PC2007-122 A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION THAT PETITION FOR CONDITIONAL USE PERMIT NO. 2007-05216 BE GRANTED (NO ADDRESS) WHEREAS, the Anaheim Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, described as: An irregularly-shaped approximately 1.85-acre area situated in the County of Orange, State of Califoi`riia, as shown in Attachment No. 1 attached hereto and incorporated herein by this reference as if set forth in full; WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on October 15, 2007, at 2:30 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed vehicle storage and display lot is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.08.030.040.0402 (Automotive-Car Sales & Rental); and 2. That the proposed use would not adversely affect the adjoining land uses and the growth and development of the area in which it is located because the operation would be a storage lot and any operational impacts will be mitigated by conditions of approval and mitigation measures; and 3. That the traffic generated by the use would not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area because adequate parking is provided on-site and the vehicles stored at this site will be delivered individually and not delivered by automobile transport trucks; and 4. That granting this conditional use permit, under the conditions imposed, will not be detrimental to the health and safety of the citizens of the City of Anaheim; and 5. That 2 people indicated their presence at said public hearing and spoke with concerns on lighting; and that no correspondence was received in opposition to the subject petition. - 1 - PC2007-122 ~ ~ CALIFORNIA ENVIRONMENTAL QUALITY ACT FINDING: That the Anaheim Planning Commission has reviewed the proposal to redesignate the subject property to General Commercial and does hereby approve the Mitigated Negative Declaration and associated Mitigation Monitoring Plan No. 148 upon finding that the declaration reflects the independent judgment of the lead agency and that it has considered the Mitigated Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW, THEREFORE, BE IT RESOLVED that the Anaheim Planning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the health and safety of the Citizens of the City of Anaheim: Prior to final and zoning insuections or within a period of one (1) vear from the date of this resolution, whichever occurs first, the followin~ conditions shall be complied with: That subject property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the applicant and which plans are on file with the Planning Department marked Exhibit Nos. 1 through 3, and as conditioned herein. 2. That any lighting onsite shall be arranged and directed so as to reflect the light away from the adjoining residential properties. Said information shall be specifically shown on the plans submitted for building permits. 3. That the easternmost two light poles located in tlie middle of the property be removed entirely and the third light pole from the eastern part of the property be reduced to one light source. 4. That all lighting on the dealership site shall be reduced to a height of fourteen (14) feet to minimize impacts to adjacent residents to the greatest extent possible. All lights shall be shielded to hide the light source from view. At 8:30 p.m. daily, lighting located in the middle of the property shall be reduced to the minimum needed to provide adequate security lighting. Compliance with this condition of approval requires approval from Planning Services Division staff upon final inspection. Any light impacts identified at said inspection shall be mitigated prior to commencement of the activity. Any decision by Planning Services staff may be appealed to the Planning Commission as a Reports and Recommendations item. 5. That the trees in the landscape setback area along the southern property line shall be a minimum size of 36-inch box trees with a minimum height of fifteen (15) feet. Prior to issuance of a building qermit, the following condition shall be complied with: 6. That the applicant shall submit a photometric plan for review by the Planning Commission as a"Reports and Recommendations" item to fully demonstrate the intensity and distribution of light on the subject and surrounding properties. - 2 - PC2oo7-122 • • Prior to approval of a~rading plan, the followin~ conditions shall be complied with: 7. The developer shall submit a copy of the signed lease agreement with Caltrans to verify the site boundary and any development restrictions imposed by Caltrans. 8. The developer shall amend the Final Water Quality Management Plan to include the expanded site boundary. 9. The landscape plan for perimeter landscaping shall be submitted to and approved by the Planning Department. The landscape plan shall conform to the recommendations of the City of Anaheim SR-91 Corridor Landscape Opportunities Survey: Interstate 5 to Riverside County Line and exhibit approved by the Planning Commission. General Conditions: 10. That the granting of this conditional use permit is subject to the approval of Reclassification No. 2007-00202 and General Plan Amendment No. 2007-00457 now pending. 11. That the property owner/developer shall be responsible for compliance with all the mitigation measures set forth in Mitigation Monitoring Plan No. 148 (Attachment No. 2 to this Resolution) created specifically for this project, and for complying with the monitoring and reporting requirements established by the City in compliance with Section 21081.6 of the Public Resources Code. Furthermore, the property owner developer shall be responsible for any direct costs associated with the monitoring and reporting requirements to ensure implementation of the mitigation measures identified in Mitigation Monitoring Plan No. 148, which are made a part of these conditions of approval by reference. 12. That because this project has landscaping areas exceeding two thousand five hundred (2500) square feet, a separate irrigation meter shall be installed in compliance with Chapter 10.19 (Landscape Water Efficiency) of Anaheim Municipal Code and Ordinance No. 5349. Said information shall be specifically shown on the plans submitted for building permits. 