A RESOLUTION OF THE ANAHEIM PLANIVING COn~IIvIISSIdN
APPROVING A NEGATNE DECLARATION t~ND
APPROVII~7G CONDTTIONAL USE PERMIT NO. 2008-05326 WITH WAIVER OF
MINIMUM NUMBER OF PARICING SPACES
(502 - 524 EAST JULIANNA STREETj
WIIEREAS, the Anaheim Planning Commission did receive a verified Petition
for Condirional Use Permit For a towing service and impound facility with the washing of towing
vehicles on certain real property situated in the City of Anaheim, County of Orange, State of
California, shown on Exhibit A, attached hereto and incorporated herein by this reference.
WHEREAS, the property is developed witli three industrial buildings located in
the Industrial zone and the Anaheim General Plan designates the properiy for Industrial land
uses; and
VJHEREAS, the proposed request to permit a tocvin~ and vehicle impound facility
wiN~ the washing of towine vehic]es at 502 - 524 East Julianna Street with waiver of the
following:
SECTION 18.42:040.010 Minimum required pazkine spaces.
(68 spaces required; 38 spaces proposed)
WHEREAS, the Plannmg Commission did hold a public hearing at the Civic
Center in the City of Anaheim on June 23, 2008, at 2:3D p.m., notice of said public hearing
having been duly given as tequired by law and in accordance with the provisions of the Anaheim
Municipal Code, Chapter 18:60, to heaz and consider evidence for and against said proposed
condirional use permit and to investigate and make findin~s and recommendarions in connection
therewith; and
WHEREAS, said Comurission, after due iuspecrion, investigation and s[udy made
by itself and in its behalf, and after due considerakion of all evidence and reports offered at said
I~earing, does find and determine the following facts:
1. That the towing and impound facility with the washing of tow vehicles in the
Industrial (n zone is properly one for which a condiuonal use permit is authorized by Anaheim
Municipal Code Section 18.10.030.040.0402 (Towing Services and Automotive Impound
Yazds).
2. That the towing and impound facility would not adversely afFect the adjoining
indushial land uses and the Lrowth and development pf the area in which it is proposed to be
located because all Uusiness acrivities would remain inside the building.
:i. ThaY the size and shape of the site for the towing and impound facility is adequate
to allow the full development pf the proposed use in a manner not dehimental to the particular

area nor to the health, safety and general welfare of the public because the business would
remain inside the building and automotive repairs and modifications aze not proposed.
4. That the variaztce wi11 not cause fewer off-sh-eet pazking spaces to be provided for
the proposed uses than the number of spaces necessary to accommodate ali vehicles as the
towing and impound business will only require parlang for employees as customers are dropped
off and do not park. Further, the business provides seven enclosed employee parkino spaces iu
addirion to tl~ose required to be shared between the three uses on the preuuses.
5. That the results of the parldng observations indicate that DuBois Towing will not
require an off-site pazldng supply. Employee vehicle and tow truck pazking will be
accommodated within the enclosed azea, and the customer parking supply of four spaces will be
in excess of tUe pazldng demand observed at the existutg busuzess location.
6. That the traffic generated by the towinp and 'unpound facility would not impose
an undue burden upon the streets and highways designed and improved to carry the traffic in the
area because the towing and impound facility is consistent with the types of industrial uses in ttie
zone, including a trucking business across Julianna Sheet.
7. That no one indicated their presence at said public hearing in opposition; and that
no correspondence was received in opposition to the subject petirion.
WHEREAS, the Anaheim Planuing Commission has reviewed the proposal and
does hereby find that the Negarive Declaration is adequate to serve as the requued environmental
documentarion in connection with this request.
NOW, TF~REFpRE, BE IT RESOLVED that the Anaheim Planning
Commission for the reasons hereinabove stated does hereby grant subject Petirion for
Conditional Use Permit upon the following condirions which aze hereby found to be a necessary
prerequisite to the proposed use of the subject property in order to preserve the health, safety and
general welfare of the Citizens of the City of Anaheim:

subuutted to the Public Works Department for review
and approval.

