Annika Santalahti, Zoning Administrator, introduced item No. 1 and stated the issues included:
1. The status of a prior easement between the current property and the property to the west.
2. Whether the driveway location on Winston Road conforms to the ones typically seen in Anaheim.
3. Code requirement for 20 feet of landscaping along State College Boulevard in connection with
any new construction that occurs on the property.
4. A listing of the parking status on a separate list in the staff report.
John Ramirez, Associate Planner, stated there was a requirement on the previous Tentative Parcel Map
No. 96-173 where a condition of approval was included to require an unsubordinated covenant or
agreement for parking and access between the two new parcels. However in May of 2004, it was brought
back to the Zoning Administrator for an amendment to delete that condition and that deletion was
approved based on the fact that each parcel contained sufficient code required parking as we11 as street
access; one on Winston Road and the other on both Winston Road and State College Boulevard. That
item is sufficiently addressed in the staff report dated April 14, 2005 and there is assurance that the
subdivision presented would not have any impact on either the adjacent property owner's rights or access
or easements between the two properties.
Ms. Santalahti stated the driveway on Winston Road is located at the intersection of the curb radius of the
corner and asked what the Public Works thoughts were on the subject.
Mr. Ramirez stated the applicant submitted into the Building Plan Check process for construction of the
two new buildings and some interior TI to the existing building located on the site. With regard to that plan
review the Public Works Department Traffic Engineering Division indicated they would not be approving
the location of the driveway where it currently stands. There will be a need to coordinate between the

applicant and Public Works Department to find a resolution with relocating the driveway in a manner that
is both safe and practical for both public right-of-way access and also for the development of the property.
Ms. Santalahti asked for thoughts from the applicant.
Applicant Statement:
Brian Malliet, 1945 Placentia Avenue, Costa Mesa, CA, stated he understood everything was completely
taken care of and to have the driveway brought up in this stage of the game would require him to return to
his lawyer for legal counseling.
Ms. Santalahti stated it surprised her not to see a condition in the tract map that addressed the driveway
being relocated in a fashion to push it further back (the driveway appears to be located on the radius of
the intersection). Regarding landscaping; the strong indigo looks nice but there essentially is no
landscaping on the property. As for the existing building, it is unfortunate that it would remain but the
proposed building on the south, specifically because of the way the parcel line sits, has frontage on State
College Boulevard and needs to provide 20 feet of landscaping according to code. Regarding parking;
according to the staff report dated April 14, 2005 each parcel broken out has the required parking.
James Ling, Associate Civil Engineer, read a condition into the records as follows: That the legal
property owner shall irrevocably offer to dedicate to the City of Anaheim an easement for a corner cutoff
at State College Boulevard and Winston Road and an additional 8 foot dedicational right-of-way along
Winston Road for road, public utilities and other public purposes. Said easement shall be thirty-eight (38)
feet from the centerline of the street along Winston Road.
