That the proposed use is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Sections 18.06.030.040.0402 and 18.06.160.010 with waiver of (a) SECTION NO. 18.40.060:020 Required improvement of right-of-way. That the waiver of required improvement of right-of-way is hereby approved on the basis that the proposed streets would connect to and be similar in width to the existing street grid; therefore, there is no reasonable relationship between the need for the full required dedication and the improvements and the traffic impacts associated with the proposedprojecL 3: That the proposed project is compatible with existing and surrounding land uses and maintains good overall project design. 4. That the project would not adversely affect the adjoining land uses and the growth :and development of the area in which it is proposed because the site plan is well designed with adequate setbacks to the street and within the development. 5. That the size and shape of the site for the proposed use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area. 6. That the granting of this conditional use permit under the conditions imposed, would not be detrimental to the health and safety of the citizens of the City of Anaheim.. 7. That no one indicated their presence at said public hearing in opposition; and that no correspondence was received in opposition to the subject petition, CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That as demonstrated by the analysis included in the Final Environmental Impact Report No. 330 EIR (Final EIR) and Addendum, the: proposed project actions will not result in new significant impacts or substantial increases in the severity of previously identified significant impacts; and, therefore, no supplemental or subsequent environmental review is required: The Planning Commission hereby determines that the previously-certified Final EIR with the Addendum and Mitigation Monitoring Plan No. 122, are adequate to serve as the required environmental documentation for the proposed project actions in connection with Conditional Use Permit No. 2006-05076. Fairmont Private School is currently seeking to modify the existing CUP (CUP2007-05256) to allow up to 750 high school students, 55 teachers, and 30 administrative staff members (office and non-office). The City of Anaheim has requested a parking study to analyze the potential changes in pazking needs under the proposed changes at the school. No changes to school operation hours, square footages, or total student count are proposed: Fairmont Preparatory Academy is a closed campus, therefore student do not leave campus for lunch. The school is located on the southwest quadrant of the Brookhurst Street at Santa Ana Freeway (I-5) interchange. The address of the school is 2220-2240 West Sequoia Avenue in the City of Anaheim: This report has been prepazed in accordance with Anaheim Municipal Code Section 18.42.040.0108 to document and evaluate the parking supply and demand for the Fairmont Preparatory Academy with the changes proposed by the School SCHOOL DESCRA'TION The following section describes existing operations at the Fairmont Preparatory Academy Campus. School Site Description and Access The school site plan is shown orr Figure I. The school currently occupies 4 buildings, including a gymnasium. Two buildings are used primarily for instruction, which inclodes classrooms,.science labs, computer labs, a theater, and amulti-purpose room. One building is dedicated to staff, administrative offices and the school library. The school is served by three access points; full access is peanitted at all gates when the gates are open. The main gate is located on W. Sequoia Avenue, bn the north edge of the campus. This gate remains open for the duration of the school's operating hours. A second gate is located bn the northwest comer of the school's. property. This gate is closed and locked after the after-school pick-up peak period. A third gate is located along the eastern edge of the school campus: This gate is only open'dnring the before- school drop-off and after-school pick-up peak periods. Fairmont Preparatory Academy currently has 209 pazking stalls on site. There are 200 marked stalls, incladmg 5 handicap stalls, in the main parking area: Another 9 stalls, including 1 krandicap-accessible stall, are located in the rear of the school by the gymnasium: The site provides enough pazking stalls to meet the current demand. The school is proposing to reconfigure the main parking lot by removing several exisfing planters to increase the on-site parking supply by 9 stalls. The school will have 218 parking stalls after the parking lot renovafions. Fairmont School is submitting a request for the pazking lot renovations with this CUP amendment application. Observations indicate that with the measures in place for school drop-off and pick-up, the circulation within the pazking lot during these times works well with little or no congestion. First period begins for both the junior high school and the high school at 7:50 AM. The high school is dismissed at 2:30 PM, while the junior high students are dismissed aT3:20 PM. The hours of the gymnasium are restricted by the existing Conditional Use Permit to the hours of 7:00 AM to 10:00 PM. High School Enrollmeut Projections Even though Fairmont Preparatory Academy is requesting a CUP amendment to allow for a maximum capacity of 750 high school students, the school's internal projections of high school enrollment forecasts that it may not reach capacity until the school year 2012-2013. METHODOLOGY School Panting Requirement Based On City Code The parking requirement for the proposed CUP amendment for the school is based on the City of Anaheim Zoning Code, Section 18.42.040 Non-Residential Parking Requirements. City Pazking Code for pertinent land uses are included in Appendix B. The City's Code sets forth the off-street parking space requirements for developments