REGULAR MEETING OF THE ANAHEIM CITY ZONING ADMINISTRATOR
THURSDAY, SEPTEMBER 22, 1988, 9:30 A.M.
Procedure to Expedite Meetin
The proponents for conditional use permit and variance applications which
are not contested will have 5 minutes to present their evidence. In
contested applications, the proponents and opponent will each have 10
minutes to present their case unless additional time is requested and the
complexity of the matter warrants. After the opponent(s) speak, the
proponent will have 5 minutes for rebuttal. Before speaking, please give
your name and address and spell your name.
Staff Reports are part of the evidence received by the Zoning
Administrator at each hearing. Copies are available to the', public prior
to and at the meeting.
The Zoning Administrator reserves the right to deviate from the foregoing
if, in the Administrator's opinion, the ends of fairness to all concerned
will be served.
All documents presented to the~Zoning Administrator for review in
connection with any hearing, including photographs or;;.other acceptable
visual representations of non-documentary evidence, shall be retained by
the City of Anaheim for the public record and shall be avai able for
public inspection.
The action taken by the Zoning Administrator on this date regarding
conditional use permits and variances is final unless, within 15 days of
the Zoning Administrator's written decision being placed in the U.S. Mail,
an appeal is filed. Such appeal shall be made at any time following the
public hearing and prior to the conclusion of the appeal period. An
appeal shall be made in written form to the City Clerk, accompanied by an
appeal fee equal to one-half the amount of the original filing fee. The
City Clerk, upon filing of such an appeal, will set said conditional use
permit or variance for public hearing before the City Council at the
earliest possible date. You will be notified by the City Clerk of said
hearing.
After the scheduled public hearings,-~~members of the public will be allowed
to speak on items of interest under "Items of Public Interest". Such
items must be within the jurisdiction of the Zoning Administrator. Each
speaker will be allotted a maximum of 3 minutes to speak. .Before,

The regular meeting of the Anaheim City Zoning Administrator was called to
order by Annika Santalahti, Zoning Administrator, .at 9:35 a.m., September 22,
1988, in the Council Chamber.

Annika Santalahti, Zoning Administrator, explained the procedures for the
meeting and that anyone desiring to speak about matters other than the
agendized items would have the opportunity to be heard at the end of the
meeting.

PUBLIC HEARING: OWNER: DOMINIC C. ETCHANDY AND BETTY J. ETCHANDY, 570 Dwyer
Dr., Anaheim, CA 92801. AGENT: MILES CAREY FOLSOM, 1743 S. Douglass Road,
#H, Anaheim, CA 92806. Subject property is an irregularly-shaped parcel of
land consisting of approximately 1.0 acre, having a frontage of approximately
137 feet on the south side of Crescent Drive, having a maximum depth of
approximately 329 feet and being located approximately 663 feet northeast of
the centerline of Peralta Hills Drive.
Waiver of maximum structural height to construct a 2-story, 32 foot high,

Ms. Santalahti stated that Item No. 1 - Variance No. 3841 would be continued
until the Zoning Administrator Meeting of October 6, 1988, which is the first
meeting to be held after the September 26, 1988, Planning Commission
discussion on the Scenic Corridor Height Study. She noted applicant had been
notified of same by staff. She said that the Anaheim City Council has
requested she take no action on height variances until after the above
referenced Planning Commission discussion.

