the traffic count
taken approximately last April of Rio Vista Street, Sunkist Street and
Lincoln Avenue. Mr. Waldron stated that in comparing these two locations,
there was more residential use both north and south of Lincoln Avenue on Rio
Vista Street than on Sunkist Street.

Mr~ Waldron reported that, according to his information, the worst
type of planning adjacent to a freeway would be any residential use.
In rebuttal to some of the objections and statements contained in
letters of protest filed, Mr. Waldron was of the opinion that many of the
statements were hearsay, without any real evidence. Regarding past action
on subject property approximately one and one-half years ago, when the area
was County territory, in his opinion it was not pertinent to the issue before
the City Council~ He further reported that the application was for a var-
lance, which completely differs from this application, and that the former
application never came before the City Council.
In conclusion, Mr. Waldron called attention to the fact that with
the construction of the freeway, subject property will be an isolated parcel
of property; that both streets will be widened, which will compensate for
any addizional traffic generated by this use, and that the highest and best
use of the property would be a service station use, taking into considera-
tion the imposition of the freeway, and the commercial developments that
have taken place on both sides of subject property.
Mro Waldron presented a petition containing forty-one signatures
of property owners or residents within close proximity of the property,
favoring said conditional use permit.
In answer to Councilman Schu%te~s question concerning devaluation
of residential property adjacent to a service station use, Mr. Waldron
advised that the majority of his practice was in the evaluation of real
estate in connection with condemnation cases; and according to his exper-
ience, there is no evidence that this use would devalue property.
Mr~ Difliippo, 1007 North Broadway, Santa Ana, Real Estate
Appraiser, reported that based on his investigation and studies, the
highest and best use of the southwest corner of the Dahlman property would
be a service station dse.
Mro Difilippo referred to a County road map of the area, the
principal streets in the area outlined in orange, residential developments
noted in blue, undeveloped property noted in light green, and the Dahlman
property noted in dark green. He advised that his study along Lincoln
Avenue began in an area near the Newport Freeway, and extended westerly to
the Orange CounZ¥ limits; that except for the immediate residential develop-
ment next to the Dahlman property, nowhere are there single family residen-
tial developments fronting on Lincoln Avenue. Yhe general use is commercial
or multiple family use.
Mr. Difllippo further advised that the study included the homes
immediately west of subject property (Tract No. 2490) including the average
size and value, the three homes fronting on Lincoln Avenue presently for
sale, and the transition presently takin9 place on State College Boulevard,
and the value of these homes for commercial use, as compared to residential
use; study of zoning actions in the area, and consideration.given to the
fact that Rio Vista Street dead-ends at Wagner Street, and future highway
development will. cu't off Rio Vista at the North, whereas Sunkist will be
taken over the Riverside Freeway into the north industrial area~ thereby
converting traffic from Rio Vista Street to Sunkist Street.
Mr. Stubbs, 502 Rio Vista Street, advised that he was the closest
resident to the Mobi19as Station on the corner of Rio Vista Street and
Lincoln Avenue, and in his oplnlon, the station had not decreased the value
of his property; that recently two offers have been made to purchase his
property for an amount substantially more than he had paid for it.
Mr~ Waldron advised that 'they would be willing to submit their
plans to the Planning Commission, or any other Architectural body of the
City~