within the City. The City's parking requirement for a high school use is shown in Table 2. The required pazking supply assuming an al]-high school .student body and the previously stated adjusmrents in administrative staff based on City Code requirements is shown in Table 3. The site currently provides 209 parking stalls, but plans to add 9 stalls for a total of 218 parking stalls. Based on City Code requirement, the current parking supply is deficient by 81 stalls. With the proposed reconfiguration of the school parking lot, the parking supply would be deficient by 72 stalls using City " Code requirements. I-Iowever, the existing CUP granted a waiver for the 80 stalls required for the gymnasium. The following section summarizes the actual parking supply needed by the school based on actual usage. EXISTING SCHOOL PARKING DEMAND The existing parking areas at Fairmont Preparatory Academy were surveyed on three 'weekdays to document the existing parking demand Pazkingbounts were conducted on Tuesday, September 18, 2007, Thursday, September 20; 2007, and Wednesday,'September 26, 2007.1. The parking lot was'surveyed every hour during the anticipated highest demand period from 830 AM to 1:30 PM to capture the highest demand of the day. The entire parking lot was divided into seven zones to facilitate data collection and data analysis:. In addition to the main campus parking area, a row of 9 parking stalls located behind the gymnasium was also included for the purpose of this study: Parking count zones'of the school campus are shownon Figure 2. The results of the parking lot countare shown in Table 4. Parking data sheets are included in Appendix A. Summary of Parking Data Collection The majority of mazked stalls on campus are regular stalls and are not reserved or specified for a type of user. A row of 18 stalls adjacent to the front lawn (Zone' 3) are marked "Seniors and Staff Only", and 5 stalls are reserved for guests in Zone 4. With the exceptlonof Shandicap-accessible stalls, all other stalls on campus are available to all users. `Parking control staff fias indicated that faculty and staff are directed to park in areas towards the southern end of tfie school (Zones 5 and ~ before students fill$p those areas. With the 9 stalls behind the gymnasium; the parking supply on campus is adequate to meettheparking demand for all hours surveyed. Tn order to maximize use of the 9 parking spaces behind the gymnasium, school staff is assigned to park in these spaces. - The data shown in Table 4 indicates that the parking lot was betwee6 77% and 87% full fa most of the day: The highest demand was observed at 10:30 AM on all three survey days: All prking zones; except Zone 3, remained almost fully occupied during all count times and days. Guest and handicap-accessible parking spaces were never fully occupied. The least number of unoccupied spaces during the survey period was 27, and the most was 49.' On average, approximately 36 spaces remained unoccupied on the days surveyed; When vehicles arrive on campus, usually before classes start at 8 AM', they are parked in the same stall for the day until the driver leaves school at the end'of the day. Students are not permitted to leave campus during lunchtime. A few staff and faculty memtiers may leave during the course of the day. The City recognizes that particular land uses "' may have unique requirements that can be demonstrated through a parking demand study. According to City Code, Fairmont Preparatory Academy is required to provide 290 parking stalls. The campus currently provides 209 stalls. Compared to City Code, the parking supply is deficient by 81 spaces. However, with the parking lot reconfiguration to increase the parking supply by 9 stalls, the parking lot will provide 218 stalls, including 6 handicap accessible stalls. A shortage of 72 stalls is forecasted compared to City Code. During normal school hpi>i•s, the gymnasium is only used by the students and staff of the Fairmont Preparatory Academy. The gym pazking requirement is already accounted for through the student .and staff Code requirements. The gym is not used for non-school functions during school hours. The Code requirement is intended for large public schools where multiple events, including extracurricular events in the auditorium, may occur during normal schooLhours. Therefore, it is unnecessary to include the parking requirement for the gymnasium in the pazking calculations for Fairmont Prepazatory Academy. The existing CUP recognizes this limited use of the gymnasium and provided a waiver for the parking requirement. To further enhance parking availability, Fairmont Ptpazatory School will implement a formal carpooling program for its teachers and administrative employees based on need. The formal carpooling program will be implemented when the number of daily available parking spaces an campus falls below 10 spaces.. Fairmont will institute a program to count on-campus parking demand every four weeks. Until the need for a fomtal carpool program exists, the school will continue to encourage its faculty, staff, and students to participate in an infomtal carpooling plan: A survey of all school employees found that nearly 60% of staff expressed a desire to carpool or use alternative modes of transportation at least three days a week. The program would complement staffs desire to control thee costs of commuting. The school would provide each participant a list of participants in order to assist in rideshare matching. Bicycle racks and a designated area for motorcycle parking have been created to promote the use of these transportation modes. Under this fomral carpooling incentive program, each participant will be given a daily carpool ticket if he or she arrives on campus via an altemative made of transportation. A minimum of three (3) tickets per week (i.e: carpool three times a week) will be exchanged for one entry into a monthly drawing for