Rafael Jimenez was present to respond to any questions staff had for the proposal.
Dena Kohler was present with opposition for this proposal. She stated that her concerns were with the
noise and the sales of beer and wine permitted so close to a residential area and High School. She
stated that the noise was so loud that it caused the 2"d-story floor of the condominium complex to vibrate.
Mr. Jimenez confirmed that the music was loud, but that it was during cone-time special event for which
he had obtained a Special Event Permit.
Condition Nos. 4 and 5 were modified at today's meeting to read as follows:
"4. That the gross sales of alcoholic beverages shall only be available in connection with the sales of
food. That the gross sales of alcoholic beverages shall not exceed 40 percent of the gross sales
of all retail sales during any three (3) month period. The applicant shall maintain records on a
quarterly basis indicating the separate amounts of sales of beer and wine and other items. These
records shall be made available for inspection by any City of Anaheim official when requested.
5. That there shall be no live entertainment, amplified music or dancing permitted outside of the
building and in the open seating area at any time."
