Mayor Pebley called the meeting to order.
INVOCATION: Reverend Walter Vernon, of the First Congregational Church,
gave the Invocation.
FLAG SALUTE: Councilman Chandler led the Assembly in the Pledge of Alle-
giance to the Flag.
PROCLAMATION: Mayor Pebley proclaimed the week of March 17 to 23, 1968,
"Poison Prevention Week."
INTRODUCTION: Mr. Bill Todd, of the Personnel Department, introduced
new employees attending the Council meeting as part of the
orientation program.
Mayor Pebley, on behalf of the City Council, welcomed the group
to the City family.

INTRODUCTION: The Mayor expressed thanks to Western Airlines for promoting
the City of Anaheim in other parts of this country, in British
Columbia, and in Alberta, Canada.
Mr. Mason Mallory, Director of Sales Promotion for Western Air-
lines, thanked the Mayor and introduced the "North Country Vaca-
tionettes," for 1968, who p~omote the northern locations in
this area.
MINUTES: Minutes of the Anaheim City Council meeting held February 20, 1968,
were approved, on mction by Councilman Krein, seconded by Councilman
Dt'ttort. MOTION CARRIED.
WAIVER OF READING - ORDINANCES AND RESOLUTIONS: Councilman Dutton moved to
waive the reading in full of all ordinances and resolutions, and that
consent to the waiver of reading is hereby given by all Councilmen, un-
less after reading of the title, specific request is made by a Councilman
for the reading of such ordinance or resolution. Councilman Chandler
seconded the motion. MOTION UNANIMOUSLY CARRIED.
REPORT - FINANCIAL DEMANDS AGAINST THE CITY: Demands against the City in the
amount of $1,479,938.79, in accordance with the 1967-68 Budget, were ap-
proved.

PUBLIC HEARING -ABANDONMENT - No. 68-lA: Public Hearing was held on proposed
abandonment of a portion of the public utility easement located along the
north and east sides of Lots 12, 13, and 14, Tract No. 2517, reserving
therefrom an easement for public utility overhead and overhang purposes
for electric power lines and cross arms; property located on the north
side of Glenoaks Avenue, west of Euclid Street, pursuant to Resolution
No. 68R-l17, duly published in the Anaheim Bulletin, February 29, 1968,
and notices thereof posted in accordance with law.
The Mayor asked if anyone wished to address the City Council,
there being no response, declared the hearing closed.

The City Engineer reported that the request had been reviewed by
all departments of the City and affected agencies, and required fees paid,
and he recommended approval of said request, subject to reservation of public
utility overhang easement.

adoption, approving said abandonment.

PUBLIC DANCE PERMITS: The following applications were submitted and granted, sub-
ject to provisions of Chapter 4.16 of the Anaheim Municipal Code, as recom-
mended by the Chief of Police, on motion by Councilman Dutton, seconded by
Councilman Krein:
a. Application submitted by Carmen D. Sanchez, on behalf of Sociedad
Ignacio Zaragoza #1, for permit to conduct public dance on March 24, 1968, at ~i..._...

ENTERTAINMENT PERMIT APPLICATION: Application filed by William Harold Stoops, for
entertainment permit to allow "Go-Go" type dancers and topless entertainment
at Tap City Restaurant, 1116 Fountain Way, was denied by the City Council,
January 16, 1968. .
A second application was filed by Mr. Stoops, setting forth the
intention to provide "Go-Go" type dancers, attired in bikini costumes, per-
forming those types of dances normally seen on television, and in establish-
ments providing entertainment throughout Southern California, and in addition,
to provide topless entertainment with the dancers performing the type of mod-
ern dances normally seen in topless establishments.
The Chief of Police recommended denial of said application, on the
basis that it would be in direct violation of Anaheim Municipal Code Section
4.18.060; in violation of Section 647 (a) of the Penal Code, in the opinion
of the Chief of Police; and that a false statement of fact was made by the
applicant in paragraph~of exhibit attached to his application, which appli-
cation was subscribed and sworn to as true and correct.

Mr. Dean Pic'l, 140 West College Street, Covina, Attorney repre-
senting the applicant, requested permission to review the recommendations of
the Chief of Police, and after doing so, noted specific reference therein to
Section 4.l8.060 of the Anaheim Municipal Code, the ordinance prohibiting
"topless" entertainment in the City of Anaheim, and stated that upon their
application for Writ of Mandate the Court issued a temporary restraining
order on the enforcement of said ordinance, subject to posting of a $l,OOO.OO

bond; further, the Court pointed out that the first application for en-
tertainment permit had not specifically stated that the proposed dancing
would not be in violation of Section 647 (a) of the Penal Code; therefore,
the new application was the same as the first, altered only to indicate
that the entertainment proposed would not be in violation of Sections
647 (a), 311, or 314.1 of the Penal Code, nor of Anaheim Municipal Code,
Section 4.18.060.
Mr. Pic'l referred to the objections set forth by the Chief of
Police in his recommended denial of said application, requesting consid-
eration of the following points:
(1) That the decision of the Judge, on the application for
Writ of Mandate virtually put to rest the issue of violating Section
4.18.060 of the Anaheim Municipal Code.
(2) As to the potential violation of Section 647 (a) of the
Penal Code, he referred to two specific cases which had recently occurred
in nearby jurisdictions, and Mr. Pic'l pointed out that establishments
were currently operating in the counties of Orange, Los Angeles, Ventura,
and San Diego, with no violation of the law.
(3) With reference to the "false statement of fact" contained
in paragraph (h) of the exhibit attached to subject application, Mr. Pic'l
advised that the only citations issued to Mr. Stoops, in connection with
premises licensed to sell alcoholic beverages and provide entertainment
were those issued by the City in connection with the ordinance in ques-
tion.

