Mayor Chandler called the meeting to order.
~INUTES: Minutes of the Anaheim City Council meeting held November 24, 1964~
were approved on motion by Councilman Dutton, seconded by Councilman
Schutte. Councilman Krein abstained from voting on said motion. MOTION
CARRIED.
PROIEST - WEED ABATEMENT CHARGES= Communication dated November 27, 1964, from
N. A. Fitzgerald, Secretary, Union Development Company, Inc.~ owners of
property located at 3302 Brady Street (A.P. #79-272-33), was submitted,
protesting the charges for weed abatement in the amount of $297.20, as
assessed by the Department of Public Works. Also submitted and reviewed
by the City Council were reports from the Director of Public Works and of
the Sanitation Division, together with the following exhibits~
Exhibit "A" - Copy of "Notice to Destroy Weeds".
Exhibit "B" - "Supplemental Information".
Exhibit "C" - Photographs of subject property.
Mr. N. A. Fitzgerald, 8555 Artesia Street, Bellflower, stated
that in the past, Union Development Company, Inc., has found it economical
and convenient to have the appropriate governmental agency abate weeds on
their large corner lot; however the billing for said weed abatement has
been approximately $16 per year. In his opinion, an error has been made,
as the rear half of the lot was sold approximately a year ago to Southern
California Water Company for service to the adjacent subdivision, and there
is no physical method whereby the division of property can he seen; and he
felt that his company had been charged for a portion of the abatement which
rightfully should he assessed to the Water Company,
Mr. Thornton E. Piersall reported that the debris removed by the
City's subcontractors crew was on the front portion of the property, while
some concrete material (noncombustible) on the rear portion of the lot was
not removed, since it does not constitute a fire hazard. He noted that in
addition to the posting of the property with a notice, the Public Works
Department mailed a "Notice to Destroy Weeds" to the owner of subject
property.
At the conclusion of the discussion, Mr. Piersall stated that
the Sanitation Inspector would be willing to visit the property with Mr.
Fitzgerald and relate the photographs to the terrain to insure that billing
was correct.
It was determined by the City Council that if the property owners
can show that an erroneous charge has been made, to the satisfaction of the
Director of Public Works, the matter can. he resolved administratively.
No further action was taken by the City Council.
RECLASSIFICATION NO. 63-64-77 AND CONDITIONAL ~SE PERMIT NO, 532 - REVISED PLANS;
Revised plans submitted by 3. H. Hedrick Company, in connection: with
Reclassification No. 63-64-77 and Conditional Use Permit No. 532, were
reviewed by the City Council together with reports from the City Engineer and
Planning Department-Development Review. (R-3, Multiple Family Residential
Development located at the southwest corner of Crescent Avenue And Gilbert
Street).

Mr. Harry Knisely, Attorney representing the developer, displayed
a rendering, in color, of the proposed building elevations and was of the
opinion that the changes would result in a hatter development.
Discussion was held concerning the architectural changes to the
elevation plans, and the proposed reduction in recreation areas, and Mr,
Knisely advised that the open green areas were reduced from 1,070 square
feet to 1,010 square feet primarily to accommodate the 27 foot radius turn-
arounds for trash trucks and emergency vehicles, as required hy the City
Council~ that there is no change in the number of units proposed,
On motion by Councilman Krein, seconded by Councilman Schutte,
the City Council found that no substantial change had been made to the plans
originally approved hy the City Council under Reclassification No. 63-64-77
and Conditional Use Permit Noo 532. MOTION CARRIED.
Councilman Schutte moved that revised plans marked Revision No. 1
Exhibits Nos. 1 through 11, he approved° Councilman Krein seconded the motion.

ORDINANCE NO. 2082: Councilman Schutte offered Ordinance No. 2082 for first
reading.

After hearing read in full the title of Ordinance No. 2082 and.
having knowledge of the contents therein, Councilman Dutton moved the

submitted to the City Council for information at the meeting held November
24, 1964, at which time the Council took no action.

