ONMENT: Pursuant to Resolution No. 6~R-317 duly published in the Anaheim Bulletin May 21, 1964, and notices thereof posted in accordance with law, public hearing was held on the proposed abandonment of a sortion of Alro Avenue, and an unnamed street extending southerly thereof (Clementine Street extension). A. Ward, President of Altec Lansing Corooration, requesting public hearing on proposed abandon- ment be further continued to be considered in conjunction with Condi±ional Use Perm&t No. 57~, as the same traffic circulation problems were involved, was superseded by letter filed this date withdrawing all objections ~o the proposed abandonment of Alto Avenue as result of an agreement and easement ~rom Mro Leo [reedman providing access from his property to the rear parking lot of the Altec Lansing Corporation property. Copies of report from the City Engineer were-furnished each Council- man wherein it was recommended, should the Council authorize the requested abandonment, the following considerations. (a) A minimum of one lane of be required 34-foot roadway, with no parking permitted, providing traffic in each direction, together ~ith left-turn bays for eas~-west Alto Avenue, and the north-south Alto Avenue. (b) That a 20-foot wide storm drain, along the north and west lines of to the C sewer and public utility easement, the Freedman development be granted 786~ (c) Ihat the north-south portion of Alto Avenue (unnamed street, extension of Clementine Street) not be abandoned. Mayor Pro Tern Dutton asked if anyone wished to address the Council.' Mro Leo Freedman advised that the 25-foot easement granted the Altec Lansing Corporation was satisfactory to all parties concerned. Further, he has agreed to make necessary provisions for t~e drainage and disposal of surface waters over his property, the method to be employed to be a part of the variance. Mr. Freedman stated that he objected to the City retaining the street area running north and south and could see no reason that this portion should not also be abandoned. He thereupon requested Council action on Conditional Use Permit 574 at this time, as schedule provided for the opening of the Hotel, ..June 1965o The City Planning Commission Resolution No. 1185, Series 1963-64, scheduled for Council consideration June 30, 1964, setting forth their findings and conditions under which Conditional Use Permit No. 574 was granted, was submitted and read. Mayor Pro Tem Dutton referred to the City Engineer,s report, noting the recommendations for the provisions of traffic circulation and drainage, and asked Mr. Freedman if he had read the report. Mr. Freedman replied that he was aware that some of these problems would be presented to the City Council and as he explained to /he Engineer, in his opinion the traffic flow and the drainage problem was definitely a part of the property and are matters of his concern° He further advised of his intention to extend Freedman Way easterly to Manchester Avenue and the two streets purchased by him from the Southern California Edison Company, which are bonded to insure improvement, in his opinion would accommodate traffic flow~ Discussion was held concerning the request for. Council expression on the conditional use permit and abandonment of Alto Avenue, and Mr. Geisler advised that if the abandonment was accomplished, the proceedings must contain all requirements relative to required easements for drainage as there was a possibility that the conditional use permit may never be completed; the Council, after review of the action taken by the City Planning Commission on the conditional use permit, could express their intention, however, it would in no way preclude a public hearing in the event an appeal was filed. Any further expenditure of funds on the project would be at the risk of the applicant. At the conclusion of the discussion, on motion by Councilman Krein~ seconded by Councilman $chutte, this issue was continued to .the 7:00 O~Clock session of this meeting to allow for the preparation of necessary requirements, should the abandonment be approved by the City Counc i 1. He stated that Freedman Way was projected to be co~'tinued and developed easterly to Manchester Avenue~ and that an agreemept has been made for the handling of drainage, however, he preferrea the drainage easement to be a floating easement,~ Mr. Maddox advised that the drainage easement may be established 100 feet to 200 feet east of the westerly boundary of the property, ~ending on 'the depth of the necessary storm drain. However, other utility easements may be required for ..electrical and gas services. Teague, of the Anaheim Bulletin, addressed the City' Council requesting that the Press be allowed ~o attend meetings of the Non Profit Corporation in order to be ~nformed of 'Corporation activities. Mr, Dave Roque, o± the Garden Grove Daily News, indicated his concurrence with Mr. Teague?s request~ The City Manager advised that meetings of the Corporation are open and the Press should be invited to attend; however they have not been invited to various committee meetings which have been held for the purpose of accumulating factual information precedent to making f~ndings and commendations to 'the Corporation, it was determined that the matter of Press attendance be further considered at the next meeting of the Non-Profit Corporation, Thursday, June 18, !964.
