A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION
APPROVING A CEQA NEGATNE DECLARATION
AND APPROVING AN AMENDMENT TO CONDITIONAL USE PERMIT NO. 424
AND AMENDING CERTAIN CONDITIONS OF APPROVAL
OF RESOLUTION NO. 776 SERIES 1962-63. ADOPTED THEREWITH
(TRACKING NO. CUP2008-05393)

WHEREAS, the Anaheim Planning Commission did receive a verified Petition
for Conditional Use Permit to amend apreviously-approved conditional use permit to allow the
expansion of an existing church to include the addition of six Sunday school classrooms,
expanded restrooms, and a child play area on certain real property situated in the City of
Anaheim, County of Orange, State of California, shown on Exhibit "A" attached hereto and
incorporated herein by this reference.
WHEREAS, the Planning Commission did hold a public hearing at the Civic
Center in the City of Anaheim on February 2, 2009, at 2.30 p.m., notice of said public hearing
having been duly given as required bylaw and in accordance with the provisions of the Anaheim
Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed
conditional use permit and to investigate and make findings and recommendations in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation .and study made
by itself and in its behalf, and after due consideration of all evidence and reports offered at said
hearing, does find and determine the following facts:
1. That the proposed expansion of an existing church to include the addition of six
Sunday school classrooms, expanded restrooms, and a child play area in the Transitional (T)
zone is properly one for which a conditional use permit is authorized by Anaheim Municipal
Code Section 18.04.030.040.0402 (Churches).
2. That the, expansion of an existing church to include the addition of six Sunday
school classrooms, expanded restrooms, and a child play area as conditioned, will not adversely
affect the adjoining land uses and the growth and development of the area in which it is located
because the church will provide the required number of parking spaces for the proposed
expansion.
3. That the size and shape of the site for the use is adequate to allow the expansion
of the church in a manner not detrimental to either the particular area or health and safety as the
property is fully developed and there is sufficient parking to provide for the uses on the property.
4. That the Craffic generated by the use of the property will not impose an undue
burden upon the streets and highways designed and improved to carry the traffic in the area.

5. That the granting of the conditional use permik under the conditions imposed will
not be detrimental to the health and safety of the citizens of the City of Anaheim.
6. That no one indicated their presence at said public hearing in opposition; and that
no correspondence was received in opposition to the subject petition.
NOW, THEREFORE, BE IT RESOLVED, that the Anaheim City Planning
Commission has reviewed the proposal and does hereby find Chat the Negative Declaration is
adequate to serve as the required environmental documentation in connection with this request,
BE IT FURTHER RESOLVED that the City of the Anaheim City Planning
Commission does hereby approve the amendment to Conditional Use Permit No. 424.
BE IT FURTHER RESOLVED Chat the Anaheim City Planning Commission
does hereby amend, in kheir entirety, the conditions of approval adopted in connection with
Resolution No. 776 SERBS 1962-63, approving Conditional Use Permit no. 424, to read as
stated in ExhibiC `°B" attached hereto and incorporated by this reference which are hereby found
to be a necessary prerequisite to the proposed use of the subject property in order to preserve the
health, safety and general welfare of the Citizens of the City of Anaheim.
BE IT FURTHER RESOLVED this permit is approved without limitations on the
hours of operation or the duration of the use. Amendments, modifications and revocations of
this permit may be processed in accordance with Chapters 18.60.190 (Amendment of Permit
Approval) and 18.60,200 (City-Initiated Revocation or Modification of Permits) of the Anaheim
Municipal Code.
BE IT FURTHER RESOLVED that the Anaheim Planning Commission does
hereby find and determine that adoption of this Resolution is expressly predicated upon business
owner's compliance with each and all of the conditions hereinabove set forth. Should any such
condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any
court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall
be deemed null and void.
BE IT FURTHER RESOLVED that the business owner is responsible for paying
all charges related to the processing of this discretionary case application within l5 days of the
issuance of the final invoice. Failure to pay all charges shall result in the revocation of the
approval of this application.
BE IT FURTHER RESOLVED that, except as expressly amended herein, the
provisions of Resolution No. 776 SERIES 1.962-63, approving Conditional Use Permit No. 424,
shall remain if full force and effect.

THE FOREGOING RESOLUTION was adopted at the Planning Commission
meeting of February 2, 2009. Said resolution is subject to the appeal provisions se[ forth in
Chapter 18.60, "Zoning Provisions -General" of the Anaheim Municipal Code pertaining to
appeal procedures and may be replaced by a City Council Resolution in the e nt of an appeal.

