been removed from the premises and that no representative from Office Depot appeared at the public
meetings on March 8 and March 22, 2001, when this request was scheduled for discussion.

Dan Cojochean, Agent, 544 E. Hoover Ave., Orange, CA 92867, introduced pictures of the actual site. He
also stated that at the previous hearing, that the stormwater catch basin at the corner of Country Hill Road
and Old Ranch restricts the use of the site. The Public Works Department has researched this issue and
determined that the catch basin is a private improvement. Therefore a public easement is not required.
Melanie Adams, Associate Engineer, refen'ed to the staff report, page 4, paragraph 22, stating that with
regards to the public storm drain that was recently constructed in Country Hill Road as a condition of
approval for Tract Map No. 15565. The applicant will be required to submit a grading plan, prepared by a
registered civil engineer, for the guest house. The engineer can redesign the catch basin to minimize
impacts on the site and design a connection to the new public storm drain. The grading plan, including
drainage and any connections to the storm drain system, will be reviewed by the Public Works
Department. Ms. Adams stated that any homeowner interested in making property connections should
contact Peter Gambino at 765-5100 ext. 4053.

Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I hereby deny Variance No. 2001-04423 on the following
basis:
1. That the petitioner submitted a revised site plan showing a minimum 15-foot (instead of
10-foot) rear yard setback.
2. That there are no special circumstances applicable to this property pertaining to its
topography, size or shape because the lot slopes only slightly from north to south and the lot size and
shape are typical of other lots in the area, and the proposed guest house can be relocated in compliance
with Code requirements; and that, therefore, there is no demonstrated hardship relative to this lot that is
significantly different from other lots within the same vicinity and zone.
3. That no other variances have been applied for or granted within the neighborhood
surrounding the subject property and, therefore, strict application of the Zoning Code does not deprive
this property of privileges enjoyed by other surrounding RS-HS-22,000(SC) zoned properties in the
neighborhood.
4. That construction of a large, two-story guest house in close proximity to the public street
and the neighboring single family residence to the east would adversely affect the adjoining land uses
and the growth and development of the area in which it is proposed to be located because the guest
house would interfere with the lines-of-sight from the adjoining property in comparison to the lines-of-sight
if the guest house were constructed in compliance with Code requirements; and that the visual intrusion
is illustrated in a photograph contained in the Staff Report to the Zoning Administrator.
5. That the two-story proposal would have a significant visual impact on the neighboring
property because the setback is a 40% deviation from the Code requirement.

Having been appointed Zoning Administrator by the Planning Director, pursuant to Anaheim Municipal
Code Section 18.12.040, to decide the above-referenced petition and a public hearing having been duly
noticed for and held on the date set forth above, I hereby approve Variance No. 2001-04424 based on the
following:
1. That the proposed 5-foot high fence will be located along the south portion
(approximately 60 feet) of the front property line (241 feet long); and that the fence will not interfere with
lines-of sight to any nearby driveways.
2. That there are special circumstances applicable to the property consisting of its
topography, location and surroundings, which do not apply to other identically zoned properties in the
vicinity; and that although other properties in the area have variations in topography, this particular lot
has a very steep downward slope to the rear (east) of the lot with virtually no flat pad areas to build on, as
illustrated on the photographs submitted by the petitioner.
3. That strict application of the Zoning Code would deprive this property of privileges
enjoyed by other properties under identical zoning classification in the vicinity because numerous single
family residential hillside properties in the area have been granted permits for existing fences abutting
street frontages with various heights above the 3-foot maximum fence height limitation.
4. That the character and design of this front yard fence will be complimentary to the design
of the petitioner's residence and to the surrounding single family homes.