Mr. Pic'l thereupon respectfully requested that the entertain-
ment permit be granted, noting the Council's right of review and possible
revocation in the event of a violation of the law.
In response to questions by Councilman Dutton, the City Attorney
advised that no court had declared unconstitutional the City's ordinance
governing "topless" entertainment; that the action taken by the court
was to temporarily restrain the enforcement of said ordinance until such
time as the court determines the constitutionality thereof. He thereupon
recommended that the City Council not issue a permit in violation of the
ordinance.
Councilman Dutton was of the opinion that the City Council would
be derelict in its duty if said permit were granted, contrary to the ordi-
nance.
Councilman Schutte moved that said permit be denied as recom-
mended by the Chief of Police. Councilman Dutton seconded the motion.
In response to Councilman Chandler, the City Attorney clarified
the actions against the petitioner and his employees, made by the City of
Anaheim, advising of the charges against those cited.
Mr. Pic'l again addressed the Council, giving further details of
the case, and expressed the opinion that under the circumstances the Council
would not be derelict in their duties by issuing the requested permit.
Question to the motion was called, and the motion carried.
RECLASSIFICATION NO. 61-62-51: Communication dated February 24, 1968, from
Mr. A.A. Edmondson, was submitted, requesting clarification of the zoning
on his property, located on the west side of Miller Street, north of Mira-
10ma Avenue.

Also submitted and reviewed by the City Council was report of
the Zoning Division, dated March 12, 1968, pointing out that the condi-
tions of M-1 zoning approval on subject property, under Reclassification
Proceedings No. 61-62-51, were never completed; that the use intended,
an equipment storage yard, was allowable, by right, only in an M-2 zone,

and if the M-1 zoning action were comp1eted,the granting of a conditional use
permit would be required for said use.
Zoning Supervisor Ronald Thompson, reported on numerous contacts
made by the staff with the petitioner, advising that Mr. Edmondson had been
informed of the zoning status on his property.
On motion by Councilman Chandler, seconded by Councilman Krein, the
Development Services Department was instructed to again communicate to the pe-
titioner the status of his zoning application. MOTION CARRIED.

FINAL MAP - TRACT NO. 6163: Developer - W.I.R. Developers, Inc.; tract located
at the northeast corner of Orange and Western Avenues, and contains 39 pro-
posed R-2, 5,000 zoned lots. (67-68-44).
The City Engineer reported said Final Map conforms substantially
with the tentative map previously approved; that bond has been posted and
approved; and required fees paid; and he recommended approval thereof.
On the recommendations of the City Engineer, Councilman Dutton
moved Final Map, Tract NO..6163 be approved. Councilman Krein seconded the
motion. MOTION CARRIED.
FINAL MAP - TRACT NO. 6409: Developer - C. Michael, Inc.; tract located at the
northwest corner of Ball Road and State College Boulevard, and contains 173
proposed R-l zoned lots; 19 proposed R-3 zoned lots; and 6 proposed M-l zoned
lots. (66-67-68 and Variance No. 1897).
The City Engineer reported said Final Map conforms substantially
with the tentative map previously approved; that bond has been posted and
forwarded to the City Attorney for approval; and required fees paid; and he
recommended approval thereof.

On the recommendations of the City Engineer, Councilman Dutton
moved that Final Map, Tract No. 6409, be approved, subject to approval of
required bond by the City Attorney. Councilman Krein seconded the motion.

PROPOSED JOINT COMPUTER OPERATIONS - CITY OF GARDEN GROVE: Council determina-
tion on proposed joint computer operations with the City of Garden Grove
was continued from the meetings of February 20 and 27 to this date for
further study and detailed analysis.
Attention was called to communication dated March 8, 1968, from
the City of Garden Grove, advising that the City Council of that city had
approved the proposed joint operation in principle.

The City Manager referred to the report submitted to the City Council
February 20, 1968, and advised that the concern was both an economic one and
a matter of increasing the sophisitication of the equipment used. That it was
proposed to progress from the present I.B.M. 1440 to the "third generation"
type of equipment, which would provide better operations; It was his recom-
mendation that the City move to the next level of computer systems as soon
as possible, and all future programming be done with the faster, higher level
equipment in mind.
Councilman Krein reported on recent visit to the data processing
plant with which Mr. Mauerhan was associated, and further reported on his
consultation with the Finance Director. It was his opinion that the City's
Staff had valid arguments for the proposed joint data processing operation,
and that the City Council should concur with their recommendations.