PUBLIC HEARING: OWNERS: JOHN GRAUTEN AND MARILYN GRAUTEN, 522 S. Westgate
Drive, Anaheim, CA 92806. RODOLFO ORINA RAMIREZ AND JULIET MACARAEG RAMIREZ,
516 S. Westgate Drive, Anaheim, CA .92806. Subject property is a
rectangularly-shaped parcel of land consisting of approximately 0.35 acre,
having a frontage of approximately 140 feet on the east side of Westgate
Drive, having a maximum depth of approximately 110 feet, being located
approximately 1,020 feet north of the centerline of South Street and further
described as 516 and 522 South Westgate Drive.
Waivers of maximum trellis height and minimum rear yard setback to construct a
9-foot high lattice trellis.
No one indicated their presence in opposition and no correspondence was
received.
Mr. Grauten said they wished to construct a 9-foot high lattice trellis on
their properties He said the reason for this is the apartments abutting
their 'properties have a view of their'backyards. He said he had the plans
reviewed by Wayne West, Chief Building Official, and he had no problems with
the plans. He submitted pictures of the trellis as viewed from the apartment
complex. He also submitted a petition signed by all his surrounding neighbors
in support of the trellis. Mr. Grauten noted the apartment complex entrance
driveway sloped up to Lincoln Avenue past Mr. Ramirez's property and entering
vehicles will have easy visibility into Mr. Ramirez's yard.... He said the
headlights from the traffic will also shine into his windows.
PUBLIC HEARING WAS CLOSED
Mr. Grauten and Mr. Ramirez expressed their concerns about the dirt on the
apartment complex side being pushed up against the existing block wall making
the fence only 3-feet high on the apartment complex side rather than the
6-feet required.
Ms. Santalahti said the fence is supposed to be 6-feet as measured on either
side and putting dirt up against the fence and making it lower then 6-feet on
one side is in violation of the Zoninq Code. She said staff would look into
the situation and have it rectified if necessary.
Mr. Grauten said he had initially put the lattice on the existing block wall
and it was then discovered the wall was actually on the apartment complex
property so he would have to remove the lattice from the wall and put it on
posts.
Ms. Santalahti asked how far the property line was from the block wall. He
said he was not sure as he has not seen the exact property dimensions, but he
did plan to come in a foot one his side.
Ms. Santalahti approved this Variance based on the fact the 'this proposal will
protect the privacy of the rear yards of subject single family lots, which
yards are otherwise visible from the adjacent apartment buildings and from the
elevated entrance driveway to said apartment complex.

Ms. Santalahti modified Condition No. 1 to include: "(a) The fence design may
be either wood lattice as shown on Exhibit No. 1 or, alternatively, solid wood
boards as shown on the photographs labeled Exhibit No. 2 and dated 9-23-88;
and/or (b) The approved fence may be either a free-standing nine (9) foot high
structure located about six (6) inches from the existing block wall (as shown
on Exhibit 1) or a modification to the existing 6-foot high block wall with
four (4) foot high wood fencing attached to the top of said block wall [as
discussed in Item 1(a) above].
Ms. Santalahti noted a Negative Declaration was prepared on this project, and
acted on staff's recommendation to approve it.
This decision shall become final unless an appeal to the City Council, in
writing, accompanied by an appeal fee, is filed with the City Clerk within 15
davs of the date of the signing of this decision or unless members of the City
Council shall request to review this decision within said 15 days.
ITEM N0. 3. CEOA CATEGORICAL EXEMPTION CLASS 5, VARIANCE N0. 3846
PUBLIC HEARING: OWNERS: HARSOYO LURITO AND ANNIE NGAI LURITO, 1909 Clifpark
Way, Anaheim, CA 92805. Subject property is a rectangularly-shaped parcel of
land consisting of approximately 0.14 acre located at the northwest corner of
Clifpark Way and Verde Street, having frontages of approximately 70 feet on
the north side of Clifpark Way and 90 feet on the west side of Verde Street,
and further described as 1909 East Clifpark Way.
Waiver of permitted encroachments into required yards to construct a 258
square-foot room addition.
No one indicated their presence in opposition and no correspondence was
received.
Mrs. Lukito said they wanted to add a sunroom and spa onto the side of their
house. She noted the addition would be inside their existing block wall
fence. She said they had a building permit for the block wall.
PUBLIC HEARING WAS CLOSED
Ms. Santalahti noted the closest neighbor's driveway was not next to the
proposed addition and its visibility would not be impacted.
Mr. Lukito questioned the requirement of Condition No. 1, to pay a traffic
signal assessment fee, and Condition No. 2, to install roll-up garage doors
when they were not doing any alterations to their garage.
Ms. Santalahti agreed that since they were not constructing<a new dwelling
they should not have to pay a traffic signal assessment fee, and also since
they were not doing any alterations to their garage, they should not have to
install a roll-up garage door even though their driveway was less than 25 feet
deep.

Ms. Santalahti approved this Variance on the basis that the request is minimal
because the proposal does not interfere with or block safe vehicular and
pedestrian lines-of-sight across the adjacent neighbor's driveway and the
adjacent public street and sidewalk, in that said driveway intersects with the
street and sidewalk about 40 feet north of subject property and 55 feet north
of the proposed addition, and deleting Condition Nos. 1 and 2.
Ms. Santalahti noted this item was Categorically Exempt.
This decision shall become final unless an appeal to the City Council, in
writing, accompanied by an appeal fee, is filed with the City Clerk within 15
days of the date of the signing of this decision or unless members of the City
Council shall request to review this decision within said 15 days.