a cash prize of $1,000. Based on initial interest in the carpooling program, it is estimated that the pazldng demand from teachers and staff may be reduced by a minimum of 10 stalls, but up to IS stalls. To yield a more conservative estimate, the final calculation for parking demand will use 10 stalls. Student parking is closely regulated. All student drivers must obtain a parking permit to park on campus. The school presently issues a maximum of 125 student parking permits based on a priority basis. First piiority is given to seniors as part of their senior privileges. Second priority is given to juniors who carpool. Any remaining parking permits are given to juniors who do not carpool. Sophomores or freshmen are not allowed to purchase a permit or pazk on campus. By enhancing the student parking permit program and instituting a forma] student and faculty/staff carpool program, Fairmont Preparatory Academy effectively manages the number of student vehicles on campus. To further encourage carpool participation, the school has designated a limited number of parking stalls close to the buildings far carpool vehicles as another component of the incentive program. Staff carpool stalls are sepazate from student carpool stalls. Even though the campus is not large and walking from the farthest parking stall is not strenuous for most people, designated carpool pazking stalls are intended [o further eliminate the need to find a parking space, and shows staff and students that the school is Parking Demand Study for Fairmont Preparatory Acadcmy 8 February 2008 dedicated to support alternative modes of transportation. The amount could be increased based on actual demand from carpool participants. Table 5 shows the adjusted parking demand for the Fairmont Preparatory Academy. After the proposed parking lot reconfiguration, the school will have 218 parking stalls, which indicates a surplus of 20 stalls on campus,'. NUMBER OF STUDENT DRIVERS BASED ON TRAVEL MODE A calculation of the number of student drivers for the current yeaz (2007-08) and the worst case maximum capacity year (estimated to be Year 2012-13) based on current travel mode percentages is provided in Table 6. Compared to the projected parking supply, of 218 pazking spaces, a surplus of 34 parking spaces is indicated for Year 2007-08. It should be noted that the student perking number does not take into consideration the formal carpooling program [hat that is being considered. Applying the percentages shown in Table 6 to the maximum capacity year (estimated to be school year 2012-13), Table 6 shows that the expected number of students driving to the school (and thus, needing a pazking space) for school year 2012-13 is expected to be 125 students. The school will continue to issue 125 students pazking permits in future .school yeazs in accordance with city parking code. Taking into consideration the other drivers requiting parking spaces at the school and the adjustments as noted in Table 5, it is expected that approximately 198 pazking spaces will be utilized for the 2012-13 school year. Compared to the projected parking supply of 218 parking spaces, a surplus of 20 parking spaces is indicated for Yea{2012-13. Again, it should be noted that the student parking number does not take into consideration the formal carpooling program that is being considered. An alternative method to evaluate future parking adequacy is to utilize existing parking counts previously shown in Table 4. The maximum number of vehicles observed was 182 vehicles. Student parking accounts for ] 11 vehicles, as shown in Table 6. The remaining 7 t vehicles could be attributed to all other drivers on campus. Future parking demand could then be calculated by adding the forecasted future student parking of 125 to spaces attributed to all other drives on campus, 71. The resulting total parking forecast is 196 parking spaces. This method yields a similar forecast pazking demand as previously shown in Table 5. Packing Demand Study for Fairmont Preparatory Academy 10 February 2008 FINDINGS AND CONCLUSIONS Findings The City of Anaheim requires a perking study to detail whether the proposed site meets the five findings for a variance from the City of Anaheim Municipal Code for parking: Section 18.42.110.0101: That the variance, underlhe conditimcr imposed, ijany, will not cause jewer bff- street parking spaces to be provided for the proposed use than the number ojsuch spaces necessary to accommodate all vehicles attributable to such use under the normal and reasonably foreseeable conditions of operation ofsuch use; ~' This study found that the parking demand of the Fainnont Preparatory Academy is forecast to be 198 stalls while providing 218 stalls on site. Therefore, the school would have adequate on-site parking spaces to accommodate the forecasted demand at this site. Section 18.42.I10.0702:That the variance, under the conditions imposed, if any, will not increase [he demand and competition for parking spaces upon the public streets in the immediate vicinity of the proposed use; * This study found that the on-site parking supply of the Fairmont Preparatory Academy is adequate to meet the parking needs of the school. Therefore, the school will not cause increased demand and competition for on-street pazking spaces in the immediate vicinity. Section 18.42.110.0103: That the variance, under the conditions imposed, ijany, will not increase [he demand and competit[on for parking spaces upon adjacent private property in the immediate vicinity of the proposed use (which property is not expressly provided as parking for such use under an agreement in compliance with subsection 18.42.050.030 (Non-Residential Uses-Exception); ' This study found that the on-site parking supply of the Fairmont Prepazatory Academy is adequate to meet the parking needs of the school. Therefore, the school will not cause increased demand and competition for pazking spaces upon adjacent private property in the immediate vicinity. Section 18.42.II0.0104.