RESOLUTION OF CONDOLEI~E WHEREAS, the City Council of the City of Anaheim has learned with sorrow of the death of Mr. F. A. Yungbluth, and ~ WHEREAS, Mr. Yungbluth, affectionately known as "Fritz", will be remembered as an active pioneer citizen and community leader, serving the City of Anaheim as City Councilman from December 14, 1932 to April 21, 1942, and WHEREAS, his long and important association and helpful guidance in matters affecting his beloved city has contributed greatly to the growth and development of Anaheim! NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it deeply mourns the passing of Mr. F. A. Yunghluth and extends deepest sympathy to his wife and family, and BE II FURTHER RESOLVED that this resolution be spread upon the minutes of the City Council and a copy thereof forwarded to his wife, Adella. RECLAF~IF~OAIION NO. ~$r~4-44 AND VkRIANC~ NO, 1605 - EXTENSION OF TIME~ Request for extension of time to comply with requirements contained in Resolution No. 64R-101, was submitted by Clifford 3. LaBorde. Mr. 3chh MacDonald, 1831 West Katella Avenue (Checkmark Realty), representing the applicant, advised that an extension is necessary to complete financing arrangements on the project. He also advised that a firm commitment has now been received and that it was believed that the project will be started within 90 days° Ntt. Dawson, Assistant City Attorney, reminded Mr. MacDonald that all requirements of Resolution No. 64R-101 such as necessary dedication, must be complied with prior to actual reclassification of the property. On motion by Councilman Pebley, seconded by Councilman Krein, 90 days extension of time was granted to Reclassification No. 63-64-44 and Variance No. 1605, subject to compliance with dedication requirements (Conditions Nos. 1 and 2 of Resolution No. 64R-101) within a reasonable time. Reed, 3r,, requesting waiver of maximum coverage to permit the construction of an addition to an existing residence briefly described as located on the east side of Fairview Street, approximately 193 feet north of Katella Avenue (914 Fairview Street). The City Planning Commission pursuant to Resolution No, 1287, Series 1964-65, granted said variance° yARIANCE NO~ 1654: Initiated by the City Planning Commission to permit a barber shop and beauty shop, on property recommended for C-O zoning, iocated on the west side of Lemon Street approximateI¥ 455 north of Anaheim Boulevard (1129 North Lemon Street). The City Planning Commission pursuant to Resolution No.. 1286, Series 1964-65~ granted said variance for a period of two years. The City Council at their meeting held August 4, 1964, adopted Resolution of Intention to rezone subject property C-2, in accordance with reclassification application No. 63-64-124 (Joe Ac Cano). It was recognized that variance would not he needed with the finalization of said reclassifi- cation° No further action was taken by the City Council on Variances Nos. 1651, 1652 and 1654. CONDITIONAL USR PERMIT NO. 544: Submitted by Elbert L. and Lida Smith (Harvey Hiers et al, Agent) permitting construction of an 82 unit motel in conjunction with a family restaurant, on property located at the southeast corner of Harbor Boulevard and Manchester Avenue, was granted by the City Planning Commission pursuant to Resolution Noo 1095, Series 1963-64. City Planning Commission Resolution No. 1293, Series 1964-65, was submitted for Council information amending Resolution No° 1095 by the addition of Condition No. 11, providing for the termination of said conditional use permit upon 'the expiration of the 45 year lease unless dedication of necessary right-of-way for street widening is obtained from the fee owner of the property~ The City Engineer recommended said conditional dedication not he accepted and that Condition No. 1 of City Planning Commission Resolution No. 1095 he required. Discussion was held by the City Council and the possible problems that could he created at the end of the lease period considered. At the conclusion thereof, Mayor Chandler was of the opinion that the action of the City Planning Commission in amending conditions of Conditional Use Permit Nco 544 was null and void, and thereupon requested the City Clerk to set said issue for public hearing before the City Counci~ subject to City Attorney ruling on the legality of the proceedings~ p~OPOSED A~NDN~NT -CHAPTER 18o40 (C-i~ G~NERAL CON~ERCI$.L ZONE).:. Mayor Chandler noted that the suggested amendment would only change the existing Mutual Aid Agreement by the addition of "rescue=, that all other provisions would remain the same, that is, the City would only respond after the resposihle entity has arrived and requested assistance. At the conclusion of the discussion, on motion by Councilman $chutte, seconded hy Councilman Krein, the City Attorney was directed to prepare an ordinance advising of the City's willingness to change the Mutual Aid Agreement in order to effectuate the purpose, to save life at any cost, and that we agree to the necessary changes which will cause our rescue units, not already in use, to roll upon direct call whether it is inside or outside the City limits° MOTION CARRIED. .RECESSl Councilman Krein moved to recess to 7t00 O'Clock PoM. Subaitted by Title Insurance and Trust Company (County of Orange, Authorized Agent), requesting permission to establish a refuse transfer station on property presently zoned briefly described as located on the south side of Katella Avenue, bounded on the east hy the Anaheim City Limits, on the west by the proposed Orange Freeway Right-of-Way, extending southerly to the Atchison, Topeka and Santa Fe Railroad Track (2600 Katella Avenue). The City Planning Commission pursuant to their Resolution No. 1242, Series 1964-65, denied said Conditional Use Permit. Review of action taken hy the City Planning Commission was ordered by the City Council and public hearing scheduled. Mr. Mrefdt noted the location of subject property, and in Sum- marizing the public hearing held before the City Planning Commission, noted the findings made hy the Commission. Letters in opposition were received from George E.. Strachan, General Manager, Anaheim Chamber of Commerce, and R. W. Koch, Road Commissioner and County SurveYor, addreSSed the Council and read into the record a prepared statement briefly reviewing events up to the present time regarding the proposed trash transfer station.. He referred to an exhibit of the County of Orange Master Plan of Refuse Disposal, noting the limited available areas and the necessity of establishing a total of four transfer stations to accommodate the western portion of the County, which is considered "the long haul zone" (subject site to he Site No. 3). Pictures of two existing transfer stations were submitted, and with the aid of a large map the area to he served from Site No, 3 noted. Mr. Koch reported that Site No. 3 was located as close to the geometrical center of the area as possihle~ Said prepared statement summarized briefly the Justification for the granting of said conditional use permit, and requested that the City Planning Commission's decision he reversed. In answer to a question of CounciLman Pebley regarding activity, Mr, Koch advised that it was estimated that a maximum of 150 trips daily would be made to the transfer station~ or 300 movements. Discussion was held concerningpossib~ traffic congestion during activity at the Anaheim Stadium, and Mro Koch noted alternate routes~ available for access to the transfer station site. Mayor Chandler referred to Downey Transfer 'Station advising that although it was not urattracti've, in his opinion the proposed transfer station would be uha'ltractive from the level of the proposed freeway. Mr. Koch further advised that every mile away from the geometrical center area cuts the economy of the transfer operation and the potential savingj one mile distant would cut the saving approximately one~half~ Discussion was held hy the City Council pertaining ±o the Anaheim Stadium proJect and other pending and potential development of subject area, which could be materially damaged or abandoned h¥ the es±ahlishment of a trash transfer station~ Mr. Koch advised that in his opinion the land use already established east of the proposed Orange Freeway would not he affected or changed because of existing uses. N[ro Kreidt reported that there were three areas still to be considered by the Planning Commission which were as follows= The question of height limitation not only to the existing berm, but to future expansion areas° 2o Limitation of height from the peripheral residential area° 3~ Limitation of height upon the Disneyland Park itself.
