REGULAR MEETING OF THE ANAHEIM CITY ZONING ADMINISTRATOR
THURSDAY, SEPTEMBER 8, 1988, 9:30 A.M.
Procedure to Expedite Meetincx:
The proponents for conditional use permit and variance applications which
are not contested will have 5 minutes to present their evidence. In
contested applications, the proponents and opponent will each have 10
minutes to present their case unless additional time is requested and the
complexity of the matter warrants. After the opponent(s) speak, the
proponent will have 5 minutes for rebuttal. Before speaking, please give
your name and address and spell your name.
Staff Reports are part of the evidence received by the Zoning
Administrator at each hearing. Copies are available to the public prior
to and at the meeting.
The Zoning Administrator reserves the right to deviate from the foregoing
if, in the Administrator's opinion, the ends of fairness to all concerned
will be served.
All documents presented to the Zoning Administrator for review in
connection with any hearing, including photographs or other acceptable
visual representations of non-documentary evidence, shall be retained by
the City of Anaheim for the public record and shall be available for
public inspection.
The action taken by the. Zoning Administrator on this date. regarding
conditional use perm.i.ts and variances is final unless, within 15 days of
the Zoning Administrator's written decision being placed in the U.S. Mail,
an appeal is filed. Such appeal shall be made at any time following the
public hearing and prior to the conclusion of the appeal period. An
appeal shall be made in written form to the City Clerk, accompanied by an
appeal fee equal to one-half the amount of the original filing fee. The
City Clerk, upon filing of such an appeal, will set said conditional use
permit or variance .for public hearing before the City Council at the
earliest possible date. You will be notified by the City Clerk of said
hearing.
After the scheduled public hearings, members of the public will be allowed
to speak on items of interest under "Items of Public Interest". Such
items must be within the jurisdiction of the Zoning Administrator. Each
speaker will be allotted a maximum of 3 minutes to speak. Before
speaking, please give your name and address and spell your. last name.

MINUTES - September 8, 1988
The regular meeting of the Anaheim City Zoning Administrator was called to
order by Annika Santalahti, Zoning Administrator, at 9:35 a.m., September 8,
1988, in the Council Chamber.

Annika Santalahti, Zoning Administrator, explained the procedures for the
meeting and that anyone desiring to speak about matters other than the
agendized items would have the opportunity to be heard at the end of the
meeting.
Ms. Santalahti stated that Item No. 3 - Variance No. 3839 would be continued
until the Zoning Administrator Meeting of October 6, 1988, which is the first
meeting to be held after the Planning Commission discussion.on September 26,
1988, regarding the Scenic Corridor Height Study. She noted applicant had
been notified of same by staff. (See Item No. 3 for additional information)

Waiver of minimum side yard setback to retain an existing patio cover.
There were three letters received in support of the proposal..
No one indicated their presence in opposition.
Father Donovan, introduced Tom Gieser, Attorney for The Servite Fathers.
Mr. Gieser submitted three letters from the owners of properties that
immediately abut the patio structure indicating they had no objections to the
structure. Mr. Gieser said the school was not financially able to pay the
amount of money it would cost to comply with some of the Conditions of
approval. He said if the Conditions cannot be waived the school would be
forced to withdraw the application. He noted that school staff feels the

overhang is important and noted it was built by the booster club some years
ago; however, the cost of putting in 600 feet of sidewalk along Wichita Avenue
is prohibitive. He said they were also concerned about other Conditions of a
lesser fiscal impact.
PUBLIC HEARING WAS CLOSED
Ms. Santalahti asked if he knew the cost of installing the sidewalk. Father
Donovan said he had spoken to Mr. Bruce Bowman, in the Engineering Department,
who estimated it would cost approximately $20,000 to complete.
Ms. Santalahti said if the Variance request involved a traffic or pedestrian
impact she could see the necessity for the sidewalk. She said since this was
not the case, she could see their point.
Ms. Santalahti asked what other Conditions were they having difficultywith,
and Mr. Gieser said they were concerned with Condition No. 3. He said they
had no idea what the cost would be to reconstruct the existing driveways along
La Palma Avenue and noted he was not aware of any damage to the driveways, and
Ms. Santalahti explained reconstruction would only be required where and if
damage existed. Mr. Gieser agreed under those circumstances.
In response to questions by Mr. Gieser, Ms. Santalahti explained the other
Conditions of approval.
Ms. Santalahti asked if the patio had a wall along the west side or was the
patio a cover only with posts, and applicant said it was a cover with posts.
Ms. Santalahti noted that the owners of the three properties (addressed on
Keystone Street to the west) which immediately abut said accessory structure
have indicated, in writing, that they do not oppose the patio cover remaining.
Ms. Santalahti ,noted this item was Categorically Exempt.
Ms. Santalahti approved this variance, in part, the patio overhang to be a
minimum of three feet from the property line, deleting Conditions Nos. 2 and
9, the remaining Conditions were renumbered, modifying Condition No. 3 to read
"That existing broken or cracked driveways shall be removed and replaced and
that any driveways along La Palma Avenue which need repairs shall be
reconstructed to accommodate ten (10) foot radius curb returns, as required by
the City Engineer", and Condition No. 8 to read "That Condition Nos. 1, 2, 5
and 6, above-mentioned, shall be completed within a period of sixty (60) days
from the date of this decision."
This decision shall become final unless an appeal to the City Council, in _
writing, accompanied by an appeal fee, is filed with the City Clerk within 15
days of the date of the signing of this decision or unless members of the City
Council shall request to review this decision within said 15 days.

No one indicated their presence in opposition and no correspondence was
received.
Rick Del Carlo, Project Manager for Santa Fe Land and Improvement Company,
said he didn't have any comments as far as the parcel map but did want to get
some clarification on the Conditions.
PUBLIC HEARING WAS CLOSED
Mr. Del Carlo expressed his concern that the Conditions remain consistent with
the previously granted Conditional Use Permits (Nos. 2922 and 3010).
Ms. Santalahti and applicant reviewed the Conditions of approval.
Ms. Santalahti noted a Negative Declaration was prepared on this project, and
acted on staff's recommendation to approve it.
Ms. Santalahti approved this Variance as the proposal is minor in that public
street frontage is not necessary for access because suitable vehicular and
pedestrian access will be provided via a recorded 25-foot wide ingress and
egress easement from Hancock Street; with modification to Conditions Nos. 1,
2, 8, 9, 16, 19, 20, and 21; added a new Condition which pertains to
maintaining consistency between this Variance and Conditional Use Permit Nos.
2922 and 3010.
This decision shall become final unless an appeal to the City Council, in
writing, accompanied by an appeal fee, is filed with the City Clerk within 15
davs of the date of the signing of this decision or unless members of the City
Council shall request to review this decision within said 15 days.

Mrs. Suggett asked if their lot could be considered a hardship because their
lot drops off so severely in the back. She said that really no part of their
house would be higher than 25 feet, it's just that the lot drops off so
severely the garages have to be underneath. She hoped this fact would be
taken into consideration, and Ms. Santalahti said it would.'..
Ms. Santalahti noted two letters in opposition had been received, and
applicants were. given copies.

Ms. Santalahti said no written correspondence on the Administrative Adjustment
had been received so far and noted the appeal period would end September 8,
1988, at 5:00 p.m. She said she would act to approve this item September 15,
1988, if no written opposition has been received by 5:00 p.m. She stated if
written opposition is received, this item will have to be readvertised and
scheduled for a public hearing if the petitioner still wants to continue with
the proposal.