3 That vehicle washing shall be limited only to towing Planning
vehicles and nottowed vehicles.
4 That vehicular body work, paniting or other automotive Planning
modification activities shall not be permitted on the
premises.
~ That impound parking of vehicles overuight shal] be Plam~ing
permitted only inside Building 3 or the enclosed outdoor
storage azea as designated on Exhibit No. 1. Shared
parking for the three (3) buildin~s shall not be used.
6 That if the towing and impound facility is expanded into Planning
Buildings 1 ancUor 2, the site and floor plan shall be
submitted to the Planning Commission for review and
approval as a Reporfs and Recommendations item.
Additional parking is not required as Iong as there is no
expansion of office azea.
7 That outdoor storage shall be limitad to the area Planning
designated on Erlubit No. 1.
8 Tbat the installation or use of any exienor intercom Planning
equipment shall be prolubited.
9 That ongoin~ during project operation, under no Public Works
circumstances shall tow vehicles be unloaded Qr loaded
on any public right-of-way nor shall any vehicles be
parked or staged on said streets.
10 T'hat gates shall not be installed across any driveway in a Planning
manner which may adversely affect vehicular traffic in
the adjacentpublic slreets.
GENERAL CONbITIONS
] 1 Tbat the property shall be permanenfly maintained in an Planning
orderly fashion through the provision ofregular
lazidscaping maivtenance, removal of trash or debris, and
removal of graf5ti within twenty-four (24) hours from
the time of discovery.
12 That timing for compliance with condirious of approval Planning
may be aznended Uy the Planning Director upon a
showing of good cause provided (i) equivalent tuning is
establisl~ed that satisfies the original intent aud purpose
of the condition(s), (ri) the modification complies with
the Anaheim Municipal Code and (iii) the applicant has
demonstrated significant progress towazd establishment
of the use or approved developineut.

13 That approval of this application constifutes approval of Planning
the proposed request only to the extent that it complies
with the Anaheim Municipal Zoning Code and any other
applicable City, State and Federal regulaUons. Approval -
does not include any acrion or findiugs as to compliance
or approval of the request regardina any other applicable
ordinance, reoulation or requirement,
14 That extensions for fiirther time to complete conditions Planuing
of agproval may be granted in accordance with Section
18.60. ] 70 of the Anaheim Municipal Code.
BE IT FURTHER RESOLVED that ttus permit is approved without limitations
on the hours of opemtion or the duration of the use. Amendments, modifications and revocations
of this pernut may be processed in accordance with Chapters 18,60190 (Aiuendment of Pernut
Approval) and 18.6~.200 (City-Initiated Revocarion or Modification of Permits) of the Anaheim
Municipal Code.
BE IT FURTHER RESOLVED that the Anaheim Planning Commission does
hereby find and determine that adoption of this Resolution is expressly predicated upon
applicant's compliance k~ith each and all of the conditions hereinaUove set forth. Should any
such condirion, or any part thereof, be declared invalid or unenforceable by the final jud~ent of
any court of competent jurisdiction, then this Resolution, and any approvals herein contained,
shaIl be deemed null and void.
BE IT FURTHER RESQLVED that the applicant is responsiUle for paying all
charges related to the processing of tlus discretionary case application within 15 days of the
issuance of the final invoice or prior to the issuance of building permits for this project,
whichever occurs first. Failure to pay all charges shall result in delays in the issuance of required
permits ox the revocation of the approval of ilus application.
THE FOREGOING RESdLiJTION was adopted at the Planuing Commission
meeting of June 23, 2008. Said resolution is subject to the appeal provisions set forth in Chapter
18.60, "Zoning Provisions - General" of the Anaheim Municipal Code pertaining to apgeal
procedures and may be replaced by a City Council Ij.esolurion in the event of an appeal.
