John Van Doren, Zoning Administrator, opened the public hearing.
Dave See, Senior Planner, introduced Item No. 3 and stated the applicant requests to subdivide the
center into three parcels. The fast food restaurant and retail center would be on its own parcels and a
reciprocal sharing of parking and access would be provided between the three parcels. As indicated in
the staff report, staff brought up an issue about an access easement between the subject property and
the Target store which is under construction to the north. The purpose of the easement is for open

access to be provided between the parcels to gain access to a new traffic signal which will be constructed
for the new Target store.
Mr. Van Doren stated he would like to review the plans and approval for the Target center to confirm what
may be required for the applicant of today's item.
Mr. See responded Public Works staff is in the process of bringing those plans to the meeting.
Mr. Van Doren stated there will not be a restriction on who can use the access, while it might serve a
general purpose in allowing employees and customers to find access to Euclid Street, it might also
facilitate ingress and egress for customers going to the different shopping locations.
Mr. See pointed out that it is the applicant's desire to have the easement, therefore staff included a
condition of approval requiring them to provide the easement. Staff would like to have that reflected on
the map but the applicant was not able to revise it in time for today's hearing, but staff feels that a
condition can be satisfied prior to the recording of the final map. Mr. See asked Mark Gordon, Assistant
City Attorney if he had any comments.
Mark Gordon, Assistant City Attorney, stated he agrees as long as the objective is accomplished before
they final the map. Condition No. 3 could be satisfied prior to the map becoming final then that would be
acceptable.
Mr. Van Doren stated staffs analysis identifies that the reciprocal access from the property to the north
would be provided so as long as the final map is conditioned to show that.
Wayne Jolley, Anacal Engineering, 1900 E. La Palma Avenue, Suite 202, Anaheim, CA, stated he agrees
with the condition pertaining to the ingress and egress access, and stated the document has been drafted
and is not aware at this time what the status of it is, and does not have a copy.
He stated the reason for the subject request is strictly for financial purposes as it makes it easier to lease
the buildings.
Mr. See referred to Condition No. 3, and stated prior to making a decision on the item staff is
recommending a modification to the condition to require the applicant to provide a copy of the recorded
covenant.
Mr. Gordon agreed with Mr. See that the new internal driveway access has to be shown and provided on
the map and staff will review the documents before the map is final.
Further discussion amongst staff took place pertaining to the easement agreement.
Mr. Van Doren asked to review Public Work's plans for the adjoining property; Sandip Budhia, Associate
Engineer, presented the grading plans for the Target Store and indicated it does not show an easement,
but it shows a block wall; and indicated this is what the grading permit was based on.
Mr. Van Doren and staff reviewed the plans and clarified questions; Mr. Van Doren stated he is
concerned because there is a parking adjustment/variance allowance for the creation of the Target site
and spaces are accounted for that. The anticipated agreement will take away spaces, therefore, they
need to hear from Traffic Engineering that it is an acceptable adjustment, and maybe the applicant for
Target may need to modify their application. He also wants confirmation that the circulation pattern will
function properly between the two properties.
Mr. See pointed out that Planning staff does not require an access easement between the properties and
are not trying to impose the condition on the applicant, but are just responding to what they want to do.

He feels the owner and applicant need to provide more information as to whether both property owners
concur and why the plan does not reflect that.
Mr. Van Doren understands that but wants to ensure if a condition is imposed, that the documents are in
place to ensure it is a sound decision on the City's part as well as the applicants.
Mr. Jolley indicated he will talk to the project manager and find out the necessary information and
respond to staff as soon as possible.
Mr. Gordon clarified that Mr. Van Doren has the choice of approving it the way it is today without any
additional condition regarding access to the northerly property or if they intend to modify the map to
accommodate that access then they will need to come back to demonstrate how they are going to be able
to accomplish that.
Mr. Van Doren indicated he understands the process and procedures, and he is concerned that if their
request had not been made by them then later on the City may have had issues.
Mr. Van Doren continued the subject item to the January 31, 2008 meeting, in order for the applicant to
come back with the necessary plans with some indication as to the acceptability and feasibility of an
agreement negotiating with the owner of the Target site, to ensure it is an appropriate inclusion of the
condition should the subject request go forward. He asked at the next hearing that any parking waiver or
adjustments be made available to him.
