RESOLUTION NO. PC2004-24
A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION
TERMINATING ALL PROCEEDINGS IN CONNECTION WITH
CONDITIONAL USE PERMIT NOS. 186, 2149 AND 3054, AND
SPECIAL USE PERMIT NO. 32, AND
VARIANCE NOS. 1214 and 3290
WHEREAS, on April 20, 1959, the Anaheim City Planning Commission did, by its Resolution
No. 203, Series 1958-59, grant Special Use Permit (sometimes identified as `Conditional Use Permit') No. 32
to construct a convention exhibition building at 1601 South Manchester Avenue; and that said use no longer
exists; and
WHEREAS, on March 7, 1960, the Planning Commission did, by its Resolution No. 187,
Series 1959-60, approve Variance No. 1214 to establish a motel at the northwest corner of Katella Avenue
and Clementine Street; and that the motel no longer exists; and
WHEREAS, on January 9, 1962, the Anaheim City Council did, by its Resolution No. 62R-
27, grant Conditional Use Permit No. 186 to construct a theater-convention hall including a restaurant and
cocktail lounge east of Harbor Boulevard between Midway Drive and Katella Avenue; and that said use no
longer exists; and
WHEREAS, on December 1, 1980, the Planning Commission did, by its Resolution No.
PC80-218, grant Conditional Use Permit No. 2149 to permit construction of recreational facilities in
conjunction with an existing educational institution (Melodyland Christian Center) on 5.85 aces on the north
side of Katella Avenue about 830 feet east of Harbor Boulevard; and that said use no longer exists; and
WHEREAS, on September 20, 1982, the Planning Commission did, by its Resolution No.
PC82-175, approve Variance No. 3290 for waiver of minimum number of parking spaces to expand an
existing motel at 301 West Katella Avenue; that said variance was subsequently terminated erroneously
(Resolution No. PC95-6) but the error was corrected in connection with a`nunc pro tunc' resolution (No.
PC95-28); and that the motel no longer exists; and
WHEREAS, on August 15, 1988, the Planning Commission did, by its Resolution No. PC88-
226, grant Conditional Use Permit No. 3054 to permit a 40-patient birthing center, 200-person child care
facility and 100-person adult daycare facility at 400 West Freedman Way; and that said conditional use
permit was never exercised; and
WHEREAS, the six above-listed entitlements pertain to various parcels totaling 15.46
acres located between Disney Way and Katella Avenue, and also having frontage on the northwest
corner of Katella Avenue and Clementine Street; and that subject area is illustrated on the Location
Map attached to the Staff Report to the Planning Commission dated March 8, 2004; and
WHEREAS, on February 26, 2002, the Anaheim City Council did, by its Resolution
No. 2002R-57, amend Conditional Use Permit No. 4078 to permit the Pointe Anaheim Lifestyle Retail
and Entertainment Complex (now known as "Anaheim GardenWalk") with waiver of the minimum
number of parking spaces on 29.1 acres located between Harbor Boulevard and Clementine Avenue,
and Disney Way and Katella Avenue; that the project includes retail/dining/ entertainment uses
including an aquarium, four hotels with up to 1,662 hotel rooms/suites (of which up to 200 units may
be Vacation Ownership Resort units) with related accessory uses, and a multi-story parking structure
with up to 4,800 striped parking spaces and 15 bus spaces with a 10,200 sq.ft, bus terminal/facility for
transport to and from airports and sightseeing venues, with development taking place in up to five

phases; and that Condition No. 74-D of said resolution specifies that the petitioner request termination
of zoning petitions that have never been exercised or that entitle uses which no longer exist, including
Conditional Use Permit Nos. 186, 2149 and 3054, and Special Use Permit No. 32, and Variance Nos.
1214 and 3290, all which apply to the 15.46-acre subject property; and
WHEREAS, the subject parcels, comprising 15.46 acres of the overall 29.1 acre
Anaheim GardenWalk project site, are vacant and undeveloped and are zoned Development Area 5
(District A)/Pointe Anaheim Overlay and Development Area 3.a (Parking District)/C-R Overlay and
Pointe Anaheim Overlay in The Disneyland Resort Specific Plan No. SP92-1; and
WHEREAS, Geoff Sherman, representing Price Legacy Corporation which has control over
the 15.46-acre subject property, has submitted a letter requesting termination of Conditional Use Permit Nos.
186, 2149 and 3054, and Special Use Permit No. 32, and Variance Nos. 1214 and 3290 to comply with
Condition No. 74-D of Conditional Use Permit No. 4078.
NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does
hereby terminate all proceedings in connection with Conditional Use Permit Nos. 186, 2149 and 3054, and
Special Use Permit No. 32, and Variance Nos. 1214 and 3290 on the basis of the foregoing findings.
