MINUTES: The Minutes o£ the regular meeting held May 26, 1953~ and adjourned
regular meeting held May 28, 1953, were approved on motion by Councilman Van
Wagoner~ seconded by Councilman Heying. MOTION CARRIfK).
DEN~IND$: Councilman Van Wagoner reported demands against the city amounting to
$110,576.53. Councilman Heytng moved that report of Finance Committee be
accepted and that warrants be drawn upon the Treasurer %o pay said demands in
accordance with report. Councilman Wisser seconded the motion. MOTION CARRIED.
FINANCIAL & OPERA/ING REPORTS.' For the month of May were submitted, read and
ordered received and filed on motion by Councilman Wi sser~ seconded by Councilman

BIDS: CONCRETE CYLINDER PIPE: Pursuant to legal notice, duly published, the
City Clerk was instructed to open bid proposals for the 'purchase of Concrete

pUBLIC HEARING: VARIANCE NO. 109~: Paul L. Pierce~ Larry Armour, Agenl-
requesting that lots Nos. 46 to 117 in¢lusive~ Tract No. 1091~ be permitted a
depth o£ 97 £ee~ and £rontages o£ 60 ~o 62 £eet. Also that a front yard set-
back of 20 feet be allowed on lots having a depth of 97 feet.
LOCATION: Proper~y bounded by Euclid Ave., Manchester Ave. and Crescen~ Ave.
City Planning Commission~ pursuant to their Resolution No. 48, denied
said variance, setting forth their reasons therefore. .
APPEAL FROM ACIION taken by the City Planning Commission was submitted
by Paul L. Pierce~ through Agent~ Larry Armour. Said Appeal was read in full an~
discussion followed.
Administrative Officer reported on the many engineering requirements
necessary and the problems involved in this particular tract~ necessi~a%in9 the
entire re-engineering of the tract, resulting in additional expense and time
delay.
Larry Armour addressed the Council stating that the map was laid out
~ith the streets as ~hey now exist because of drainage problems, this was con-
sidered good engineering practice~ then the alley was put.in and Euclid S%ree~
was widened. Further, that the group of lots involved are in the heart0f the
subdivision. Mr. Armour further advised that the tract met the requirements of
the Anaheim Municipal Code until such time as the alley was requested. The
homes are to be between 1~050 square feet and 1,250 square fee~.
Councilman Heying asked what provision was made to keep the water
flow off the property.
Mr. Armour stated they ~ere installing a 10" .~curb along Crescent
Street. The tract is designed so as when water reaches maximum stage~ the
streets within the subdivision, running north and south will act very to a
drain in a bath tub. similarly

The City £ngineer reported on this situation~ outlining for the City
Council the necessary engineering requirements of this tract. Engineering problems
in this tract, due to the location and soil conditions, had in his opinion been
satisfactorily met.
On suggestion of Councilman Heying, the matter was continUed to later'
hour, to further study the problem, and so ordered.
PUBLIC HHARING:~ P-L ZONE to be established. Pursuant to City Planning Commission
Resolution No. 46 recommending the addition to the Municipal Code of ~ R-~L Zone
(Parking Landscaping Zone) to be used in connection with newly established C-l,
C-2, M-1 and ~-2 Zones.
Addition of Section 9200.21 "P-L Zone" was discussed. It was considered
the zoning should be more specific as to what .percentage was to be parking and what
percentage should be landscaping, thereupon, on motion by Councilman Heying, seconded
by Councilman,.Wisser, said matter was referred back to the City Planning Commission
for further study and mpre definite terms of proposed Section 9200.21._MOTION CARRIED.
F-52-53-13: PUBLIC HEARING: J. H. Mulvey- property described as southwesterly
portion of Lot 6, Anaheim Extension~ with a frontage of 123.94 feet on E. Center St.
and having a depth of 407.32 feet northerly from the center line of E. Center Street
be changed from R-A to R-3.
City Planning Commission recommended the granting of said reclassification
pursuant to their Resolution No. 43.
City Clerk offered Petition signed by 79 residents in the area protesting
the change of zone. Said petition was read in full.
WILLIAM FRECKER, 107 Evergreen St. Addressed the Council stating more than 1/3 of
the signers of the petition were present at the meeting. He stated he was an
Appraiser by trade and called attention to the fact that when multiple dwellings
were allowed~, devaluation of surrounding property followed~ the erection of two-
story dwellings would be a direct invasion of privacy.
MAYOR PEARSON asked what could be done with this property.
AUDIENCE: It was recommended it be considered R-1 property, inasmuch as an excess
of 50,000 square feet was invo~lved.
CITY CLERK read City Planning Commission Resolution No.~ 43. ~Two.< public hearings had
been held~ March 16 and April 6, at which times~ no one present objected to the re-
classification and no objections had ~een received in writing.
GEORGE POITEVIN~ 113 Evergreen St. Addressed the Council stating no notice of poblic
hearings had been received by him.
WAYNE C. IRVIN~ 241 Spruce St. Addressed %he Council stating they didnot come prepared
to offer an alternate use of the land, but they would be glad to consider another use
the applicant might make.
KENNETH DUNLEVY: 1505 E. Center $2. addressed the Council stating the granting of
this change of zone would establish a precedent, and the south side of Center Street
might request more core, hernial zoning.
MR. MULVEY: Regarding the suggestion that the Nor-Park Homes buy the property, they
do not want it because it cannot be subdivided into lots, this part of the property
was not desirable for them, it is not big enough to divide into R-1 lots. It can be
used for stores or R-3~ there is no other way %o develope it. The property is too
narrow in front for the depth.
GEORGE POIIEVIN: City Planning Commission stated they had plans for running a
street through there.
JAMES LANGWORTHY~ t believe this would be establishing a pre.cedent~ this being the
only lot fronting Center Street. It seems this is just a part of a larger problem.
WILLIAM B. SHEPPARD: 214 Evergreen St. - How would it be subdivided for R-3, what
use would be made of it that way9 It seems you would have to have a street.

