Applicant's Testimony:
Glenn Lake, Fuscoe Engineering, 16795 Von Karman, Irvine, CA, stated they have read and concur with
the staff report.
THE PUBLIC HEARING WAS CLOSED.
Mr. See stated Condition No. 2 requires a maintenance covenant to ensure that the property is
maintained as one lot.
Mark Gordon, Deputy City Attorney, recommended that staff modify Condition No. 2 to state that prior to
final map approval, a maintenance covenant shall be submitted to the Subdivision Section and approved
by the City Attorney's Office; and also add a new condition to the conditions of approval stating that the
applicant shall execute and record with the Orange County Recorder a declaration of covenants,

conditions and restrictions ("CC&Rs") satisfactory to the California Department of Real Estate creating
maintenance obligations.
Mr. Sell concurred with staff's recommendations and approved Tentative Parcel Map No. 2006-225,
to establish a 1-lot, 54-unit commercial and industrial airspace subdivision, by adopting the attached
excerpt including the findings and conditions contained therein. He stated the decision would be written
and signed no later than 7 days from the date of the meeting and would be final after the appeal period
expires 10 days following the date of the decision.
