Continued from the Zoning Administrator meeting of May 21, 1987, in order to be readvertised with the correct hearing time and from the June 4, 1987, meeting in order for applicant to submit .revised plans. Having been appointed Zoning Administrator by the Director of Community.. Development, pursuant to Anaheim Municipal Code Section 18.12.060, to decide the above-referenced petition and a public hearing having been duly noticed for and held on the date set forth above, I do hereby find, that: 1. That, pertaining to maximum lot coverage, there are no special circum- stances applicable to the property such as size, shape, topography, location or surroundings, which do not apply to other identically zoned properties in the vicinity; and 2. That strict application of the Zoning Code pertaining to maximum number of bedrooms deprives the property of privileges enjoyed by other properties in identical zoning classification in the vicinity. 3. That review of an aerial photograph, dated December 1986, indicates all other rectangularly-shaped parcels in the immediate vicinity have 15-foot rear yard setbacks, or greater, and that the proposed lot coverage waiver would reduce the setback to 10 feet. Based on the evidence and testimony presented to me, I do hereby determine to approve Variance No. 3659, in part, denying waiver (a) on the basis that all other rectangularly-shaped parcels in the immediate vicinity comply with the Code required 35$ maximum lot coverage; and approving waiver (b), in part, permitting a maximum of four bedrooms rather than five as proposed, subject to the following conditions as modified: 1. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim marked Exhibit Nos. land 2; provided,. however, that a minimum fifteen (15) foot building setback shall be maintained from the rear (west) property line, that lot coverage shall not exceed 35~ and that only 4 bedrooms are permitted. Revised plans showing said .increased setback, maximum 35~ lot coverage and 4 bedrooms shall be submitted in connection with the building permit. 2209H AZA 87-08 Page 2 Variance No. 3659 2. That prior to final building and zoning inspections, Condition No. 1, above-mentioned, shall be complied with. 3. That approval of this application constitutes approval of the .proposed project only to the extent it complies with the Anaheim Municipal Zoning Code and any other applicable City regulations. Approval does not include any action or findings as to compliance or approval of the project regarding any other applicable. .ordinance, regulation or requirement.