Mayor Coons advised that the letters o£ opposition were introduced
in evidence~ and asked if there was a spokesman for the group that wished to
address the Council.
Mr. Gordon McCone, 218 North Normandy Drive, President of Anaheim-
Sunkist Civic Association, advised of the City Planning Commission's
opposition to the previous County Planning Commission application in July
of 1962. He further advised that it was their understanding that the
Conditional Use Permit 9ranted by the Planning Commission for service
station use of the property was subject to certain restrictive measures.
Although they appreciated the restrictive measures taken, they could not
understand the reasons for granting the permit when they vigorously opposed
it in the past.
In their opinion, conditions have not materially changed in favor
of Mr. Dahlman's request; in fact, they felt the conditions were enhanced
for the local home owners by the addition of another residential tract con-
raining eighty-three homes; further, there was reason to believe that homes
of comparable value could be constructed on the Dahlman property.
Mr. McCone felt there was documentary evidence to show that
moderately priced homes adjacent to freeways sell as well as similar homes
in other areas.
Regarding the statement of Mr~ Difilippo concerning homes on
arterial highways and their increase in value for commercial use, Mr. McCone
noted that no mention was made of the value of the homes immediately behind
the converted homes; ~hat the question was, have they increased or decreased.
Regarding the State condemnation of all but 120 feet of the Lincoln
Avenue frontage, Mr. McCone noted a Plan Study of the City Planning Commission
indicating how homes in that area could be constructed on cul-de-sac streets
that would not front on Lincoln Avenue~
Regarding the statement made that Sunkist-Lincoln intersection was
a better intersection than Rio Vista-Lincoln intersection for this user he
reported that at the Planning Commission hearing it was noted that after
completion of the Riverside Freeway overpass, the traffic will not have access
to subject property; further, the service stations located at the intersection
of Rio Vista $tree~ and Lincoln Avenue were constructed after commercial
development in this area was in existence, and this location, in his opinion,
was more in keeping with the general nature of the existing development.
Mr. McCone advised of the voting record of the Planning Commissioners
on this issue, and noted reasons stated by those voting "No".
In conclusion, Mr. McCone noZed the nature of the traffic pattern
in the area, and the fact that the granting of the service station use would
establish a precedent in the area, creating conditions ~etrimental to the
children. He stated that they felt there was a use of the land more compa-
tible to the use of the existing area.
Mr. Raymond Grant, 2403 East Sycamore Street, member of the Anaheim-
Sunkist Homeowners Association, called attention to the fact that the service
station is proposed to be located on a high-speed off-ramp of the freeway,
constituting a danger to traffic in the deceleration lane, and to all traffic
westbound on Lincoln Avenue, by left-hand turns into the service station site,
subjecting all citizens to an unnecessary hazard.
Mr. Earl Butcher, 2310 Alden Avenue, President of East Anaheim Civic
Association, addressed the Council in support of position stated by Mr.
McCone, and also in support of the General Plan, as it pertains to their
area. In his opinion, the service station use would establish a precedent
for development of vacant property, which is a concern to their association.
He thereupon requested the use be denied~ as ~hey felt it definitely was not
a desirable location for a service station.

Dr. Howard Garber~ 303 North Sunkist Street, addressed the Council
in agreement with expressions made by the opposition.
Dr. Garber advised that his letter sent to the City Council was
sent prior to his knowledge of any hearings on this matter. He further
advised that this was ±he second time this issue has been considered, and
wondered how many times this could be considered, maintaining the same
concern of the residents.
Me called attention to a similar application {or the intersection
of La Palma Avenue and Sunkist Street, which was denied because of the ctoss
pro×imity of the school, and was of the opinion that this locatlon was
essentially the same considering the proposed park to be built in the
immediate future.
Dr. Gather advised that there was no commercial development on
Lincoln Avenue from State College Boulevard to Rio Vista Street, and the
granting of this use would be spot zoning. He asked what was proposed for
the adjoining area, and felt there was a good possibility of the extension
o£ commercial development. He called attention to the fact that at the
hearing before the Orange County Planning Commission and Board of Super-
visors, and with the knowledge of the proposed freeway, the requested use
was denied.
Councilman Dutton advised Dro Garber that upon receipt of his
letter dated 3anuary 6, t964, concerning the notice of public hearing, he
personally inspected the property and found said notice posted.
Dfc Garber advised that when he inspected the site, he found that
no notice was posted.
Mr. Francis Lo Ricker, 2459 Cas{ Lincoln Avenue, felt that if
there is to be a change in zoning, it should apply to the entire Lincoln
Avenue frontage, and suggested a meeting of property owners on Lincoln
Avenue to determine the wishes concerning zoning; that under the present
circumstances, he would be in opposition %o said application unless it would
apply to other properties along Lincoln Avenue.
Mr~ Sam Ca!aronel!o, 2449 East Paradise Road, referred to a
County Sectional Map 12-4-10, Exhibit A, wherein the location of the station
was shown at the corner of 'the property. Mro Caiaronello asked what the use
would be on the balance of 'the property.
Mayor Coons replied that any subsequent use of the property would
require application before the City Planning Commission for a different use.
Mr. C~ C~ Neaty', 502 Stehly, member of the Anaheim-Rio Vista
Homeowners Association, and resident in close proximity to the service sta-
tion located on the corner of Lincoln Avenue and Rio Vista Street, advised
that the light from said service station illuminated the bedrooms of their
home.
Mr~ Nea].y noted thai the report of the appraiser omitted any
reference to 'the freeway~ and regarding traffic, the majority of the traffic
on Sunkist Street consists of residents of that area. Others will travel
the freeway~ when constructed. Further, he felt certain that offers to
purchase Mro giubbs~ property were not £or resident{al use o£ the property.
Regarding the requirement of a block wall, he noted the same
requirement was made for the service station site located at Rio Vista
Street and Lincoln Avenue, and thai after a full year, the wall has not
been constructed. He stated ~hat if this zoning is permitted, they would
request that none of the conditions be waived.
Mr. Nealy referred to the commercial spot zoning along State
College Boulevard, which was a possibility along Lincoln Avenue, and
reported that the commercial spot zoning along State College Boulevard
commenced with service stations located at the intersection, and that when
this occurs, the buffer normally required between business and residential
is removed~ making the second row cf homes less desirable~

