LOCATION: 3454 East Miraloma Avenue: This irregularly shaped 19.21-
acre property has a frontage of 655 feet on the south side of
Miraloma Avenue, a maximum depth of 1,270 feet, and is
located 180 feet west of the centerline of Grove Street (Pacific
Sunwear Corporation).
Request waivers of (a) minimum number of parking spaces and (b) maximum
floor area ratio to expand an existing industrial building for additional office
space.

John Van Doren, Zoning Administrator, opened the public hearing.
Dave See, Senior Planner, introduced Item No. 2.
Kerry Wilson, 4770 Campus Drive, Suite 100, Newport Beach, CA, stated the request is a very large site.
The facility has an 180,000 square foot building, and a 300,000 square foot building on site. The 300,000
square foot building is the distribution center. By the nature of their business they are not anywhere near
the density of an office building and they have parking exceeding 1,000 stalls, and 400 normally remain
empty. The request is to spread everyone out, not necessarily add staff but spread everyone out so they
could properly utilize more office space and the space to do that is in the distribution center building, and
it has about 120 employees that run the automated operations system.
Mr. Van Doren stated he reviewed the parking study and supports staff recommendation. He supports
the application with the understanding that they are not increasing the floor area of the building, but just
increasing the floor area use. They are changing the use of certain amount of square feet from

warehouse distribution to office. Office use is more intense in terms of occupation, number of people and
number of parking spaces, but they are not increasing the staffing level, just increasing the space for
them. The zoning laws relate to sufficient parking and is appropriate that a variance is requested
because the rules would allow for you to add employees, whether that is your intention now or not and
when you add employees then you increase parking space demand. He explained that a variance
attaches to the land and not to the business operation; therefore we need to be careful that we do not
create a situation that meets the present needs but creates a conflict for future needs or future owners.
He believes the parking study well delineates the number of parking spaces that are over and above what
is presently being used and allows a cushion if employees are added in the future.
Mr. Wilson clarified that they are adding floor area, on the second level.
Mr. See responded that the building foot print is not expanding, but they are adding floor area within the
existing building/air space which in effect increases the parking requirement which created the parking
variance, but according to the parking study it concluded that only 658 spaces are needed, which the
applicant currently far exceeds that amount with the existing supply.
THE PUBLIC HEARING WAS CLOSED.
Mr. Van Doren thanked Mr. See for the clarification and took action to approve the subject request.
