LOCATION: 626 South Harbor Boulevard. Property is arectangularly-shaped parcel of land
consisting of 0.10 acre, having a frontage of 48 feet on the east side of Harbor
Boulevard and being located 353 feet south of the centerline of Water Street.
Waiver of minimum number of parking spaces to establish a medical clinic with a maximum of two
employees.

The adjacent land uses and zoning are single family residential and noted that along the south property line
that although there is a block wall for approximately two thirds of the way back from Harbor Blvd. the rear
portion of the property where the garage is -there is a wooden fence up on the neighboring property. Code
does require a 6 ft. tilock wall between commercial and a residential use. The block wall needs to be
continued along the property line back to the alley. Mr. Apeles replied that he will complete the fence with a
block wall
(1. That the condition regarding the operation in accordance with the parking analysis that was submitted
and approved by the city.
2. Require that the block wall along the south property line be continued to the edge of the public right-of-
way along the alley so that there is a continuance blockwall along the south property line to buffer the
residential use to the south.
3. Conditioned that a small sign in the range of approximately 3 sq. ft. maximum at the back of the building
to identify the name of the business, and address so that people know where they are going when they
drive along the alley.)
The Zoning Administrator states that the current conditions pertain to trash enclosures. Dave See, Associate

Planner, stated that the Streets and Sanitation Division indicated that trash barrels would be acceptable for
this use, provided they are hidden from view in an appropriate location and that they will review final plan
prior to permits.
Selma Mann, Deputy Ciry Attorney noted that because of the fashion of the parking which was approved by
Traffic Engineering for the specific use proposed with the employee count would be appropriate and that we
add another condition. Basically a condition that states "Granting of this variance shall be deemed contingent
upon operation of the use in conformance with the assumptions relating to the operation etc. as contained in
the traffic analysis letter that you submitted, the reason for that is, if another doctor came in such as a
veterinarian the parking situation might be viewed differently by the city because of the way the customer
count could take place so we want to make sure that this medical clinic operates the way that the letter states
its going to operate and continues in that fashion because that is the reason for the variance potentially being
approved and if for instance something changes and you wanted two doctors and two nurses you would
have to come back to the Ciry and get that worked out in an appropriate fashion so that the parking can be
redressed with those conditions and parameters.
Dave See, Associate Planner, pointed out that the parking study the Traffic and Transportation Manager
approved (parking letter) wanted a condition stating that there would be a maximum of iwo employees due to
shortage of parking.
Selma Mann, Deputy Ciry Attorney:. Concerned that there is nothing that would stop this particular type of
medical operation from being transferred or sold or used by another more intense medical operation, it would
be appropriate to add a condition regarding the parking waiver based upon the parking letter and any
intensification or change. Also noted there is no parking demand study its a parking letter. CONDITION:
That the granting of this variance shall be deemed contingent upon operation of the use in conformance
with the assumptions relating to the operation and intensity of the use as contained in the Parking .Demand
Study prepared by Advantec Consulting Engineers dated March 25, 1998 on file in the Planning
Department. Exceeding, violating, intensifying or otherwise deviating from any of said assumptions as
contained in said Parking Demand Study shall be deemed a violation of the express conditions imposed
upon the granting of this variance which shall subject said variance to termination or modification pursuant
to the provisions of Sections 18.03.091 and 18.03.092 of the Anaheim Municipal Code.

REMARKS: Annika Santalahti, Zoning Administrator approved Variance No. 4344 to permit the parking
waiver as requested and in accordance with the findings.
Staff: Linda Johnson, Advanced Planner. Stated that there was already an existing 825 sq. ft. kitchen area
so this proposal is to change a hotel lobby area/administrative office area to a restaurant, so combined total
of the dining area and kitchen area.
