Frank, Authorized Agent)o Public hearing was scheduled to amend Condition Nco 1 of Resolution No. 5567 in reclassification proceedings No. F-59-60-14, by amending deed restrictions~ restricting the C-1 use of the property to business and professional offices only, by adding thereto~ rest home~ The Mayor asked if anyone wished to address the Council. Mro Dudley Frank addressed the Council and presented prop'osed plot plan of development and renderin9 of the rest home, and again explainedt that in his opinion, this use would be less onerous, from a zoning standpoint, that that originally projected° Reference was made to the Anaheim Municipal Code wherein, with the enactment of the interium R-3 Ordinance Nco 1390, rest home use was deleted from the R-3 zone and not incorporated within any other zone classification. ~ Consideration was given to the possibility of pro'cessing this requested use by means of the variance procedure and it was doubtful that the four re- quirements coverin9 the granting of variances could be met. 4218 City Hall,.Anaheim, California - COUNCIL MINUTE$.-..JBly...12.~..~.960~,~.7~00' P.~.~. At the conclusion of the discussion, the Mayor asked if anyone else wished to address the Council, there being no response, declared the hearing closed° RESOLUTION NO. 61385 It was considered that under the circumstances, the City Council could not legally grant the requested amendment to allow the use of a rest home, and thereupon, Councilman Chandler offered ~esolutton No. 6138 and moved for its passage and adoption, denying said request. RECLASSIFICATION NO. F-59-60-94: Request of James,B. Kerwin for deletion of Condition Nco 11 of Resolution No. 6065~ pertaining to installation of stdewalks~ in Reclassification proceedings No. F-59-60-94, was submitted~and discussed. It was. noted that the requirement of installation of sidewalks on South and Plac~ntia Avenues was included in City Planning Commission's Resolution No. 2~2, Series 1959-60, which was incorporated in Resolution o£ Intent NCo 6065 by the City Council. Tract located on the north side of La Palma Avenue, west of Euclid Avenue, and contains 65 proposed R-3 lotso The City Engineer advised that a representative from the developer was present~ and wished to request continuance of said tentative map until such time as their application for Reclassification No. F-60-61-2 is con- sidered by the City Councilo Councilman Coons moved that the verbal request of the Applicant be 9ranted~ and that action on Tentative Tract Noo 3812 be deferred at this time~ to be again considered in conjunction with Reclassification No. ?.~60-61-2o Councilman Chandler seconded the motion° MOTION CARRIED. Tract located 1320 feet south of Ball Road on the east side of Euclid Avenue and contains 36 proposed R-i lotso The City Planning Commission approved said tentative map, subject to the following conditions: 1o "Not A Part Of" at NoWo corner to be a lot in the subdivision or right of way and easements and improvements be provided fronting "Not A Part Of". 2o Ail cul-de-sac lots within subdivision shall have 15~ setback. RECON~ENDATION - POST OFFICES, C-1 ZONE: City Planning Commission Resolution NOo 1, Series 1960-61, recommending to the City Council that Post Offices be 4223 ~it.y Hall~ Anaheim,..Ca_!ifornia -~C!L MINUTES-.3u!¥ !2,.!960, 7~00 considered an allowable use in the C-1 Zone, was held over for one we~k (July 19, 1960) for further information, on motion by Councilman Goons' seconded by Councilman Chandler° MOTION CARRIED. TRACT NO. 1647 AND TRACT NO. 3278: Request of Anaheim Company~ Co C. Phtllips~ President, for completion of improvements in tract located between Ninth 'and Hampstead Streets, south of Cerritos Avenue~ was considered by the City COuncil July 5, 1960, and ordered deferred to this date, pending repo=t and recommendation of the City Attorneyo Mr. Turner reported on the conversation he had with Mr. Van Tassel, representing the bonding company, informing them that the City CoUncil wanted action on the improvements in these tracts° He further advised that action was filed in the latter part of 1957 and that the bonding ccm~pany has been working on this since that time and has encountered 'many problems. Mro Phillips addressed the Council, stating that the report of the City £ngineer on the items taken care of was in the tract next to him and did not concern him° He was of the opinion that the bonding company"s excuse has been an existin9 irrigation line which he felt could have been lowered° At the conclusion of the discussion, Councilman Chandler moved that the City Attorney be instructed to give the bonding company and their Attorney a week to give us a solid starting date for the finishing of these lmprovem6nts, and a probably finishing date~ and if they do not give us that within a week, to press the suit with the greatest dispatcho Councilman Coons seconded the motion° MOTION CARRIED. PUBLIC DANCH PERMIT: Application for Public Dance Permit, filed by Stan Betz (Street Sweepers Car Club) for permission to hold a dance July 22, 1960 at the Carpenter's Hall~ was submitted~ Mro Melvard, Mro Dale McDonald and Mro Austin Doss, residents in the immediate area of the Carpenter's Mall, advised the Council of the undesirable situations that existed in the neighborhood as result of the public dances held at the Carpenter's Hall~ and requested that this dance permit and all future public dance permits for this location, be denied. Discussion was held by the City Council regarding additional policing requirements~ and on motion by Councilman Chandler~ seconded by Councilman Thompson, said dance permit was granted~ subject to the recommendations of the Chief of Police~ with the additional requirement that two uniform patrolmen~ at the expense of the permittee~ be required to be on patrol outside at all times° Councilman Schutte voted "no'".
