THE PUBLIC HEARING WAS OPENED. Armando D. DuPont, the applicant, stated no comments. No one indicated their presence at the public hearing in opposition to the proposal and no correspondence was received in opposition. THE PUBLIC HEARING WAS CLOSED. Ms. Santalahti referred to staff regarding Item No. 3 (That all parcels shall be assigned street addresses by the Building Division) and asked if it is a standard tract parcel map condition or since it is an existing project, if there is some expectation that they would have new address numbers assigned to them. James Ling, Principal Civil Engineer, stated it is a typical condition set by the Public Works Department on behalf of the Building Department in order to ensure that the building permits will be assigned to a legal address. Ms. Santalahti referred to the applicant and asked what would happen if a building is demolished or destroyed etc., once the map is recorded and the airspace requirements are taken care of appropriately. Mr. DuPont responded all of the owners would have to agree to the separation through their association, and once separated, adhere to the proper procedures, destroy the building and rebuild it. OCTOBER 13, 2005 ZONING ADMINISTRATOR ACTION AGENDA Ms. Santalahti concurred with staffs determination that that the project is Categorically Exempt under Section 15315, Class 15 (Minor Land Divisions) of the CEQA Guidelines. Ms. Santalahti approved Tentative Parcel Map No. 2005-239 (to establish a 1-lot, 4-unit airspace condominium subdivision for an existing industrial complex) based on the following: 1. That a maintenance covenant shall be submitted to the Subdivision Section of the Public Works Department for review and approval, in a form satisfactory to the City Attorney. The covenant shall include provisions for the maintenance of private facilities and a maintenance exhibit. The covenant shall be recorded concurrently with the final parcel map. 2. That the final parcel map shall be submitted to and approved by the City of Anaheim and the Orange County Surveyor, and shall then be recorded in the Office of the County of Orange Recorder. 3. That all parcels shall be assigned street addresses by the Building Division of the Planning Department. 4. That an unsubordinated restricted covenant providing reciprocal access and parking shall be submitted to the Planning Services Division of the Planning Department, in a form satisfactory to the City Attorney, for review and approval; and following approval shall be recorded in the Office of the Orange County Recorder. A copy of the recorded covenant shall then be submitted to the Planning Services Division. In addition, provisions shall be made in the covenant to guarantee that the entire complex shall be managed and maintained as one (1) integral parcel for purposes of parking, vehicle circulation, signage, maintenance, land use and architectural control; and that the covenant shall be referenced in all deeds transferring all or any part of the interest in the property. 5. That prior to final parcel map approval, Condition Nos. 1, 3 and 4, above mentioned, shall be complied with. 6. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal Regulations. Dave See, Senior Planner, stated the applicant was notified of today's Zoning Administrator meeting but could not attend due to a conflict in schedule with a previously scheduled meeting. No one indicated their presence at the public hearing in opposition to the proposal and no correspondence was received in opposition. THE PUBLIC HEARING WAS CLOSED. Ms. Santalahti referred to staff and stated there was never a termination for Variance No. 1605 (waiver of one (1) story height limitation and side yard setback requirement to permit construction of a 35-unit apartment building with carports) approved by the City Council on February 13, 1964. She added a condition requiring termination of Variance No. 1605. Ms. Santalahti concurred with staffs determination that the proposed project fal{s within the definition of Categorical Exemptions, Section 15301, Class 1 (Existing Facilities), as defined in the State CEQA (California Environmental Quality Act) Guidelines and is, therefore categorically exempt from the preparation of further environmental documentation. That the applicant shall obtain the appropriate permit(s) from the Building Division of the Planning Department for the ten (10) foot high gates and fencing along the public alley. 3. That the applicant shall submit a letter to the Planning Department requesting termination of Variance No. 1605 (for waivers of a one-story height limitation and required side yard setbacks to construct a 35-unit apartment building with carports on subject property). 4. That Condition Nos. 2 and 3, above-mentioned, shall be complied with within a period of six (6) months from the date of this Decision.