Excerpt from the minutes of the City Planning Commission meeting
held November 23, 1964, was submitted, terminating all proceedings on
subject reclassification as requested hy the petitioner, said termination
to be without prejudice.
The City Planning Commission, 'pursuant to Resolution No. 1432,
Series 1964-65, recommended disapproval of General Plan Amendment No. 23.
On motion by Councilman Pebley, seconded by Councilman Krein,
the City Council terminated all proceedings on Reclassification No, 63-64-122
and General Plan Amendment No. 23, without prejudice. MOTION CARRIED.
PLANNING STUDY NOo 75=113=i (TRACT NOo 2688): Excerpts from the minutes of the
City Planning Commission meeting held November 23, 1964, was submitted,
recommending adoption of Planning Study No. 75-113-1, Exhibit "B", as the
heat possible method of developing property adjacent to five lots recently

approved for C-1 zoning ~ eclassification No. 64-65-23) for the ultimate
extension of the existing north-south alley through Lot No. 3, Tract No. 2688
(East of State College Boulevard, between Westport Drive and Virginia Avenue).
~tr~ Mickelson called attention to Exhibits "A" and "B", posted on
the east wail of the Council Chamber, and noted the remaining R, 1 parcel
fronting on State College Boulevard and extending west to Reseda Street,
south of Westport Drive~ He advised that in the event said R-1 parcel is
developed for a use other than R-1 (State College Boulevard frontage), a
logical separation would be to extend the existing north-south'alley
through the property, abandon the east-west alleys, which extend
along the north and south boundaries of said property. It was further
noted that if the 20 foot east-west alleys were abandoned by the City,
and 10 feet of each was absorbed by lots 13 and 14 (fronting on Reseda
Street), the remaining I0 feet of each alley being abandoned to lot 3,
there would be sufficient area therein to subdivide that portion of lot 3
adjacent to Reseda Street for two single-family residential lots.
At the conclusion of Council discussion, Councilman Dutton
moved that Planning Study No. 75-113-1, Exhibit "B" be approved hy the
City Council. Councilman Pehley seconded the motion. MOTION CARRIED°
TEN/ATIyE MAP - TRACT NO. 4239: Developer, Shattuck and McHone, tract located
at 3730 West Ball Road, and contains 20 proposed R~I lots (filed in
conjunction with Reclassification No. 64~65~61 and Variance No. 1672).
Pursuant to communication received December 11, 1964, GQpncilman
Dutton moved Tentative Tract No. 4239 he continued, to he considered in
conjunction with Reclassification No. 64-65-61 and Variance No. 1672.

The City Planning Commission pursuant to Resolution No~ 1350,
Series 1964-65, recommended approval of Area Development Plan No. 11,

That any development proposed for subject properties be required to
include as part of the development proposal provision for a standard
width 20-foot alley with setbacks adequate to make provisions for a
25-foot vehicular turning radius,
That the alley he improved to conform with the limits of the additional
dedication and the power poles he relocated hy the City to conform to
the southerly boundary of the additional dedications said improvements
to he accomplished subsequent to complete dedication of the additional
6-foot of alley right-of-way.
That as development progresses through the remaining parcels of subject
property, the property owners he ehcouraged to utilize as few driveways
as possible, ioe., if property owners collectively develop their parcels
that the number of driveways which presently exist he reduced in order
to minimize the number of possible vehicular conflict points and still
provide adequate vehicular circulation to the parcels, further that
singly developed parcels should he encouraged to arrive at an agreement
with adjacent property owners to utilize accessways which have been
constructed on abutting properties.
Public hearing was continued from the meeting of November 4, 1964,
at the request of the authorized agent.
Mr. Mickelson noted the location of subject property and the
existing uses and zoning in the immediate area. He referred to Area
Development Plan No. 11, posted on the east wail of the Council Chamber,
noting the 14-foot, east-west alley north of subject property which expands
to 20-feet in width at a point approximately 185-feet east of Citron Street.
He called attention to the Planning Commission's finding that reclassifica-
tion of subject property would require dedication and improvement of an
abutting alley, said alley being necessary for provision of secondary
circulation for the area.
Mayor Chandler asked if anyone wished to address the City Council
in opposition to the proposed reclassification, there being no response,
asked if the applicant or his agent wished to address the City Council.
Mr. Ulysses f. Bauer, Architect and Authorized Agent, 940 West
Broadway, indicated his presence for the purpose of answering any questions.
Mayor Chandler noted that if the requested C-0 zoning is approved,
the balance of the properties on the block will he used for similar purposes
eventually, and asked why block walls were'recommended hy the Planning
Commission.
Mr. Bauer indicated the applicant was willing to post necessary
bond to insure installation of said wall, but was of the opinion that the
walls would detract from the attractive landscaping and residential
atmosphere of the area, that actual installation thereOf was a matter
that should be subject to agreement between the commercial developer and
the residential property owners. He further advised that there presently
exists a dense 6-foot hedge along the west property line.
Mr. Mickelson reported that the purpose of the block wall
requirement was to provide some protection for the neighboring properties
which may remain residential for some time. He noted that the C-O zone
requires a block wall adjacent to residential property, and that bonding
therefore is provided for in said zone.
Mayor Chandler declared the public hearing closed.

