The City Clerk called the meeting to order for the purpose of electing a
Mayor Pro Tern for the City of Anaheim.
Councilman Van Wagoner nominated Councilman Heying, Mayor Pro /em for the
City of Anaheim and moved the nomination closed. Councilman Wisser seconded the
motion. MOTION CARRIED. Mayor Pro /em Heying was seated.
MINg/ES 9f the regular meeting held August 11, 1953 and adjourned regular meeting
held August 24~ 1953 were approved on motion by Councilman Van Wagoner~ seconded by
Councilman Wisser. MOTION CARRIED.
.DEMANDS: Councilman Van Wagoner reported demands against the city amounting to
$122 ~ 411. 04. Councilman Wisser moved that report of Finance Committee be accepted
and that warrants be drawn upon the Treasurer to pay said demands in accordance with
report. Councilman Van Wagoner seconded the motion. MOTION CARRIED.
VARIANCE NO. 198: PUBLIC HEARING: APPEAL FROM ACTION TAKEN BY CITY PLANNING COMMISS-
ION: Garden Homes- Tract No. 1691 - JOhn D. Ardaiz: Request to reduce set-backs
from 25 feet to 20 feet for homes in said tract.
City Planning Commission (Resolution Ne. 10, Series 1953-'54) denied said
Variance for the following reasons:
1. /here appears to be no exceptional or extraordinary circumstances or
conditions applicable to the subject property or its intended use that do not apply
to other property in the same vicinity or zone.
2. The granting of the proposed Variance .,is not necessary fo~ the preser-
vation and enjoyment of a substantial property right already enjoyed by others in
the same visinity or zone.
3. The granting of the proposed Variance would be detrimental to the
future enforcement of set-back requirements.
Mr. John D. Ardaiz and Mr. D. W. Edwards, Builder, addressed the Council
statin9 their reasons for the request due to 98-£oot depth o£ lots and change.in
building plans to erect larger homes than the original planned 700 sq. ft. house.
?uther believed set-back variance would be granted in as much as others had been
allowed.
Administrative Officer stated in the two tracts where set-back were
reduced from 25 ft. to 20 ft.~ one included a continuation of streets where
buildings were now existing and the set-back of 20 ft. continued the same set-back
already established and the second was where lhe inclusion of an alley~ for drainage
purposes~ necessitated reduction o£ set-back, requirements.

and adoption.

said reclassification, subject to the deeding of 20 feet to the City of Anaheim for
the future widening of Ball Road.
The sale of Mr. Hartman's property to Mr. Shipkey is contingent on this
rezoning~ however the property owner from whom the 20 foot deed~ for the widening
of Ball Road, would be submitted (Mr. Kef/let) is out of town and under the cir-
cumstances full and complete representation could not be had at this meeting.
Public Hearing was ordered continued to September 8, 19D3_on motion by
Councilman Van Wagoner, seconded by Councilman Wisser. NDIION CARRI£D.
F-52-53-19: PUBLIC HHARING: F. E. Warries, 1109 E. Center Street, requesting
property be changed from R-3 to C-2 for the erection of a Service Station.
City Planning Commission~ Resolution No. 2- Series 1953-54 recommended
denial of said rezoning for the following reasons:
1. /hat property owners in the area are opposed to the erection cfa
Service Sfation.
2. /hat there are sufficient Service Stations located on Center St.
at present.
3. /hat the Commission would consider some other Commercial use on
the property other than a Service Station.
Mayor Pro /em Heying requested Item 2 be stricken out~ as it has no
bearing on the matter as far as the Council~is Concerned.
WILLIA~ P. WHBB~ Attorney addressed the Council~ representing neighbors in the
vicinity protesting the change of-zone and the Jallowance of a SerVice Station
at this location.
Others addressing the Council in opposition to the granting of said
reclassification were:

IF~IJV~ RKGAN, Agent for Mr. Warnes, addressed the Council statin9 reasons believed
reclassification should be granted~ that Center Street is fast becoming commercially
used~ and under such circumstances it was impossible to sell this property for
residential purposes. Standard Oil Company has offered a very fine lease for
this property, and pictures were presented of the proposed station to be erected
there. It was their opinion that the erection of a new Standard Oil Station
would improve the surrounding area, and further the depriving of Mr. Warnes of
an opportunity to lease to the Stand Oil Go. was depriving him of the best use
o£ his property.
Councilman Van Wagoner moved the council sustain action taken by the
City Planning Con~ss$on-; that the~:re¢lassification under Application F-52-53-19
be ~denied. Councilman Wisser seconded the motion. MOIION CARRIED.

between W. Santa Aha St. and W. Water St. be chan9ed from R-1 to R-2.
City Planning Commission, Resolution No. 3- Series 1953-54 recommended
the reclassification of this property.
No written objections were received by th~ City Clerk and no one present
objected to the proposed change of zone.

F-52-53-21: PUBLIC HEAR_INGt Filed by Gaetha Sisson, Agent requesting change of
zone on property numbered 1012 to 1024 East Center St. from R-3 to 0-2 for the
erection of a Service Station.
City Planning Commission~ Resolution No. 4- Series 1953-54 recommended
denial of said reclassification for the following reasons:
1. That property owners in the area are opposed to the erection of a
Service Station.
2. That there are sufficient Service Stations on Center Street at the
present time.
3. /hat the Commission is against further shoe-stringing of business
along Center Street at this time.
Mayor'Pro Tern Heying requested Item 2 be stricken out, as it has no
bearing on the matter as far as the Council is concerned.
Petition filed August 20th, protesting the granting of this reclassificat-
ion was read by the City Clerk.
Petition filed with the City Planning Commission, June 25, 1953, protest-
ing the rezoning was read in full by the Clerk.

Communication from Frank N. Gibbs, protesting rezoning was submitted and
Statements from residents of Orange County who live near Service Stations
such is proposed for this location were submitted and read. Said statements
certified no notice of odor or ill effects from the station they.were near.
Mr. Kendall W. Magill, 119 No. Rose Street addressed the Council urging
the denial of said reclassification.
Mrs. Gaetha Sisson, Agent address the Council and presented pictures of
proposed station to be erected by the General Petroleum Co. at an approximate cost
of $35,000.00. A count of 1100 cars on Center Street between the hours of 1:00 and
2:00 had been made by her. Further~ she had sold other property for similar use,
and after such sale, the surrounding property increased in value.
After full discussion by the Council~ Councilman Wisser moved to sustain
the action of the City Planning Commission and thereby.deny Rec~lassification No.
F-52-53-21. Councilman Van Wagoner seconded the motion. MOTION CARRIED.

YRAII~R PARK: Mr. C. F. Chaney requested the City Council to issue building permit
to allow commencement of construction of the Trailer Park to be located at
Manchester and Ball Road, and included in the Ball Road Annexation No. 2.
The Administrative Officer stated the territory was not yet incorporated
within the City of Anaheim, and if something could be worked out with the County
Building Department there might be a possibility of issuing a permit in advance
of the completion of the annexation proceedings, however~ it would be in fu~ll
accordance with the County.
EMPLOYEES~ ASSOCIATION: Emil E. Blankmeyer and delegation representing the Anaheim
City Employees~ Association requesting the City Council consider a 5% raise~
retroactive to August 16th, and further requesting discussions with the Administrat-
ive Officer, Keith A. Murdoch~ at least once a month or oftener.
Mr. Murdoch was very favorable to the meetings with the Employees
Association.
Mayor Pro Tern Heying advised the delegation that the issue regarding the
raise be taken up with the Administrative Officer for his presentation to the City
Council at a later date.
