Discussion on various sections of the proposed amendment was held and Mr, Allan Short further explained certain recommendations as proposed by the City Planning Commission. Attention was called to Joint work session with the City Planning Commission~ scheduled at 10:00 A.M., September 22~ 1964, for the purpose of discussing certain amendments to the Zoning Code, and it was suggested that the proposed C-1 amendments be included in said work session. CONTINUED.PUBLIC HEARING = RECLASSIFICATION NO~ 63Z64-118 AND CONDITIONAL USE P~RMI I NOg 573 (PLAN ST.tDY NO~ 71-33=1)~ Initiated by'the City Planning Commission to consider change of zone from R-A, C=i and C~3 to C=l, and permission to operate a wheel alignment and brake adjustment shop, property briefly described as located on the west side of Brookhurst Street, extending southerly from the Orange County Boundary Line (South of Broadway) to Orange Avenue (403 ~ 533 South Brookhurst Street)° Public hearing was held July 14, 1964, continued to August 4, and further continued to August 25, 1964, and to this date to consider amendments recommended by the City Planning Commission to the provisions of the C=I zoning° The Mayor asked if the applicant wished to address the Council. Mro Joseph Sahagen, 12680 Kona Drive, Garden Grove, owner of a portion of subject properties, advised that his was the only vacant parcel included in subject reclassification~ that his plans were to construct a commercial building, and he requested Gouncil authorization of a temporary building permit therefor, pending the completion of rezoning procedures, ~ro Kreidt noted the location of subject properties, calling attention to Plan Study No. 71-33-1, posted on the east wall of the Council Chamber, and identified the Sahagen property as parcel No. 8 on said Plan Study. The Mayor asked if anyone else wished to address the Council for or against the proposed reclassification, there being no response, declared the public hearing closed~ RESOLUTION NO. 64Rr655~ At the conclusion of Council discussion, Councilman Krein offered Resolution No. 64R-665 for adoption, authorizing preparation of necessary ordinance changing the zone as requested subject to the following conditions: That prior to the reading of the ordinance on any portion of subject property, a legal description shall be furnished, showing a legal vesting of title, legal description, and a map of the property° That prior to the reading of the ordinance on any portion of subject property, said property shall conform to all provisions of the C-l, Neighborhood Commercial Zone. On motion by Councilman Krein, seconded by Councilman Pebley, .said sign permit was granted for a period of six months, subject to the posting of a $100 bond, and to execution of a Hold Harmless Agreement by the applicant. CONDITIONAL USE PER, II NO, 531 ~ EXIENSION OF TI~E: Communication dated August 20, 196~, from Reverend Bill 3o White, Pastor of the First Baptist Church of Stanton, was submitted requesting an extension of time to Conditional Use Permit No. 531, for compliance with certain conditions thereof. It was the finding of the City Council that the Church has been actively proceeding with the conditions of Conditional Use Permit No. 531, and on motion by Councilman Schutte, seconded by Councilman Krein, 180 day extension of time was granted. R~CLASSIFIC~IION NOo 59=60~53 = EXTENSION OF TI~ Communication dated August 13, 1964, from Joseph Jo Loza~ requesting one year extension of time to improvement bond filed in connection with Reclassification No. 59-60-53, was submitted. On motion by Councilman Pebley, seconded by Councilman Dutton, one year extension of time to the improvement bond was granted by the City Council, subject to the filing of C-1 Deed Restrictions and payment of street lighting fees, as required pursuant to Resolution No. 6016, within 30 days from this date. Application files were reviewed and the Council indicated that it was their intent to omit %he condition on the variance relative to dedication and improvemen~ of the 20-foot alley along the west property line~ and that Condition No.. 7 of Resolution No. 64R-653 should read as follows~ "That a vehicular access way shall be developed on subject property with location, length, and turn-around area of said access way to be subject to the approval of the Fire Chief, to insure adequate fire protection, and the Director of Public Works, to insure adequate trash collection." Further discussion was held regarding the future rezontng of sur- rounding properties, and at the conclusion thereof, it was moved b~Councilman Dutton, seconded by Councilman Pebley, that the wall to be constructed around subject property, as required by the Anaheim M~ntcipal Code, be waived for a period of two years, or such lesser time as the City Council may determine, subject to the posting of a bond guaranteeing the construction thereof° MOTION CARRIED. ORANG]~ COUNTY TENTATIVE TRACT NO~ ~748~ Property located on the south side of Orange Avenue, 1,080.87 feet west of Brookhurst Street, and is proposed for subdivision into 8 R-1 lots~ Mr'o Kreidt submitted subject tract map f9~ Council review. He noted the location of the property in question, and reported the City Planning Com- mission at their meeting of September 14, 1964, recommended approval of said Orange County Tract, subject to the fo~lowing recommendations~ 1. That Street "A~' be a minimum width of 56 feet to provide a 36=foot road- way with lO-foot parkways° 2. That the cul-de-sac be a minimum radius of 48 feet, in order to provide a curb radius of 38 feet with a lO-foot parkway, That the "not-a-part~ be included within the subdivision as a recorded lot within the tract, or the dedication and improvement of Orange Avenue he provided. 4, That sidewalks he constructed along Orange Avenue and Street "A". 5. That utilities he provided hy the City of Anaheim as stipulated on the tentative map. 6. That street improvements be constructed to the requirements of the City of Anaheim as set forth in the City's utilities agreement pending annexation. 7. That Lot Nos. 4 and 6 he re-designed to provide lot widths in accordance with the City of Anaheim's requirements.