WILLIA~ FRH~KER: Concerning the property on Evergreen and the property on ~Cedar
to the north, the entire area, there was no easement on the property. The entire
easement has been at the expense of the property buyers of the Nor-Park Homes. I
would feel before any consideration be given for any kind of development~ tha~ the
easement be shared.
JI~ NECTOR: The entire property should be reconsidered.
WILLIA~ A. REESE: Asked if Mr. Mulvey owned any other property in the tract.
MAYOR PEARSON: Thanked all attending and advised the matter would be given further
study and will be considered at a later date.
PUBLIC HFARING: AMHND S~.CTION 9200.11: Proposed change of Code to prohibit
residential use in the ~-1, Industrial Zone~ within the City of Anaheim.
City Planning Commission Resolution No. 39 didnot recommend the proposed change
to the Municipal Code.
TOM McLAUGHLIN addressed the council calling attention to property owned by-his
client that could bebetter used as Residential than M-1.
ADMINISTRATIVE OFFIOHR advised the problem should be taken care of by reclassification.
Councilman Heying moved to hold the matter over. Councilman Van Wagoner seconded
the motion. MOTION CARRIED.
PUBLIC HEARING.. F-52-53-!4: Property owners on the W. side of S. Lemon St.
between W. South St. and W. vermont Ave. requesting change of zone from R-1 to
City Planning Commission Resolution No. 45 recommended the reclassification.
Communication from Conan W. and Irene K. Gray, owners of approximately 3~ acres
west of the property on which change of zone is requested~ stating they had no
objections to the reclassification, was submitted and read.

VARIANCE NO. 192: Mx:. Peltzer addressed the council wanting to know the outcome
of Variance No. 192.
WhR. PIERCE. Addressed the Council stating he didn't think they would be eStJblish-
ing a precedent by reason of the circumstances involved. He called attention to
the approval of the map, subject to engineering requirements, and to the best of
their ability, they had made the changes and met the engineering requirements.
CITY ENGINEER: Collaborated statements made by Mr. Pierce in that in his opinion
particular engineering requirements necessary in this tract had been met.
Councilman Van Wagoner moved to accept the $ubidivision, as submitted,
Councilman Heying seconded the motion, with the comment there were definite

extenuating circumstances in this particular area that probably would not occur
again. MOTION CARRIED.
Subdivider hopes homes to be approximately $12,000.00.

The Building Department had been notified to withhold building permits
until such time as it could be determined if additional building was within the
limits of the Variance, pursuant to Resolution No. 1642.

QUINTON ENGINEERS: City Administrative Officer discussed the Quinton Engineers'
proposal to prepare detailed plans and specifications for three-million gallon
water reservoir and pumpin9 station at the La Palms Avenue location, and recommended
to the City Council the acceptance of said proposal as outlined in their letter
o£ June 9, 1953.
On motion by Councilman Van Wagoner, seconded by Councilman Heying,
the City Attorney was instructed to prepare necessary resolution, or agreement,
securing the services of the Quinton Engineers, as recommended. MO/ION CARRIED.
_PURCHASE ACCOUNTS, EDISON CO.; On recommendations of the Administrative Officer
and Superintendent of Light, Power and Water, George Oelkers, the City Council
approved the purchase of sixteen accounts on Santa Ana Street from the Edison
Company at the cost of $6,500.00~ on motion by Councilman Heying~ seconded by
Councilman Wisser. MOTION CARRIED (Electric Works Extension Bond Fund)
C~.IQN, N~JNICIPAL ADMINISTRATORS: Keith A. Murdoch, Administrative Officer,
was authorized to attend the 39th Annual Convention of Municipal Administrators,
to be held in Los Angeles, September 20th t~rough the 24th, on motion by Council-
man Heying, seconded by Councilman Wi sser. MOTION CARRIED.
Councilman Van Wagoner moved to adjourn. Councilman Wisser seconded
