John Van Doren, Zoning Administrator, opened the public hearing.
Dave See, Senior Planner, introduced Item No. 3 and stated he provided a site plan which depicts the
proposal and it is a vacant lot. Staff recommends approval of the request as they believe there is a
hardship; there is a very minimal buildable area on the lot which meets the findings for a variance. There
is a 20-foot wide utility easement and it is parallel to the I-5 Freeway.
Mr. Van Doren referred to the utility easement and asked for clarification in order to ensure it is not a
Caltrans easement where it might later impact the residents of the home.

Eugene Levert, 5352 Richmond Avenue, Garden Grove, CA, stated they located all the utilities along the
fence, along with the sewer and water lines.
Mr. Van Doren asked if the patio is covered or just a slab.
Mr. Levert responded it is just a slab, they are preliminary drawings to depict the footprint and it might get
revised to stay out of the easement but for right now it is just to provide general information.
Mr. See stated the setback is from the property line and the proposal complies with the setback adjacent
to the freeway; however, assuming the applicant can't build in the easement area, there are some
instances where something can overhang into an easement area, but the easement holder would have to
approve that. If the applicant cannot get approval for a roof overhang or a slab, then it would have to be
"clipped" back and that could be handled through plan check.
Mark Gordon, Assistant City Attorney, asked if there is a condition that deals with that that makes it a
requirement before they could establish the patio structure.
Mr. Levert stated he is very familiar with building on lots that are left over from Caltrans, and is very used
to the utility easements. He indicated he will not go over the easement; these are preliminary drawings
and when he gets the final drawings you will not see that encroach.
Mr. Gordon asked staff is there a condition as a requirement of approval that they build in conformity with
the current site plan or any plans being approved in connection with the subject action.
Mr. See responded there is a condition of approval which requires them to build in conformance with
Exhibit Nos. 1 and 2, but they could add a condition requiring the applicant to obtain an approval from the
easement holder to encroach or to keep the building entirely out of the easement area.
Mr. Van Doren indicated that the condition should state that they stay out of the easement, or obtain
approval from the easement holder for any encroachment.
Mr. Levert stated the lot stands alone and the other homes face Illinois Street; they are not putting the
home forward where it would protrude past the existing front setbacks of other homes. Now that Water
Street curves in, and there is already 10-foot walkway, by pushing it back another 25 feet, it really makes
it hard to put a building on there, but it gives the illusion that the house is pushed back on the lot where it
really would not look right. Those are the main things when you approach the street how the front
property is going to look. In taking all that into perspective those are the reasons they came to the
decision of a 15-foot front setback.
Mr. Van Doren took action to approve the subject request, with an added condition of approval.