TIMING: PRIOR TO ISSUANCE OF A GRADING PERMIT
1 Prior to grading plan approval, the applicant shall submit Public Works
a Drainage Study prepared by a registered professional
Civil Engineer in the State of California. The Study
shall be based upon and reference the latest edition of
the Orange County Hydrology Manual and the
applicable City of Anaheim Master Plan of Drainage for
[he project area. All drainage sub-area boundaries per
the Master Plan for Drainage shall be maintained. The
Study shall include: an analysis of 10-, 25- and 100-year
storm frequencies; an analysis of all drainage impacts Co
the existing storm drain system based upon the ultimate
project build-out condition; and address whether off-site
and/ or on-site drainage improvements (such as
detention/ retention basins or surface runoff reduction)
will be required to prevent downstream properties from
becoming flooded.
2 Prior to grading plan approval, the developer must subtniC Public Works
a geotechnical report that meets the requirements for a
"Screening h3vestigaCion for Liquefaction Potential" as
identified in DMG special publicaCion 117 "Guidelines for
Evaluating and Mitigating Seismic Hazards in Califomia".
Please note that if the findings of the screening
investigation cannot demonstrate the absence of
liquefaction hazards, Chen the comprehensive quantitative
evaluation must be conducted to develop mitigation
recommendations to effectively reduce the hazard to an
acceptable level.
g Prior to the issuance of grading permit, the applicant shall Public Works
submit to the Public Works Department Development
Services Division for review and approval a Water Quality
Management Plan that:
® Addresses Site Design Best Management Practices
(BMPs) such as minimizing impervious areas,
maxinuzing permeability, minimizing directly
connected impervious areas, creating reduced or
"zero discharge" areas, and conserving natural
areas.
® Incorporates the applicable Routine Source
Control BMPs as defined in the Drainage Area
Mana ement Plan.

• Incorporates Treatment Control BMPs as defined
in the DAMP.
• Describes the long-term operation and
maintenance requirements for the Treatment
Control BMPs.
• Identifies the entity that will be responsible for
long-term operation and maintenance of the
Treatment Control BMPs, and
• Describes the mechanism for funding the long-
term operation and maintenance of the Treatment
Control BMPs.
4 Prior to issuance of the grading permit, applicant shall Public Works
obtain a demolition permit for demolition of existing
structures.
TIMING: PRIO R TO ISSUANCE OF A BUILDING PERMIT
5 The sewer impacC fee for West Anaheim (Zone C) shall be Public Works
paid. The fee is currently $359 per 1,000 s.f. of gross floor
area (institutional).
TIMING: PRIOR TO FINAL BUILDING AND ZONING INSPECTION
6 The applicable Citywide Traffic Impact Fee shall be paid Public Works
to the City of Anaheim, in an amount established by the
City Council Ordinance/Resolution prior to the issuance
of a building permit. This fee will be used to fund traffic
and transportation improvements within the area
impacted by this project. Said fee shall be subject to
adjustment by the City Council.
~ Prior to issuance of certificate of occupancy, the applicant Public Works
shall:
• Demonstrate that all structural BMPs described in
the Project WQMP have been constructed and
installed in conformance with approved plans and
specifications.
• Demonstrate that the applicant is prepared to
implement all non-structural BMPs described In
the Project WQMP
• Demonstrate that an adequate number of copies of
the approved Project WQMP are available onsite.
Submit for review and approval by the City an Operation
and Maintenance Plan for all structural BMPs
8 Gates shall be added to the existing trash enclosure. Public Works

9 Fire lanes shall be pasted with "No Parking Any Time." Public Works
Said information shall be specifically shown on plans
submitted for building permits.
10 Complete aBurglary/Robbery Alarm Permit applieat5on, Police
Form APD 516, and return it to the Police Department
prior to initial alarm activation. This form is available at
the Police Department front counter, or it can be
downloaded from the following web site:

11 Business to be equipped with alarm system (silent or Police
audible). Provide comprehensive security alarm system
for the following:
® Perimeter building and access route
protection.
® High valued storage areas.
12 Rooftop address numbers for the police helicopter shall Police
be painted on the roof. Minimum size 4' in height and
2' in width. The lines of the numbers are to be a
minimum of 6" thick. Numbers should be spaced 12" to
18" apart. Numbers should be painted or constructed in
a contrasting color to the roofing material. Numbers
should face the street to which the structure is addressed.
Numbers are not to be visible from ground level.
i3 Industrial, commercial., institutional, or office buildings Police
shall have clearly mazked doors with numbers
corresponding to the alarm zones, if any. The
identification of alazm zone coverage will assist
responding police and security units in faster
identification and apprehension of potential suspects, if
any.
14 Adequate lighting of parking lots, driveways, circulation Police
areas, aisles, passageways, recesses, and grounds
contiguous to buildings shall be provided with lighting
of sufficient wattage to provide adequate illumination to
make clearly visible the presence of any person on or
about the premises during the hours of darkness and
provide a safe, secure environment for all persons,
property, and vehicles on-site.
15 Trees should not be planted close enough to the structure Police
to allow easy access to the roof, or should be kept
trimmed to make climbing difficult.

17 Classroom doors should be equipped with locks that can Police
be locked from the inside, allowing lockdown of those
rooms in the event of criminal activity in, or around the
building. All classroom windows shall be left clear and
unobstructed, to allow an unimpaired line of sight by a
peace office into the interior of the classroom during
school hours.
GENERAL'
18 That on-going during project operation, no required Public Works
parking areas shall be fenced or otherwise enclosed for
outdoor storage uses.
19 That approval of this application constitutes approval of Planning
the proposed request only to the extent that it complies
with Che Anaheim Municipal Zoning Code and any other
applicable City, State and Federal regulations. Approval
does not include any action or findings as to compliance
or approval of the request regarding any other applicable
ordinance, regulation or requirement.
20 ThaC extensions for further time to complete conditions Planning
of approval may be granted in .accordance with Section
18.60.170 of the Anaheim Municipal Code.