Councilman Dutton stated he would not like to see a hasty Council
decision reached on this issue, that he personally felt he had not sufficient
information to make a decision and it was his obligation to be sure of the
facts before voting on a matter. He questioned how spending funds on a facil-
ity located outside the city limits might be justified.
The City Attorney noted that the proposal would fall under a cate-
gory of mutual benefit, and might be accomplished under a joint powers agree-
ment.
Councilman Chandler expressed a desire for more detailed informa-
tion and related certain questions which he wanted answered.
With reference to the possibility of cities other than Garden Grove
becoming involved with a central data processing operation, Mr. Murdoch ad-
vised that the City of Garden Grove was the only one whose data processing
operations had progressed to a degree to consider such a proposal. He stated
that if the City Council approved the concept of the proposal, the operational
details would then be worked out and established.

Mayor Pebley felt the City should continue present operations with
the future possibility of progressing to the next higher level equipment with-
out another entity involved. He stated he was not ready to make a final de-
cision without having more knowledge on the subject.
Councilman Schutte stated he did not have sufficient information
to make a determination at the present time; however, if the City was to
combine operations with another city, perhaps all Orange County cities
should consider a joint facility.
Finance Director, Douglas Ogden, advised that the proposed 24-hour
operation would run seven days a week, the City of Anaheim to have use of the
computer for 12 hours per day. Further, to include even a third city, that
time would necessarily be reduced until such time as expansion of the equip-
ment was warranted. He noted that in order to go into greater detail, pin-
pointing costs, etc., an expression from the Council relative to the concept
would first be necessary.
Councilman Chandler called attention to some of the possible pit-
falls in the proposed operation and stated it would be well to first have
the study and the proposed contract before approving the concept.

Mr. Murdoch asked if the Council objected to a more intense survey
to provide more detailed answers to questions raised; possibly including
initially a proposed agreement between two cities, with a provision for add-
ing other cities.
Councilman Dutton stated he would like the analysis to include the
service potential.

Mr. Vince Carl, 2633 Whidby Lane, President of Management Com-
puter Services, requested permission to address the Council, noting that
his firm had submitted a proposal to the City of Anaheim to provide com-
puter services, including office space, if desired. He called attention
to costs of operating the third generation computer equipment, and pointed
out the advantages of using the service, paying only for the time the ma-
chines were actually used, thereby determining, at a minimum risk, whether
the more sophisticated machines woulc:bbe feasible-for the.City.
At the conclusion of the discussion that followed, it was the
consensus of the City Council that a detailed study be conducted, con-
trasting costs and other factors, considering the proposed joint opera-
tion and proposals received from private service organizations.
GROUP INSURANCE - ACCIDENTAL DEATH POLICY: On report and recommendation of
the City Manager, Councilman Schutte moved that the City Council approve
expansion of Travelers Insurance Policy No. GA-764993 for additional
coverage, to include Assistant Department Heads and Division Heads in
the $50,000.00 accidental death coverage; and further moved that the
City Manager be instructed to execute said rider on behalf of the City.
Councilman Chandler seconded the motion. MOTION CARRIED.
REQUEST - ANAHEIM STADIUM AND CONVENTION CENTER: Councilman Dutton requested
that a study be conducted to determine the economic impact of the Stadium
and Convention Center upon the City of Anaheim.
ADJOURNEMENT: Councilman Krein moved to adjourn. Councilman Schutte seconded
the motion. MOTION CARRIED.

the reading in full of all ordinances and resolutions, and that consent to

REPORT - FINANCIAL DEMANDS AGAINST THE CITY: Demands against the City in the
amount of $637~698.72, in accordance with the 1967-68 Budget, were approved.
PUBLIC HEARING -RECLASSIFICATION NO. 67-68-50 & VARIANCE NO. 1948: Submitted by
Robert Wasserman, requesting change of zone from C-1 to R-3, and waiver of
maximum building height within 150 feet of R-A zoned property; property
briefly described as located on the east side of Knott Avenue, south of
Lincoln Avenue.
The City Planning Commission, pursuant to Resolution No. PC68-45,
recommended approval of said reclassification, subject to the following con-
ditions:
l. That the owner of subject property shall deed to the City of
Anaheim a strip of land 64 feet in width for the extension of Del Monte Drive
through subject property.
2. That the owner of subject property shall deed to the City of
Anaheim a strip of land 20 feet in width, including standard alley cutoffs
along the northerly and easterly property lines for alley purposes.
3. That street improvement plans shall be prepared and all en-
gineering requirements of the City of Anaheim along Knott Avenue, the exten-
sion of Del Monte Drive, and the proposed alleys, such as curbs and gutters,
sidewalks, street grading and paving, drainage facilities, or other appur-
tenant work shall be completed as required by the City Engineer and in ac-
cordance with standard plans and specifications on file in the office of the
City Engineer, and that a bond in an amount and form satisfactory to the City
of Anaheim shall be posted with the City to guarantee the installation of
said engineering requirements.
