LOCATION: 3131 West Ball Road: Property is approximately 0.5-acre,
having a frontage of 66 feet on the north side of Ball Road, a 15 day appeal period
maximum depth of 300 feet, and is located 60 feet west of the
centerline of Gourtright Street.
Waiver of minimum side yard setback to construct an addition to an existing
single-family residence.

David See, Senior Planner, introduced Item No. 1.
THE PUBLIC HEARING WAS OPENED.
Applicant's Testimony:
Carlos Hernandez, nephew of the owner at 3131 West Ball Road, Anaheim, CA, stated they agreed
with everything the City asked of them except closing the driveway. He proposed that there was still
green area in the front and they have two RV's (Recreational Vehicles), and that even with a single truck
they would have to watch very carefully to prevent having an accident. Therefore, he feels nine feet is too
narrow for the two RV's to maneuver through.
Mr. Sell stated concerns with the ingress and egress onto Ball Road and potential accidents occurring;
the yard looking like a used car lot; and that the applicant was possibly trying to turn the house into a
room and board.
Mr. Hernandez responded they could not afford a bigger home and therefore wished to make their
present home big enough for everyone who lived there (5 brothers, uncle, and 2 nephews -four are in
school). They planned to use stucco materials with a Spanish style roof, vinyl windows, and bay windows
because of noise reduction.

There was no public audience present at the meeting and no opposition was received regarding this item.
THE PUBLIC HEARING WAS CLOSED.
Mr. Sell asked the applicant if he would be willing to agree with a stipulation that they would park a
maximum of two RV's in the front.
Mr. Hernandez responded yes.
Mr. See stated staff would work with the applicant to write a requirement that RV's would be parked in the
front only where designated. Additionally, staff could work with the owner to do a landscape screen on
the sides that would soften the appearance somewhat.
James Ling, Principal Civil Engineer, asked to read conditions into the records as follows:
(1) Delete Condition No. 2
(2) [Added at the public hearing] That the proposed driveways shall be improved per City Standard
Detail No. 115-B. Said improvements shall clearly be shown on the grading plan.
(3) [Added at the public hearing] That a maximum of two (2) operable recreation vehicles (RVs) shall
be permitted within the front setback area as shown on the site plan. No other vehicles shall be
permitted within the front setback area.
(4) [Added at the public hearing] That a final site plan shall be submitted to the Planning Department
for review and approval.
THE PUBLIC HEARING WAS CLOSED.
Mr. Sell concurred with staff's recommendations and approved Categorical Exemption -Class 1 and
approved, in part, Variance No. 2006-04682 with stipulations pertaining to landscaping and screening,
and deleting Condition No. 2. He stated the decision would be written and signed no later than 7 days
and the applicants would receive a copy no later than 15 days following the date of the decision.
