ZONING ADMINISTRATOR DECISION LETTER No action taken Project Planner: (avazquez@anahei m. net) Q.S.287 Annika Santalahti, Zoning Administrator, stated following the public notice for Administrative Adjustment No. 2005-00280, request to waive the minimum rear yard setback (15 feet required; 12 feet proposed), to construct a second story balcony to the rear of asingle-family residence in the RS-3 (SC) (Residential Single-Family, Scenic Corridor Overlay) zone, located at 1051 South Pine Canyon Circle, she ascertained that the balcony proposed for construction is permitted under code. The underline zoning, RS-3 zone, allows encroachments of balconies into required rear yard setbacks when the encroachment portion does not exceed more than 4 feet, and in this case a 3 foot encroachment already exists in the rear yard setback. Therefore the proposed balcony is permitted by right under sections: 18.04.100.010.0101 (Required: minimum 15-foot rear yard setback) 18.04.100.040 (Permitted: maximum 4-foot encroachment into the required 15-foot rear yard; Proposed: 3 feet) 18.04.100.040.0401 (Permitted: maximum 240 square feet encroachment into the required 15-foot rear yard, Proposed: 63 square feet). She concluded that an administrative adjustment is unnecessary, there is not an appeal period, and no further action is deemed necessary, other than the applicant obtaining the appropriate permit(s) for the proposed balcony from the City of Anaheim Planning Department, Building Division. THE PUBLIC HEARING WAS OPENED. Applicant's Testimony: Sylvano Ibay, representing the Anaheim White House Restaurant, 887 S. Anaheim Boulevard, Anaheim, CA, stated they concur with the requirements as listed in the staff report dated November 10, 2005. Public Testimony: Larry E. Slagle, President of the Yellow Cab Company of Northern Orange County, Incorporated, stated their company makes approximately 80 trips, daily, to and from the Anaheim White House Restaurant, in addition to having three other companies to back them up, and based on those standards together with other amenities, they believe Bruno, the owner, is an asset to the City of Anaheim and they wish to support him. Jerry Zomoradian, 301 S. Anaheim Boulevard, Anaheim, CA, stated Bruno's generosity and involvement with the community, along with operating a very clean and professional business makes him an asset to Page 3 ACZA111005.DOC • November 10, 2005 ZONING ADMINISTRATOR ACTION AGENDA the City of Anaheim. He further stated that the approval of this proposal will promote Bruno's business and he feels he will not be a risk to the public therefore, he supports his request. Wayne Wedin, 417 Associated Road Unit A-326, Brea, CA, stated as customers, he and his wife have never seen a parking problem at the Anaheim White House Restaurant, and they have been going there since it opened. He feels the restaurant falls into the category of great restaurants; ones that the City of Anaheim is uniquely proud of, particularly the restaurants that fall into the category with the ability to attract patrons of the Pond, the Stadium, etc., to go there after an event and have dessert or a glass of wine, etc. He suggests that a bar cannot be found in the Anaheim White House Restaurant, but rather it is a restaurant that serves beverages in addition to its main objective of both fine food and good atmosphere. Therefore, he asks that a favorable consideration be given to the request. John Fuhr, 508 S. Landmark Lane, Anaheim, CA, stated he moved here from Washington, D.C. and is a homeowner of the new John Laing properties, and having moved from a really vibrant city where there are lots of restaurants and outdoor dining, etc., he bought into the vision of the new downtown and what is happening in Anaheim in hopes that it will become a reality and therefore, he supports Bruno's request. THE PUBLIC HEARING WAS CLOSED. Ms. Santalahti asked the applicant, Mr. Ibay, to briefly describe the frequency and types of activities that would take place outside the restaurant. Mr. Ibay responded essentially the customer would sit down inside the restaurant for dinner and if they wanted to go outside after dinner and have a cigarette or cigar or a cordial, they would like to be able to accommodate them. For special occasions such as weddings, they would like to be able to serve outside until the duration of the event, but it would not be an everyday occurrence. Ms. Santalahti asked under what kind of circumstances the offsite parking would be needed, and how often. Mr. Ibay responded that he did not foresee it happening more than two or three times a year. Ms. Santalahti asked if he would know ahead of time. Mr. Ibay responded yes, 95% of their business is based upon reservations so that they know how many dinners they would need to prepare each night. Ms. Santalahti affirmed the Police Department reviewed the proposal and did not have any special concerns regarding the request based on other related special events that occurred in the past. No one else indicated their presence at the meeting regarding this item. THE PUBLIC HEARING WAS CLOSED. Ms. Santalahti referred to staff and asked if the previously approved waivers were the same as the ones being requested in today's meeting. Dave See, Senior Planner, responded the only change with the proposal is the addition of the two-story; the building footprints are the same and therefore the waivers are the same.