Pursuant to Resolution No. 1424, Series 1964-65, the City Planning
C6mmission denied Variance No. 1657! and pursuant to Resolution No. 1425,
Series 1964-65, recommended that General Plan Amendment No. 32 he disapproved.
Mr. Mickelson noted the location of subject property and the
existing uses and zoning in the immediate area, summarizing the evidence
submitted to and considered hy the City Planning Commission, He advised
that original plans submitted were for a ten-unit, two-story apartment
building, with 12 parking spaces in lieu of the 14 spaces which would he
required hy the Anaheim Municipal Codet that revised plans were presen$ed
at the continued public hearing before the Planning Commission, at which
time the plans reflected 14 multiple-family residential units, and it was
proposed to remove the existing dwelling.
The Planning Commission requested further revision to plans to
single-story development, however at a subsequent hearing, the applicants
requested that the original plans be considered. In the recommended
approval of said reclassification, the Planning Commission stipulated
single story construction.
Mr. Mickelson further advised that since the time the variance
application was filed, the zoning code has been revised to allow carports
as a matter of right in conjunction with R-3 developments.
Attention was called to the General Plan, which indicates low
medium density in subject area, and Mr. Mickelson reported that the
Planning Commission felt no change thereto would be warranted by the
proposed reclassification.
Mayor Chandler asked if anyone wished to address the Council in
opposition to the proposed development.
Mr. W. S. Griffith, 406 West Vermont Street, owner of R-1 property
adjacent to the east, voiced his objection to the proposed reclassification,
and particularly to two-story construction, and he noted nearby vacant land
which he felt was more suitable for such a development. He requested that
if the R-3 zoning is approved, it he limited to single-story construction
with a block wall to protect his property.

- - ' Mrs. Clementine Roberts, 410 West Vermont Street, addressed the
Council in opposition to the proposed development, being of the opinion that
in time, subject property could he developed for a higher and more suitable
use. She requested protection of her privately owned irrigation water line,
which extends across the front of subject property.
The Mayor asked if the applicant or his agent was present and
wished to address the City Council.
Mr. John Haggerty, attorney representing the petitioners, advised
of the multiple-family development to the east of subject p~operty, and of
two-story multiple-family properties on Harbor Boulevard, as well as motel
and other apartments on Vermont Street west of Harbor Boulevard. He reviewed
the proposed density and lot coverage of the ten-unit development,
and adViSed ihe existing single-family residential dwelling would remain on
the property and it was expected to he occupied hy the property owner. In
their opinion, the plan was logical and aesthetically acceptable.
Council discussion was held regarding the single-story recom-
mendation from the City Planning Commission, and Mr. Haggert¥ requested
that the City Council consider the original two-story ten-unit plans, and
if said development could not he approved, he further requested that the
zoning application he denied rather than limiting the development to single-
story construction.

4. That the owners of subject property shall submit an irrevocable offer
of a deed of easement for alley widening purposes, provided however,
that no permanent underground storage facilities shall he located in
the proposed easement.
5. That Condition Nos. 1, 3, and 4, above mentioned, shall he complied
with within a period of 180 days from date hereof, or such further
time as the City Council may grant.
6. That subject property shall he developed substantially in accordance
with plans and specifications on file marked Exhibit Nos. 1, 2, and 3,
and further provided, that subject property shall he developed in
accordance with the service station site development standards.
Pursuant to Resolution No. 1406, Series 1964-65, the City
Planning Commission granted Conditional Use Permit No. 632, subject to
the following conditions:
1. That trash storage areas shall be provided in accordance with approved
plans on file with the office of the Director of Public Works prior
to final building inspection.
2. That this conditional use permit is granted subject to the completion
of Reclassification No. 64-65-39.
3. That subject property shall be developed substantially in accordance
with plans and specifications on file marked Exhibit Nos. 1, 2, and 3,
and further provided, that subject property shall be developed in
accordance with the service station site development standards.
4. That a six-foot masonry wall shall be constructed along the north and
west property lines, provided however, that said wall on the west
property line shall be removed at the time the City deems it necessary
to widen the existing alley to 20 feet, prior to final building
inspection of the proposed service station.
General Plan Amendment No. 42 was disapproved by the City Planning
Commission, pursuant to Resolution No. 1407, Series 1964-65.
Subject property was located on the sectional zoning map posted
on the east wall of the Council Chamber,~ and Mr. Mickeison briefed the
evidence submitted to and considered by the City Planning CommiSsion. He
reported that the applicant proposed to move his dwelling to the north in
order to provide a barrier between the proposed service station and other

residential prOperties further north. Concerning the General Plan Amendment,
the Planning Commission felt a change would not be warranted by the granting
of subject applications,, but that said amendment should be further considered
at the annual review.
Plans and the files were reviewed by the City Council, and the
Mayor asked if anyone wished to address the City Council in opposition to
the proposed service station, there being no response, asked if the applicant
had additional information to offer.
Ntt. Fred B. Morley, 501 North East Street, in answer to Council
questioning, advised that the person who appeared before the Planning
Commission in opposition to the applications resided at 520 North Rose Place,
approximately one block north and west of subject property.
Mayor Chandler asked if anyone else wished to address the City
Council, there being no response, declared the public hearing closed.