13. That no signs of any kind shall be displayed on the subject property at any time. 14. That outdoor special events shall be subject to review and approval by Zoning Division staff and shall be conducted in a manner that will not adversely affect the adjoining residential land uses. 15. That no vehicle preparation including washing, drying, detailing and cleaning, or repair or maintenance work shall be permitted. 16. That vehicles shall not be delivered by automotive transport trucks. All inventory shall be independently delivered to this site (i.e., each vehicle shall be individually driven to this site). 17. That no loud speakers shall be permitted. - 3 - PC2007-122 ~ • 18. That quarterly inspections are required and shall be conducted by the Planning Department to determine compliance with conditions of approval and to ensure that the onsite lighting is maintained in a way that is not intrusive to the adjacent residences. All such inspections are to be paid for by the applicant. 19. That timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition(s), (ii) the modification complies with the Anaheim Municipal Code and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development. 20. That extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Anaheim Municipal. 21. That approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the Anaheim Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED that the applicant is responsible for paying all charges related to the processing of this discretionary case application within 15 days of the issuance of the final invoice or prior to the issuance of building permits for this project, whichever occurs first. Failure to pay all charges shall result in delays in the issuance of required permits or the revocation of the approval of this application. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of October 15, 2007. Said resolution is subject to the appeal provisions set forth in Chapter 18.60, "Zoning Provisions - General" of the Anaheim Municipal Code pertaining to appeal procedures and may be replaced by a City Council Resolution in the eyent of an ~ppeal. This MMRP is in compliance with Section 15097 of the California Environmental Quality Act (CEQA) Guidelines, which requires that the Lead Agency "adopt a program for monitoring or reporting on the revisions which it has required in the project and the measures it has imposed to mitigate or avoid significant environmental effects." The MMRP lists mitigation measures recommended in the IS/MND and identifies mitigation monitoring requirements. These requirements are provided only for mitigation measures that would reduce or avoid significant impacts of the proposed project. Table A presents the mitigation measures identified for the proposed project. Each mitigation measure is labeled consistent with the topical section in the IS/MND to which it pertains. The first column of Table A provides the mitigation measures that were identified in the Environmental Issues discussion of the IS/MND. The columns titled "Party Responsible for Implementing Mitigation" and "Implementation Timing" identify the party responsible for carrying out the required actions and the approximate time period over which the actions will be implemented, respectively. The columns titled "Party Responsible for Monitoring," "Action by Monitor," and "Monitoring Timing" identify the party ultimately responsible for ensuring that the mitigation measure is implemented, the steps for monitoring the action identified in the mitigation measure, and the approximate timeframe for the oversight agency to ensure implementation of the mitigation measure, respectively. Any occupied bird nests/burrows found during survey efforts shall be mapped on the construction plans. To ensure compliance with Sections 3503 and 3503.5 of the Califomia Fish and Game Code and the federal MBTA, if bird nesting activity is detected at any nesUburrow site, then the active site shall be protected until nesting activity has ended. Nesting activiry for birds in the region of the project site normally occurs between February 15 and September 15. Between February 15 and September 15 (unless nesUburrows are no longer active as determined by a qualified biologist), the following restrictions on construction are required to protect nesUburrow sites: (1) clearing limits shall be established at a minimum of 150 ft in any direction from any occupied nesUburrow; and (2) access and construction surveying shall not be allowed within 50 ft of any occupied nesUburrow. Construction during the nesting season can occur at the nest sites if a qualified biologist has determined that the nesUburrows are no longer active. The archaeologist shall attend one pregrading meeting and provide specific communication and grading activiry protocols to be followed in the event of a possible find, even though the probability of discovering any finds is very low. In addition, the archaeologist shall conduct at least one visit during the active hours of grading operations to ensure that recommended protocols are being followed. Should potential archaeological finds be discovered during grading, all grading shall be halted and the archaeologist shall be called to record newly discovered resources and to salvage and catalog cultural materials as necessary. The archaeologist shall establish procedures for archaeological resource surveillance and would have authority, in cooperation with the City, to temporarily halt or divert work to permit sampling, identification, and evaluation of artifacts as appropriate. If the archaeological resources are found to be significant, the archaeologist shall determine appropriate actions, in cooperation with the City, for exploration and/or salvage. The archaeological monitor would (1) ascertain the significance of the resource, (2) establish protocol with the City to protect such resources, and (3) ascertain the presence of additional resources. Significant resources may require additional excavation and cultural resource work.
