21. That the canopy will be removed from the awning of the building. That prior to
commencement of the activity authorized by this decision, or within a period of one (1)
year from the date of this decision, whichever occurs first, condition (nos. 20 and 21)
shall be complied with. That conditions be satisfied prior to commencement of the
activity or issuance of the building permit or expansion into the adjacent square,footage
or within one year from the date of this decision which ever occurs first.

No one spoke for or against the proposal.
Staff had a concern regarding the modification (canopy added to the front of the restaurant) however
the owner is having it removed. The Zoning Administrator advised Mr. Dhillon, that if he is interested
in adding a canopy, he would need to submit a building permit application which would be reviewed
by staff and one of the issues they would be interested in would be the actual appearance and how it
blends in with the remainder of the building.
Selma Mann, Deputy City Attorney stated that on the first page of the staff report (4-b), .indicates that
there is an existing conditional use permit No. 2294 to permit on premise sale and consumption of
beer and wine in conjunction with the proposed restaurant that was approved by the Planning
Commission on January 25, 1982. Since that is a conditional use permit for the same use on the
same premises the City Attorney's office would recommend that a condition be placed upon this
approval that there be a request made for termination of Conditional Use Permit No. 2294.
