REGULAR MEETING OF THE ANAHEIM CITY ZONING ADMINISTRATOR

Procedure to Expedite Meeting:
The proponents for conditional use permit and variance applications which are
not contested will have 5 minutes to present their evidence. In contested
applications, the proponents and opponent will each have 10 minutes to present
their case unless additional time is requested and the complexity of the
matter warrants. After the opponent(s) speak, the proponent will have 5
minutes for rebuttal. Before speaking, please give your name and address and
spell your last name.
Staff Reports are part of the evidence received by the Zoning Administrator at
each hearing. Copies are available to the public prior to and at the meeting.
The Zoning Administrator may withhold questions until the public hearing is
closed.
The Zoning Administrator reserves the right to deviate from the foregoing if,
in the Administrator's opinion, the ends of fairness to all concerned will be
served.
All documents presented to the Zoning Administrator for review in connection
with any hearing, including photographs or other acceptable visual
representations of non-documentary evidence, shall be retained by the City of
Anaheim for the public record and shall be available for public inspection.
The action taken by the Zoning Administrator on this date regarding
conditional use permits and variances is final unless, within 15 days of the
Zoning Administrator's written decision being placed in the U.S. Mail, an
appeal is filed. Such appeal shall be made at any time following the public
hearing and prior to the conclusion of the appeal period. An appeal in
written form to the City Clerk, accompanied by an appeal fee equal to one-half
the amount of the original filing fee. The City Clerk, upon filing of such an
appeal, will set said conditional use permit or variance for public hearing
before the City Council at the earliest possible date. You will be notified
by the City Clerk of said hearing.
After the scheduled public hearings, members of the public will be allowed to
speak on items of interest under "Items of Public Interest". Such items must
be within the jurisdiction of the Zoning Administrator. Each speaker will be
allotted a maximum of 3 minutes to speak. Before speaking, please give your
name and address and spell your last name.

MINUTES - June 18, 1987
The regular meeting of the Zoning Administrator was called to order by
Annika Santalahti, Zoning Administrator at 9:30 a.m., June 18, 1987, in the
Council Chamber.

Annika Santalahti, Zoning Administrator, explained the procedures for the
meeting and that anyone desiring to speak would have the opportunity to be
heard at the end of the meeting.
ITEM N0. 1 EIR CATEGORICAL EXEMPTION-CLASS 5 AND VARIANCE N0. 3659
PUBLIC HEARING. OWNER: KEITH JOHN HULTQUIST AND MARLENE MARIE HULTQUIST,
1225 Andrea Lane, Anaheim, CA 92807. AGENT: BLUE RIBBON BUILDERS, INC.,
1135 W. Katella, Orange, CA 92667, ATTN: LYNN NEALE. Property is a
rectangularly-shaped parcel of land consisting of approximately 4,908 square
feet, having a frontage of approximately 50 feet on the west side of Andrea
Lane, approximately 350 feet north of the centerline of La Palma Avenue and
further described as 1225 Andrea Lane.
Request for waivers of maximum lot coverage and maximum number of bedrooms
to construct a second-story addition to a single-family residence.
Continued from the meetings of May 21, in order to be readvertised with the
correct hearing time and for the applicant to be present to answer questions
and from June 4, 1987, in order for the applicant to submit revised plans.
Annika Santalahti, Zoning Administrator, explained this matter was continued
from the meeting of June 4, 1987, in order for the architect to review the
plans to determine if they could be revised to lessen the 'impact of the
addition over the patio area.
Perry Hanstad, builder, stated a concern regarding the rear of the structure
extending into the 20-foot setback was discussed at the last meeting. He
stated that neighbor has a 2-story addition within 10 feet of the rear
property line and he feels denying this request would be denying one
property owner the right to do something that another property owner can
do. He stated the owner wants to proceed with the submitted plans, but that
the window could be changed.

Ms. Santalahti stated she did review an aerial photograph dated December 1986
which showed almost the entire block and most of the properties are
rectangularly-shaped and appear to have rear setbacks of about 15 feet rather
than 10 or 20 feet; and that the property to the south, off„the cul-de-sac of
Andrea and Woodsboro, has a different requirement since it ;is not
rectangularly-shaped.
Mr. Hanstad stated this lot is small and the only other choice the owner has
is to move.
Joe Bueno, 1217 N. Andrea Lane, stated there are reasons for having codes and
restrictions and he thought they should be enforced. He stated this addition
is rather large when compared to the lot size.
Mr. Hanstad stated following the last meeting, the neighbor put up a "for
sale" sign and kie feels this addition will decrease his property value.
THE PUBLIC HEARING WAS CLOSED.
Ms. Santalahti stated she reviewed the aerial photograph in relationship of
this structure to the property on the south to see how the buildings would
relate to one another and the closest properties appear to have building
setbacks of about 15 feet and subject property is setback about 20 feet and is
inset from the neighbor to the north. She stated the aeria'1 photograph
re-enforced her opinion that this request should be approved in part, denying
waiver (a) for maximum lot coverage, thereby requiring 35$ permitted, and
approving waiver (b) in part, permitting four bedrooms, rather than the five
proposed. She explained from looking at the plans, eliminating that one
bedroom would bring the plan into conformance with the 35$,'lot coverage
requirement. She stated Condition No. 1 would also be modified to read:
"1. That subject property shall be developed substantially in accordance
with plans and specifications on file with the City of Anaheim marked
Exhibit Nos. 1 and 2; provided, however, that a minimum fifteen (15)
foot building setback shall be maintained from the rear (west)
property line, that lot coverage shall not exceed 35$ and that only 4
bedrooms are permitted. Revised plans showing said increased
setback, maximum 35$ lot coverage and 4 bedrooms shall be submitted
in connection with the building permit."
Ms. Santalahti explained if the owner goes ahead with construction based on
this approval, a minimum 15-foot setback will have to be maintained, and that
it appears all the rectangular lots have approximately 15 foot setbacks and if
the lot coverage is kept at 35$, the 15-foot setback would be acceptable. She
added there are no variances approved in that area and that the aerial
photograph referred to showed the entire block.
Mr. Hanstad stated the neighbor has a 10-foot setback.
Ms. Santalahti stated any lots in the neighborhood which arse not
rectangularly-shaped would have different requirements.

Ms. Santalahti explained this decision becomes final unless an appeal to the
City Council, in writing, accompanied by an appeal fee, is filed with the City
Clerk within 15 days of the date of the signing of this decision or unless a
member of the City Council shall request to review this decision within said
15 days.