The Mayor declared Resolution No. 64R-118 duly passed and adopted.
PUBLIC HEARING~ RECLASSIFICATION NO. 63-64-73: Submitted by Herman H. Bruns,
requesting a change of zone from R-A to R-l, property located on the west
side of West Street~ approximately 223 feet south of Santa Aha Street
(525 South West Street).
The City Planning Commission pursuant to Resolution No. 1028,
Series 1963-647 recommended said reclassification, subject to the following
conditions:
1, That sidewalks shall be installed along West Street, as required by the
City Engineer and in accordance with standard plans and specifications
on file in the office of the City Engineer prior to final building
inspection.
2. That a Record of Survey to record the approved division of subject
property be recorded in the office of the Orange County Recorder.
3. That Condition Noo 2~ above mentioned~ shall be complied with within a
period of 180 days from date hereof~ or such further time as the City
Council may grant.
4. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim, marked
"Exhibit Nos. 1 and 2"°
Mr. Kreidt noted the location of the property~ and advised that
the change proposed would divide one parcel of land into two standard R-1
lots. He summarized the evidence submitted to and considered by the City
Planning Commission~ and further advised that as approved by the City
Council, construction is presently under way at the petitioner's own risk.
The Mayor asked if anyone wished to address the Council either
for or against said application~ there being no response, declared the
hearing closed.
RESOLUTION NO. 64R-119: Councilman Krein offered Resolution No. 64R-119
authorizing preparation of necessary Ordinance~ changing the zone as
requested~ subject to the recommendations of the City Planning Commission.

PUBLIC HEARING, RECLASSIFICATION NO. 63-64-74 AND VARIANCE NO. 1618: Submitted
by Gall Vary, requesting a change of zone from R-2 to R-3, and waiver of
garage requirement ~o permit the construction of four garages instead of
five, property briefly described as located on the south side of Broadway,
approximately 130 feet west of Bush Street (916 East Broadway).
The City Planning Commission pursuant to Resolution No. 1029,
Series 1963-64, recommended said reclassification subject to the following
conditions:
1. That the completion of these reclassification proceedings is contingent
upon the granting of a Variance~
2. That the owners of subject property shall pay to the City of Anaheim the
sum of 15¢ per front foot along Broadway, for tree planting purposes.
3. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim, marked
"Exhibit Nos. 1 through 4"'.
The City Planning Commission pursuant to Resolution No. 1030,
Series 1963-64, 9ranted Variance No~ 1618, subject to the followin9
conditions:
lo That the owners of subject property shall pay to the City of Anaheim the
sum of $25.00 per dwelling unit, to be used for park and recreation
purposes, said amount to be paid at the time the building permit is
issued.
2. That trash storage areas shall be provided in accordance with approved
plans on file in the office of the Director of Public Works, prior to
final building inspection~
3o That this variance is granted subject to the completion of Reclassifi-
cation No. 63-64-74.
4. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim, marked
"Exhibit Nos. 1 through 4".
Mr~ Kreidz noted the location of the property and the zoning and
use in the immediate area,, He summarized the evidence submitted to the City
Planning Commission, advisin9 that no one appeared in opposition, and that
the City Planning Commission was of the opinion that the requested use would
be the highest and best use of the property,
The Mayor asked if' anyone wished to address the Council either for
or against said application, there being no response, declared the hearing
closed.

Council questions.

ensuing term. MOTION UNANIMOUSLY CARRIED.
~DJOURNMENT: Councilman Krein moved to adjourn to February 19, 1964, 7:00 P.M.
for the purpose of holding a Public and General Discussion on the proposed
Anaheim City Charter, as recommended by the City Charter Committee, and
also moved waiver of further notice of said adjournment. Councilman $chutte

Mayor Coons called the meeting to order.
Mayor Coons welcomed those present, and explained that the informal
public discussion was scheduled to hear and receive any suggested changes
that might be made, or might be incorporated in the Charter proposed for the
City of Anaheim by the Anaheim Citizens' Charter Study Committee, a Committee
appointed by the City Council for this purpose.
