Procedure to Expedite Meeting: The proponents for conditional use permit, variance, administrative use permit and administrative adjustment applications which are not contested will have 5 minutes to present their evidence. In contested applications, the proponents and opponent will each have 10 minutes to present their case unless additional time is requested and the complexity of the matter warrants. After the opponent(s) speak, the proponent will have 5 minutes for rebuttal. Before speaking, please give your name and address and spell your name. Staff Reports are part of the evidence received by the Zoning Administrator at each hearing. Copies are available to the public prior to and at the meeting. The Zoning Administrator reserves the right to deviate from the foregoing if, in the Administrator's opinion, the ends of fairness to all concerned will be served. All documents presented to the Zoning Administrator for review in connection with any hearing, including photographs or other acceptable visual representations of non-documentary evidence, shall be retained by the City of Anaheim for the public record and shall be available for public inspection. The action taken by the Zoning Administrator on this date regarding conditional use permits and variances is final unless, within 15 days of the Zoning Administrator's written decision being placed in the U.S. Mail, an appeal is filed. None None 03/21/91 Page,3 • REGULAR MEETING OF THE ANAHEIM CITY ZONING ADMINISTRATOR MINUTES - MARCH 21, 1991 The regular meeting of the Anaheim City Zoning Administrator was called to order by Annika Santalahti, Zoning Administrator, at 9:30 a.m., March 21, 1991, in the Council_Chamber. PRESENT• Annika M. Santalahti, Zoning Administrator Della Herrick, Associate Planner Melanie Adams, Associate Civil Engineer Margarita Solorio, Acting Secretary Annika Santalahti, Zoning Administrator, explained the procedures for the meeting and that anyone desiring to speak about matters other than the agendized items would have the opportunity to be heard at the end of the meeting. ITEM NO. 1 - CEQA NEGATIVE DECLARATION, VARIANCE NO. 4117 PUBLIC HEARING: OWNER: LARRY R. SMITH, 17045 Marina Bay Drive, Huntington Beach, CA 92643. AGENT: ANACAL ENGINEERING COMPANY, 1900 E. Subject property is an irregularly-shaped parcel of land consisting of approximately 3.6 acres located north and west of the northwest corner of Ball Road and Knott Street, having approximate frontages of 116 feet on the north side of Ball Road and 204 feet on the west side of Knott Street and further described as 919-959 South Knott Street. Waiver of required lot frontage to permit a 2-lot parcel map. Cal Queyrel, 1900 E. La Palma Avenue, agent, stated Parcel 1 of the tentative parcel map has no access to a dedicated street because the developer had plans to make additional improvements to the property and did not want a strip of land to interfere. He stated they are requesting waiver of required lot frontage to permit a 2-lot parcel map. No one indicated their presence in opposition and no correspondence was received. PUBLIC HEARING WAS CLOSED Ms. Santalahti asked what is the current parcelization of the property. Mr. Queyrel answered there have been as many as three parcels in the past. He stated whatever is there now they will be reverting to a two-lot parcel map. • Ms. Santalahti stated she will add a condition that makes a reference to appropriate easements being recorded in connection with the parcel map, relative to public, emergency and servicing access. Ms. Santalahti stated she will approve Variance No. 4117 on the basis that an appropriate easement will be established in connection with the parcel map to provide appropriate vehicular access and circulation to the entire site. Me. Santalahti noted a Negative Declaration was prepared on this project, and acted on staff's recommendation to approve it. This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is filed with the City Clerk within 15 days of the°date of the signing of this decision or unless members of the City Council shall request to review this decision within said 15 days. Della Herrick, Associate Planner, stated all of the conditions of approval are going to be on the parcel map. She stated that parcel map is advertised for the April 4, 1991, Zoning Administrator meeting. ITEM NO. 2 - CATEGORICAL EXEMPTION-CLASS 5, VARIANCE NO. 4119 PUBLIC HEARING: OWNER: RONALD M. AND LINDA M. MORGAN, 545 Sherwood Drive, Anaheim, CA 92805. Subject property is an irregularly shaped parcel of land consisting of approximately 0.2 acre, having a frontage of approximately 83 feet on the west side of Sherwood Drive, having maximum depth of approximately 126 feet, being located approximately 176 feet west of the centerline of Grove Avenue and further described as 545 Sherwood Drive. Waiver of minimum required side yard setback to construct a 70 square foot bathroom addition to an existing single-family residence. Linda Morgan, 545 Sherwood Drive, owner, stated the required sideyard setback is eight feet on both the north and south sides of her property and that she is asking for a five foot sideyard setback. She stated a five foot six inch setback already exists on the south side of her residence. No one indicated their presence in opposition and no correspondence was received. PUBLIC HEARING WAS CLOSED Ms. Santalahti asked Mrs. Morgan if she has spoken to her immediate neighbors on the north side regarding this addition and if they have seen the site plan that she is proposing. Mrs. Morgan answered yes, she talked to her neighbors before they applied for the variance because she did not want to pay the extra expense and have the variance denied. She stated there was no opposition from her neighbors. Ms. Santalahti stated she went out and looked at the property and asked Mrs. Morgan if she is aware if other houses in her neighborhood have similar setbacks. MINUTES, ZONING ADMITOR, MARCH 21, 1991 • PAGE 3 Mrs. Morgan stated her house seems too close to both of her neighbors' houses to have eight foot setbacks for each house. She stated she has never measured, but by looking at them they both seem to be very close to her property lines. Mrs. Morgan stated her neighbor's garage is on the side she is proposing to add the bathroom and there are no windows. She stated no one would be looking into anyone's house. Ms. Santalahti asked staff what is the lot width for the RS-10,000 Zone. Della Herrick, Associate Planner, responded Code requires seventy (70) feet. Ms. Santalahti stated she concurrs with the Categorical Exemption, Claes 5 prepared for this item. Ms. Santalahti stated she will approve Variance No. 4119 on the basis that there are other lots in the immediate vicinity and in the same zone that have sideyards smaller than eight feet. She stated this property will not be inconsistent with the existing developments as it is proposed to be developed. This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is filed with the City Clerk within 15 days of the date of the signing of this decision or unless members of the City Council shall request to review this decision within said 15 days. Box 1566, San Juan Capistrano, stated they are proposing on-sale alcoholic beverages in a restaurant with waiver of minimum number of parking spaces. He stated they find the revised conditions given to them by staff before the public hearing, acceptable. No one indicated their presence in opposition and no correspondence was received. Mr. Weinroth answered this is a proposed restaurant. He stated the space is vacant and the applicant has proposed to build a new restaurant. Ms. Santalahti stated she concurrs with the environmental impact analysis and approves the negative declaration prepared for the proposal. Ms. Santalahti stated she will approve Conditional Use Permit No. 3399 with the revised conditions on the basis of the standard findings. She stated she will also approve the parking waiver on the basis that a traffic analysis was prepared by the petitioner and approved by the City Traffic Engineer. She stated the parking variance is approved for a restaurant with the specific square footage outlined in the staff report. This decision shall become final unless an appeal to the City Council, in writing, accompanied by an appeal fee, is filed with the City Clerk within 15 davs of the date of the signing of this decision or unless members of the City Council shall request to review this decision within said 15 days.