' Further discussion was held by the City Council concerning
Condition No. 4 of the conditional use permit, and consideration given to
allowing a bond to be posted in lieu of actual construction of the wall
at this time,
Ntt. G. S. Mason, representing Richfield Oil Corporation,
noted the dimensions of the property and the proposed rear entry to the
station which requires sufficient turning radius. It was his understanding
that the Planning Commission was in favor of widening the entire alley at
one time at a future date. He stated they were agreeable to immediate
construction of the wall on the west property line..
At the conclusion of the discussion, it was determined that
the conditions of the Reclassification and Conditional Use Permit remain
as recommended by the City Planning Commission.
PUBLIC HEARING - RECLASSIFICATION NO, 64-~5-4~ AND QONDITIONAL USE PERMIT

A, Johnson, requesting change of zone from C-1 to C-3; property briefly
described as located on the west side of Anaheim Boulevard, north of Ball
Road (1107 South Anaheim Boulevard).
The City Planning Commission pursuant to Resolution No, 1408~
Series 1964-65, recommended approval of said reclassification, subject to the
the following conditions:
1.: That the owners of subject property shall deed to the City of Anaheim
a Strip of land 53 feet in width, from the center line of the street,
along Anaheim Boulevard for street widening purposes..
2. That the owners of subject property shall pay to the City of Anaheim
the sum of $2.00 per front foot along Anaheim Boulevard, for street
lighting purposes.
That the owners of subject property shall pay to the City of Anaheim
the sum of 155 per front foot along Anaheim Boulevard, for tree planting
purposes.
4. That the sidewalks and driveways shall be installed along Anaheim
Boulevard as required hy the City Engineer and in accordance with
Standard plans and specifications on file in the office of the City

Mr. Mickelson noted the location of subject property and its
proximity to existing Co3 zoning to the south and across the street to the
east. He called attention to the 6~foot parking=landscaping zone on adjacent
properties to the north and south, and referred to the Planning Commission
minutes of November 9, 1964, wherein the petitioners stipulated to the
provision of said 6~foot parking-landscaping zone on subject property,
although the Planning Commission resolution did not specifically recommend
C-3 with the 6-foot parking°landscaping zone. He was of the opinion that
said 6-foot P~L zone should be adopted on the front six feet of subject
property so that the City Zoning Map will reflect the uniform landscaping
setback along the entire frontage.
Plans and the file were reviewed by the City Council, and Mayor
Chandler asked if anyone wished to address the City Council in opposition.
Mrs. Florence Hill, owner of property at 1137 South Lemon Street,
stated that she had no objection to the commercial zoning; however she
requested that provision he made for the additional traffic. She requested
that no access to Lemon Street he allowed from subject property, and advised
of her neighhorhood~s sand and dust problems resulting from vehicles using
an unpaved area on the east side of Lemon Street for parking.
The Mayor asked if the applicant was present and wished to address
the City Council.

' ~' NM. E. Lewis Johnson, 14613 East Whittier Boulevard, Whittier,
owner of subject property, advised that he had no access easement from the
property other than the access to Anaheim Boulevard. He reported that some
automobiles have been parking on a portion of subject undeveloped property.
Nits. Hill and Mr. Johnson came forward to the Council Table and
reviewed plans and an aerial photograph.
NM. Johnson advised that the previous owner of subject property,
Mr. Collins, reserved a permanent private 20-foot alley easement along the
southerly property line as a condition of the sale. He stated that he
intended to pave said easement with asphalt and use it as a drive for access
to Anaheim Boulevard.
Mrs. Gilbert Clarke, 114i South Lemon Street, addressed the City
Council also requesting that there he no access from subject property to
Lemon Street.
Discussion was held by the City Council pertaining to the
easement and possible methods of precluding access from ~uhject property
to Ball Road and Lemon Street.
At the conclusion of the discussion, Councilman Schutte moved
that public hearing he continued one week, December 22, 1964, 1,,30 P.M.,
to allow visual inspection of the property, and further moved that NM.
David Collins he requested to attend the hearing at that time. Councilman
Krein seconded the motion. MOTION CARRIED.