•That the variance, under the conditions imposed, if any, will not increase traj~c congestion within the off-street parking areas or lots provided jor the proposed use; and ~ The proposed changes to Fairmont Preparatory Academy will not affect current on-site circulation. Conclusion Fairmont Private School seeks to modify its existing CUP to allow up to 750 high school students, 55 teachers, and 30 administrative staff members. This parking demand study has forecasted the parking demand for this condition at 198 parking stalls. The campus currently provides 209 parking stalls. Fairmont Prepazatory Academy plans to increase its existing parking supply of 209 stalls by 9 stalls by the removal of several existing planters. After the renovation, the parking lot would provide 218 on-site parking stalls. This supply is adequate to accommodate the forecasted parking demand of 198 stalls. The property is presently developed with a private school and is designated by the Anaheim General Plan Land Use' Element Map for "GC" - Generat Commercial-land uses and is zoned "CL" Commercial, Limited. As a policy, pazking permits are only provided to - -- approximately (56%) of 12'h grade students and on a limited basis to 11°i grade students, with priority going to those students that carpool with other students. No 9°i or 10th grade students aze permjtted to park on campus. Those students who do not meet the above stated requirements to park on campus either ride Fairmont buses, public transportation, carpool with other students or are dropped pff and picked up by their parents. 1n order to further reduce pazking demand, Fairmont has formalized several carpool programs for faculty, staff and students. These programs include incentives for those who carpool and details are included as part of the Detailed Parking Demand Study. A recent survey of faculty and staff revealed that over 59% aze interested in participating in these carpool programs. In addition to reducing parking demand on campus, we have initiated the process of potentially adding from 14-20 new parking stalls to increase the total number to 223-229 as shown on Exhibits C and D, Existing Campus Plan and Proposed Campus Parking Plan, respectively. To date, three separate contractors have provided recommendations and cost estimates for potential modification schemes to expand parking capacity to our existing lot without changing [he configuration of the traffic isles or the overall parking lot layout. We feel that these changes will be beneficial and can be accomplished in a short timeframe, minimizing the potential for disruption of construction during the. school year. Considering the above factors, we feel that Fairmont Preparatory Academy has sufficient parking available to allow the school the flexibility to expand our high school programs up to the requested capacity of 750 high school students as well as allowing the incremental increases in faculty and staff to accommodate student needs in the future. From an operational perspective, no changes would be required to the school's hours of operation or management of daily arrival and departure routes. The centerline to curb width should be widened to 43 feet with a five (5) foot wide pazkway and five (5) foot wide sidewalk adjacent to the right-of--way line in conformance with Public Works Standazd Detail No. 160-A. Landscaping and irrigation shall be installed between the sidewalk and curb, as approved by the Parks Division. A Right of Way Construction Permit from the Public Works Department, Development Services Division shall be obtained to install the pazkway landscaping and irrigation. Any other lazge water system equipment shall be installed to the satisfaction of the Water Engineering Division outside of the street setback area in a manner fully screened from all public streets and alleys. Said information shall be specifically shown on plans and approved by Water Engineering and Cross Connection Control Inspector before submittal for building permits. 6 That all requests for new water services or fire lines, as well Public Utilities as any modifications, relocations, or abandonment of existing water services and. fire lines, shall be coordinated through Water Engineering Division of the Anaheim Public Utilities Department. 7 That this project has landscaping azea exceeding 2,500 Public Utilities squaze feet and a sepazate irrigation meter shall be installed incompliance with Chapter 10.19 of the Anaheim Municipal Code and Ordinance No. 5349 regazding water conservation. 8 That the developer shall submit revised elevation and Planning landscape plans indicating vine pockets along the east elevation of the commercial retail building including lattice treatment on the elevation to enhance the clinging vines. Landscape irrigation schedules shall be adjusted to accommodate the seasons. ® Selection of drought-tolerant, low water consuming plant varieties shall be used to reduce irrigation water consumption in new landscaped azeas. ® Efficient irrigation systems shall be installed which minimise runoff and evaporation and maximize the water that will reach plant roots. ® The project shall comply with the water conservation requirements of Title 20' and 24 of the California Administrative Code. MM 5 The Gas Company (Energy) 13 That the applicant shall comply with the National Pollutant Public Works Discharge Elimination System. A general pemut for MM 6 construction activities shall be certified by the Regional Water Quality Control Boazd. BE IT FURTHER RESOLVED that the Anaheim Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declazed invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED that the applicant is responsible for paying all chazges related to the processing of this discretionary case application within 15 days of the issuance of the final invoice.
