Bill Sell, Zoning Administrator, opened the public hearing.
Dave See, Senior Planner, introduced Item No. 2 and stated that staff received written opposition from a
neighbor opposing the structure height and therefore, the applicant requested a two week continuance in
order to speak with the opposing neighbor in hopes of resolving their differences. Also, staff received a
letter from an additional neighbor who did not express opposition or in favor of but concern only.
The applicant was not available for today's hearing.
Mr. Sell closed the public hearing and continued the item to the July 5, 2007 meeting as requested by the
applicant.

Applicant's Testimony:
Fady M. Tawadrous, 2260 West Lincoln Avenue #B1, Anaheim, CA„ stated they have a steep slope in
the back of their property and therefore feel the only place they can build is above the garage.
Gus Sadighi, 6661 East Canyon Hills Road, Anaheim Hills, CA, stated having three (3) children has
caused them to require extra room in their home and after contemplating the circumstances they reason
that the only place to build would be above the garage. He noted that there are other single level homes
in the neighborhood.
Mr. See stated that the applicants' house is oriented towards the front of the property and its contours
indicate slopes in the back and sides so for that reason the only thing the applicant could propose is the
top of the garage. Also, staff received a call from the Homeowners Association expressing concern about
the driveway and parking on the side of the house.
Mr. Sadighi submitted a letter from the Homeowners Association indicating their approval.

Mr. Tawadrous stated they desire an additional driveway because their driveway presents limitations and
they cannot park in the street. They presented a proposal for an additions! driveway.
Mr. See stated parking would have to be outside the 25 foot setback line which staff could grant
administratively.
Mr. Sell closed the public hearing and approved CEQA Categorical Exemption -Class 1 and VARIANCE
2007-04724. He stated the decision would be written and signed no later than 7 days from the date of the
meeting and would be final after the appeal period expires 15 days following the date of the decision.

Applicant's Testimony:
Hoss Eftekhari, Hoss William 8~ Associates, 100 S. Anaheim Boulevard, Suite # 360, Anaheim, CA,
representing the applicant, stated he has surveyed the property and find all of the buildings to be in
excellent condition, excluding one defect that needed to be repaired as mentioned in the tentative map.
There are 10 units; one is a pharmacy and the rest are doctors' offices. Most of them are occupied and
have one or two sewage systems. He stated the landscaping and irrigation looks fine and everything is
on separate water meters and separate sewers which are located on Ball Road. He stated that if it
deems necessary they are willing to remove a portion of the existing sidewalk to create a new sidewalk
and landscaping adjacent to the curb.
George Saadian, Landmark West Enterprises, 3712 W. Jefferson Boulevard, Los Angeles, CA, stated
that he did not believe there was a shared system of fire protection as mentioned in the staff report
conditions of approval therefore he asked if the issue could be addressed in today's meeting.
Mark Gordon, Deputy City Attorney, stated he was unaware of the condition and asked staff what
purpose the condition had in context of the subject project. He stated that someone from Public Works or
the Building Department could explain why the issue came up in the context of the subject development.

Mr. Sell called a brief recess in order to allow staff time to confer with the Fire Department.
Elaine Thienprasiddhi, Associate Planner, stated she spoke with Todd Rudaitis, Senior Fire Safety
Specialist, and he stated that initially he believed the building had sprinklers and since seeing that there
are none staff could do away with the condition.
Mr. Sell closed the public hearing and approved CEQA Categorical Exemption -Class 15 and Tentative
Parcel Map No. 2007 -140. He stated the decision would be written and signed no later than 7 days from
the date of the meeting and would be final after the appeal period expires 10 days following the date of
the decision.
